Ordinance No. 846 1 2 3 4 5 6 ORDINANCE NO. 846 AN ORDINANCE OF THE CITY OF VERNON REGULATING THE INSTALLATION, ARRANGEMENT, ALTERATION, REPAIR, USE AND OPERATION OF PLUMBING AND DRAINAGE SYSTEMS ON PREMISES WITHIN THE CITY OF VERNON.,. AND ADOPTING THE UNIFORM PLUMBING CODE AND ITS APPENDICES A THROUGH H, 1973 EDITION BY REFERENCE. . THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: SECTION 1: The Uniform Plumbing Code and its appendices 7 A through H, 1973 edition, and the installation Standards prepared 8 and published by the International Association of Plumbing and 9 Mechanical Officials is hereby adopted as the Plumbing Code of 10 the City of Vernon. 11 SECTION 2: Administration. This Ordinance shall be 12 known as the Uniform Plwnbing Code, may be cited as such and will 13 be referred to in the Ordinance as "this code". 14 SECTION 3: Application and Scope. The provisions of 15 this code shall apply to all new construction, relocated buildings 16 portable buildings, commercial coaches, and to any alterations, 17 repairs or reconstruction, except as provided for otherwise in 18 this code. 19 20 21 22 23 SECTION 4: Department having Jurisdiction. The office of the Administrative Authority is the City Council of the City of Vernon or whoever may be designated by them by resolution or minute order from time to time. SECTION 5: Duties of the Administrative Authority. The Administrative Authority shall maintain public office hours necessary to efficiently administer the provisions of this code a nd shall perform the following duties: (1) Require submission of, examine and check plans and specifications, drawings, descriptions, and/or diagrams necessary to show clearly the character, kind and extent of work covered by applications for a permit and upon approval thereof shall issue the permit applied for. (2) Administer and enforce the provisions of this code 24 25 26 27 28 29 30 31 32 -1- 1 in a manner consistent with the intent thereof and shall inspect 2 all plumbing and drainage work authorized by any permit to assure 3 compliance with provisions of this code, approving or condemning 4 said work in whole or in part as conditions require. 5 (3) Issue upon request a Certificate of Acceptance for - 6 any work approved by him. 7 (4) Condemn and rej ect all work done or being done or 8 materials used or being used which do not, in all respects, com- 9 ply with the provisions of this code. 10 (5) Order changes in workmanship and/ or materials 11 essential to obtain compliance with all provisions of this code. 12 (6) Investigate any construction or work regulated by 13 this code and issue such notices and orders as provided in 14 15 Section 7. " (7) Keep a complete record of all the essential trans- 16 actions of his office 17 SECTION 6: Right of Entry. The Administrative Authority 18 and authorized representatives shall carry proper credentials of 19 their respective office, upon exhibition of which they shall have 20 the right of entry, during usual business hours, to inspect any 21 and all buildings and premises in the performance of their duties. 22 23 SECTION 7: Dangerous and Insanitary Conditions. (a) Any portion of a plumbing system found by the 24 Administrative Authority to be insanitary, as defined herein, is 25 hereby declared to be a nuisance. 26 (b) Whenever brought to the attention of the department 27 having jurisdiction that any insanitary conditions exist or that 28 any construction or work regulated by this code is dangerous, 29 unsafe, insanitary, a nuisance or menace to life, health or pro- 30 perty, or otherwise in violation of this code, the said department 31 may request an investigation by the Administrative Authority who, 32 upon determining such information to be fact, shall order any -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 person, firm or corporation using or maintaining any such condi- tion or responsible for the use or maintenance thereof to discon- tinue the use or maintenance thereof or to repair, alter, change, remove or demolish same as he may consider necessary for the proper protection of life, health or property and in the case of any gas piping or gas appliance may order any person, firm or corporation, supplying as to such piping or appliance to discontinu supplying gas thereto until such piping or appliance is made safe to life, health or property. Every such order shall be in writing, addressed to the owner, agent or person responsible for the premises in which such condition exists and shall specify the date or time for compliance with such order. 14 (c) Refusal, failure or neglect to comply with any such 15 notice or order shall be considered a violation of this code. 16 (d) When any plumbing system is maintained in violation 17 of this code and in violation of any notice issued, pursuant to the 18 provisions of this section, or where a nuisance exists in any 19 building or on a lot on which a building is situated, the Adminis- 20 21 22 23 24 25 26 27 28 29 30 31 32 trative Authority shall institute any appropriate action or pro- ceeding in any court of competent jurisdiction to prevent, restrain, correct or abate the violation or nuisance. SECTION 8: Violation and Penalties. Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction there- of shall be fined in an amount not exceeding Three Hundred Dollars ($300.00), or be imprisoned in the County Jail of the County of Los Angeles, or the City Jail of the City of Vernon, as the com- mitting magistrate may direct, for not more than ninety (90) days, or by both such fine and imprisonment, in the discretion of the Court. Each day such violation is committed or permitted to con- tinue, shall constitute a separate offense and shall be punishable -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 as such hereunder. