Ordinance No. 853 10 11 12 1 2 3 4 5 ORDINANCE NO. 853 AN ORDINANCE OF THE CITY OF VERNON AMENDING THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959. THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: SECTION 1: The following SECTIONS of the CODE OF THE CITY 6 OF VERNON, CALIFORNIA, 1959, are hereby deleted in their entirety: 7 (1) Sec. 11.1; (2) Sec. 11.2; (3) Sec. 11.3; (4) Sec. 1l.4; 8 9 (5) Seco 11.5; (6) Seco 11.6; (7) Seco 1107; (8) Seco 11.8; (9) Sec. 1109; (10) Seco 11. 10 ; (11) Seco 11. 11; (12) Sec. 11. 12; (13) Sec. 11. 13 ; (14) Sec. 11. 14; (15) Sec. 11.15 ; (16) Sec. 1l.16; (17) Sec. 11.17 and (18) Sec. 11.18. 13 read as follows: SECTION 2: Sec. ll.24(a) of said CODE is hereby amended to 14 "(a) Food or beverages which are at all times, while on 15 such vehicle, thoroughly enclosed and protected in hermetic- 16 ally-sealed cans or bottles not requiring refrigeration for 17 preservation. 11 18 SECTION 3: Seco 11024(c) of said CODE is hereby amended to 20 19 read as follows: 1I(c) Fresh or frozen fish; provided, however, that delivery 21 shall be confined to whole unbroken boxes or lots. The fish 22 shall be delivered within three hours after being loaded, in 23 containers completely covered with iceo A clean canvas or tar- 24 paulin shall cover all containers while in transit. The vehicle 25 shall be provided with a sloping metal floor turned up on all 26 sides and draining to a tank or container, so as to prevent the 27 spilling, draining, or dumping of any waste liquids from such 28 fish-truck on any street, sidewalk, or premiseso" 29 SECTION 4: Sec. 11.25 of said CODE is hereby amended to 30 read as follows: 31 "Sec. 11025. Permit required. 32 It shall be unlawful for any person to deliver or -1- 1 transport food in a Wholesale food vehicle within the City 2 without first applying for and receiving a health permit for 3 each such vehicle from the health department. Such health 4 permit shall be in addition to any other license or permit 5 required by the City. The City Council shall establish by 6 resolution health permit inspection fees for wholesale food 7 vehicles. Such permit shall be issued for a period not 8 exceeding twelve (12) months, shall expire on June 30th of 9 each succeeding year and shall be renewed annually. App1ica- 10 tion for initial permits and for renewal shall be made to the 11 Health Department. At the time application is made, there 12 shall be paid to the City Clerk the annual fee established by 13 the City Counci10ff 14 SECTION 5: Sec. 13.6 of said CODE is hereby amended by 15 adding the following definitions in appropriate alphabetical 16 sequence: 17 ffConnnercial Agricultural Operationll is the use of any pro- 18 perty to house or raise animals, fowls or plants for consumption 19 or other use wherein the animals, fowls, plants or their by-pro- 20 ducts are not entirely used or consumed on that property or by 21 the persons occupying the propertyo This definition shall also 22 include such operations as kennels, holding pens and stables. 23 ttLaundry"0 Any room, building or place or portion thereof, 24 maintained, used or operated for the purpose of commercially 25 laundering clothing, articles for personal wear, household linens 26 rags or materials used for domestic, commercial or industrial 27 purposeso 28 "Laundry Vehicletlo Any vehicle used in whole or in part for 29 the transportation of clothing, linens, rags or other materials 30 to or from a commercial laundry by such laundry or by the 31 operator of an independent laundry business. 