OF VERNON~ CALIFORNIA, 1959, BY AMENDING SEC. 7.15-2 OF SAID CODE

4 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS:
5 SECTION 1: That Sec. 7.15-2(5) is hereby amended to read as

(5) Section 204 of such Uniform Building Code is hereby
8 stricken in its entirety, including the heading 'Board of
9 Appeals', and in lieu of such section and heading there is
10 inserted the following:
11 'ALLOWANCE OF VARIANCE OR EXCEPTION FROM REQUIREMENTS
OF CODE.

'Section 204. Whenever the City Council of the City of
Vernon shall find upon the basis of reliable evidence infor-
lTlation or opinion placed before it that the public health,
safety, and welfare v;i11 not be adversely affected or, in the
alternative, will be well served thereby, the said City
Council may, in its discretion and subject to such conditions
and limitations as it may see fit to impose, relieve an
applicant for a building permit from one or more of the re-
quirements of this Code, or any other Ordinances of the City
of Vernon relating to building construction, drainage, street
frontage requirements, health or fire requirements, insofar
as they relate to building construction, and, without limi-
ting the foregoing, may authorize the substitution of materials
types of construction and safety equipment or devises. All
applications for building pern1its seeking the allowance of a
variance or exception from the requirements of this Code shall
be presented to the City Council by the Building Official,
with his written recommendations and the written recommenda-
tions of a representative of the Fire Department, and the
written recommendations of the Traffic Engineer regarding

frontage requirements, if the same be applicable, for
allowance or rejection and for the terms, conditions, and
limitations, if any, which said Building Official and said
representative of the Fire Department recommend be imposed
upon such permit, if granted by the City Council. The
Building Official shall, prior to making his reco~nendations,
solicit and include therein the recommendations of other
departments of the City, which may be affected by the request
for a variance or exception from the requirements of this Code.
'Any applicant for a building permit seeking a variance
or exception from the requirements of this Code, which variance
or exception has been refused or granted subject to conditions
or limitations, pursuant to the foregoing provisions of this
Section 204, may request a hearing before the City Council
for the purpose of obtaining a new or different decision with
respect to said request for a variance or exception. Such
request for a hearing must state the following:
'10 The name and mailing address of the applicant for
purposes of the requested hearing.
'2. A method of identification of the application or
applications involved, and the previous decision of the
Building Official or of the City Council, if any, with respect
to each such application.
'30 The specific ruling which the applicant requests be
made by the City Council with respect to each such app1icationo
'40 A brief summary in non-technical language of the
points or contentions to be made by applicant at the requested
hearing, which summary shall be sufficient to inform any in-
terested person who may wish to meet or refute applicant's
presentation at the hearing.'
'The City Council shall set a time and place for a
hearing on such application, provided it shall comply with the

fo::egoing requirements, 'which hearing shall ta.ke p lace not
morE' tban thirty days after receipt of the app licant' s request.
and upon not less than ten days' written notice from the City
Clerk, mailed to the applicant by United States mail, postage
prepaid, to the address sho1;vn on the request for hearing. In
the event that the request for hearing does not comp 1y I:vith
the foregoing requirements, no hearing shall be set and the
City Clerk shall advise the applicant of the City Council's
finding and that no hearing shall be set unt~l such require-
ments are met. Such latter notice shall be mailed by the
City ClerJ., to the applicant by United States mail, postage
prepaid, to the address 8hO\\ln on the request for hearing, and
if no adequate address is shown thereon, the City Clerk shall
make a reasonable effort to locate an address for the appli-
cant to which the notice may be mailed and, failing to find
such address, no notice shall be sent.' 11
SECTION 2: There being no newspaper printed, published and
circulated in the City of Vernon, the City Clerk is hereby directe
to certify to the passage of this Ordinance and shall post the
same or cause the same to be posted in three (3) of the most public
places in the City of Vernon, to wit: the northwest corner of 38t
Street and Santa Fe Avenue, the northeast corner of Leonis Boule-
vard and Pacific Boulevard, and on the bulletin board in the lobby
of the City Hall of said City, located at 4305 Santa Fe Avenue, al
in the City of Vernon, County of Los Angeles, State of California;
that this Ordinance shall be in full force and effect thirty (30)
days from and after said posting.
ADOPTED AND APPROVED this 3rd day of September 1974