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the pro- visions of this code. No permit presuming to give authority to violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorized is lawful 0 The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from there- after requiring the correction of errors in said plans and speci- fications or from preventing construction operations being carried on thereunder when in violation of this code or of any other ordinance or from revoking any certificate of acceptance when is- sued in erroro Every permit issued by the Administrative Authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within one hundred twenty (120) days from the date of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one hundred twenty (120) days. Before such work can be recom- menced, a new permit shall be first obtained so to do, and the fee therefor shall be one-half (1/2) the amount required for a new permit for such work, provided no changes have been made, or will be made, in the original plans and specifications for such work; and, provided further, that such suspension or abandonment has not exceeded one (1) yearo SECTION 9: Permit required. (a) It shall be unlawful for any person to install, remove, alter, repair or replace, or cause to be installed, removed, altered, repaired or replaced, any plumbing, gas or drainage piping work or any fixture or water heating or treating -4- 1 equipment in a building or premises without first obtaining a per- 2 mit to do such work from the Administrative Authority 0 3 (b) A separate permit shall be obtained for each 4 building or structure. 5 (c) No person shall allow any other person to do or 6 cause to be done any work under a permit secured by a Permittee 7 except persons in his employ. 8 SECTION 10: Work not requiring Permit. 9 No permit shall be required in the case of any repair 10 work as follows: the stopping of leaks in drains, soil, waste or 11 vent pipe, provided, however, that should any trap drainpipe, soil, 12 waste or vent pipe be or become defective and it becomes necessary 13 to remove and replace the same with new material in any part or 14 parts, the same shall be considered as such new work and a permit 15 shall be procured and inspection made as hereinbefore provided. 16 No permit shall be required for the clearing of stop- 17 pages or the repairing of leaks in pipes, valves or fixtures, when 18 such repairs do not involve or require the replacement or rear- 19 rangement of valves, pipes or fixtures. 20 SECTION 11: Application for Permit. 21 Applications for plumbing permits describing the work 22 to be done shall be made in writing by a plumbing contractor, 23 maintenance plumber, or their authorized representative. Where a 24 license is required by the State of California, a permit shall not 25 be issued unless the applicant has such a license. 26 Applications shall give the location where such work is 27 to be done, either by street and house number, by lot, block and 28 tract, or similar description, that will readily identify and 29 definitely locate the proposed work. The application shall be 30 upon a form specified by the Director of Public Works of the City 31 of Vernon. 32 Each such application shall be accompanied by such -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 plans as may be required by the Director of Public Works of the City of Vernono SECTION 12: Cost of Permit. Every app licant for a permit to do work regulated by this code shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in connection therewith, together with such information, pertinent thereto, as may be required. Any person who shall commence any work for which a permit is required by this code, without first having obtained a permit therefor, shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by this section for such work, provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor prior to the commencement of the work. In all such cases, a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. When a permit has been obtained to connect an existing building or existing work to the public sewer, or to connect to a new private disposal facility, the backfilling or private sewage disposal facilities abandoned consequent to such connec- tion is included in the building sewer permito A fee for each plumbing permit shall be paid to the City Clerk as set forth by resolution of the City Council. SECTION 13: All Work to be Inspected. All plumbing and drainage systems shall be inspected by the Administrative Authority to insure compliance with all the requirements of this codeo . .00 0 0 0 0 -6- 1 SECTION 14: Notification. 2 It shall be the duty of the person doing the work 3 authorized by the permit to notify the Administrative Authority 4 orally,or in writing, that said work is ready for inspection. 5 Such notification shall be given not less than twenty-four (24) 6 hours before the work is to be inspected. 7 It shall be the duty of the person doing the work 8 authorized by the permit to make sure that the work will stand the 9 tests prescribed elsewhere in this code, before giving the above 10 notification. 