32 "Solid Waste Disposal Site" is any site, facility or loca- -2- 1 tion which is used or maintained for the final disposal of solid 2 waste 0 3 "Solid Waste Processing Facility" is any site, facility or 4 location which is used or maintained for the storage and re-use, 5 recycling, reduction, separation, recovery or conversion of 6 solid waste. Solid Waste Processing Facility shall not include 7 a company which is recycling solid waste material produced as a 8 result of its own manufacturing process,provided such solid 9 waste remains on the premises where produced until re-used. 10 "Solid Waste Transfer Station" is any site, facility or 11 location which is used or maintained for the temporary storage 12 of solid waste after being collected and before being conveyed 13 to a solid waste processing facility or disposal siteo 14 SECTION 6: Seco 13.6 of said CODE is hereby amended by 15 deleting the existing definition of "Solid Waste", and inserting 16 in lieu thereof the following: 17 "Solid Waste" means all putrescible and nonputrescible 18 solid and semi-solid wastes, including garbage, trash, refuse, 19 paper, rubbish, ashes, industrial wastes, demolition and construc 20 tion wastes, abandoned vehicles and part thereof, discarded home 21 and industrial appliances, manure, vegetable or animal solid and 22 semi-solid wastes, and other discarded solid and semi-solid 23 wastes. 24 SECTION 7: Seco 1306 of said CODE is hereby amended by 25 deleting the definition "Private Rubbish Disposal Vehicle", and 26 inserting in lieu thereof the following: 27 "Private Rubbish Disposal Vehicle" 0 Any vehicle used in 28 whole or in part to convey solid waste to a solid waste disposal 29 site, transfer station, or processing facility from a location or 30 locations in the City. Private Rubbish Disposal Vehicle shall 31 not include a vehicle operated by a company in the City to convey 32 solid waste from its place of business to a solid waste disposal -3- 1 site, transfer station or processing facility or a vehicle used 2 by a provate individual to convey solid waste from his home to 3 a solid waste disposal site, transfer station or processing 4 facility, or a vehicle used by a governmental entity. 5 SECTION 8: The health permits required, pursuant to Sec. 6 13.7 of said CODE, for the occupations, classifications or cate- 7 gories as set forth therein, ate hereby amended to read as follows: 8 "(a) Caterer; (b) Cesspool and Sump Pump Vehicle; (c) Com- 9 mercia1 Agricultural Operation; (d) Food Processing Establish- 10 ment; (e) Food Vending Machine Business; (f) Food Warehouse; 11 (g) Laundry; (h) Laundry Vehicle; (i) Offal Vehicle; (j) Render- 12 ing Plant; (k) Restaurant; (1) Retail Food Delivery Vehicle; 13 (m) Retail Food Preparation Vehicle; (n) Retail Food Production 14 and Marketing Establishment; (0) Retail Fruit and Vegetable 15 Vehicle; (p) Retail Packaged Food Vehicle; (q) Rubbish Disposal 16 Business; (r) Solid Waste Disposal Site;(s) Solid Waste Process- 17 ing Facility; (t) Solid Waste Transfer Station; (u) Water Supply 18 Utility" 19 SECTION 9: There being no newspaper printed, published 20 and circulated in the City of Vernon, the City Clerk is hereby 21 directed to certify to the passage of this Ordinance and shall 22 post the same or cause the same to be posted in three (3) of the 23 most public places in the City of Vernon, to wit: the northwest 24 corner of 38th Street and Santa Fe Avenue, the northeast corner 25 of Leonis Boulevard and Pacific Boulevard, and on the bulletin 26 board in the lobby of the City Hall of said City, located at 27 4305 Santa Fe Avenue, all in the City of Vernon, County of Los 28 Angeles, State of California; that this Ordinance shall be in 29 full force and effect thirty (30) days from and after saidpo~~ November 30 ADOPTED AND APPROVED this 5th day of ~~~, 1974. 31 32 .. ~-'l../ IEMER, C~ty C erk -4- 101 I 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 ~2 1 STATE OF CALIFORNIA 2 I COUNTY OF LOS ANGELES 31 ) ) ss. ) 4 I, F.