11 SECTION 15: Any person regularly employing one or more 12 plumbers for the purpose of installation, alteration, maintenance 13 or repair on his or its own premises shall make periodic reports 14 covering all installations, additions or alterations and shall pay 15 for each thereof the permit fees provided for in this Ordinance. 16 All such work shall be installed and done in accordance with the 17 provisions of this Ordinance and such work shall be subject to 18 inspection by the Director of Public Works in accordance with 19 Section 318 of the Uniform Plumbing Code. 20 SECTION 16: Where a building or structure, or a portion 21 thereof, has its occupancy changed to a different group, or a 22 different division of the same group, as defined in the Uniform 23 Building Code as adopted by ordinance of the City of Vernon, the 24 plumbing installation in the affected building or structure or 25 portion thereof shall be made to comply with the requirements of 26 this Ordinance. 27 SECTION 17: Allowance of Variance or Exception From 28 Requirements of Code. Whenever the Director of Public Works shan. 29 find, upon the basis of reliable evidence, information or opinion 30 placed before him that the public health, safety, and welfare will 31 not be adversely affected or, in the alternative, will be well 32 served thereby, he may, in his discretion and subject to such -7- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 conditions and limitations as he may see fit to impose, relieve an applicant for a plumbing permit from one or more of the require- ments of this Code, and, without limiting the foregoing, may autho- rize the substitution of materials, types of installation and safety equipment or devices. All requests seeking the allowance of a variance or exception fmm the requirements of this Code shall be presented to the Chief of the Fire Department for recommenda- tions if applicable, for allowance or rejection and for the terms, conditions and limitations, if any, which said Fire Chief and said Director of Public Works recommend be imposed upon such permit, if granted. The Director of Public Works shall, prior to his making his findings, solicit and include therein the recommendations of other departments of the City, which may be affected by the request for a variance or exception from the requirements of this Code. Any applicant for a plumbing permit seeking a variance or exception from the requirements of this Code, which variance or exception has been denied or granted subject to the conditions or limitations, pursuant to the foregoing provisions of this SECTION 17 may request a hearing before the City Council for the purpose of obtaining a new or different decision with respect to said request for a variance or exceptiono Such request for a hearing must state the following: 10 The name and mailing address of the applicant for the purposes of the requested hearing. 20 A method of identification of the application or applications involved, and the previous decision of the Director of Public Works or of the City Council, if any, with respect to each such application. 3. The specific ruling which the applicant requests be made by the City Council with respect to each such application. 40 A brief summary in non-technical language of the points or contentions to be made by applicant at the requested -8- 1 hearing, which summary shall be sufficient to inform any interest 2 person who may wish to meet or refute applicant's presentation at 3 the hearing. 4 The City Council shall set a time and place for a 5 hearing on such application providing it shall comply with the 6 foregoing requirements, which hearing shall take place not more 7 than thirty (30) days after receipt of the applicant's request. 8 In the event that the request for hearing does not comply with 9 the foregoing requirements, no hearing shall be set and the City 10 Clerk shall advise the applicant of the City Council's findings 11 and that no hearing shall be set until such requirements are met. 12 Such latter notice shall be mailed by the City Clerk to the 13 applicant by United States mail, postage pnepaid, to the address 14 shown on the request for hearing, and if no adequate address is 15 shown thereon, the City Clerk shall make a reasonable effort to 16 locate an address for the applicant, to which the notice may be 17 mailed and, failing to find such address, no notice shall be sent. 18 SECTION 18: If any section, sentence, clause, phrase, or 19 portion of this Ordinance is for any reason held to be invalid or 20 unconstitutional by the decision of any court of competent juris- 21 diction, such decisions shall not affect the validity of the 22 remaining portion or portions of this Ordinance. 23 SECTION 19: Every violation of this Ordinance is hereby 24 declared to be a public nuisance. 25 SECTION 20: There being no newspaper printed. published 26 and circulated in the City of Vernon, the City Clerk is hereby 27 directed to certify to the passage of this Ordinance and shall 28 post the same, or cause the same to be posted, in three of the 29 most public places in the City of Vernon, to wit: The northwest 30 corner of 38th Street and Santa Fe Avenue; the northeast corner 31 of Leonis Boulevard and Pacific Boulevard; and on the bulletin 32 board in the lobby of the City Hall of said City, located at -9- 1 4305 Santa Fe Avenue, all in the City of Vernon, County of Los 2 Angeles; that this Ordinance shall be in full force and effect 3 as of April 15) 1974. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ADOPTED AND APPROVED this 5th day of March , 1974. ~-r~~~' / Mayor ~' .
