Ordinance No. 854 1 ORD~NANCE NO. 854 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING CHAPTER 3 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, 3 WHICH PROVIDES FOR THE LICENSING, IMPOUNDING AND REGULATING THE KEEPING, SALE AND EXHIBITION OF ANIMALS BY AMENDING CERTAIN SECTION 4 THERETO 5 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: 6 SECTION 1: Sec. 3.13 IS HEREBY AMENDED: 7 Seco 3.13. Director to issue dog license tags; fee. 8 Pursuant to chapter 3 (commencing with section 30801) of 9 division 14 of the Food and Agricultural Code, the director shall 10 issue serially numbered metallic dog license tags stamped with the 11 name of the county and the year of issue and shall collect for each 12 such tag a fee as prescribed in Article IX of this chapter. 13 SECTION 2: Sec. 3.17 IS HEREBY AMENDED: 14 Sec. 3.17. Fee to be paid in advance. 15 The fees provided for herein shall be paid annually in 16 advance to the director. The full amount of any such fee is payab1 17 for any fraction of a year. 18 SECTION 3: Seco 3.18 IS HEREBY AMENDED: 19 Seco 3.18. Register of dog license tags. 20 The director shall procure the number of license receipts and 21 dog license tags needed each year and shall keep a register wherein 22 shall be entered the name and address of each person to whom any 23 dog license tag isissued, the number of such tag, the date of is- 24 suance thereof, and a description of the dog for which issued. 25 SECTION 4: Sec. 3020 IS HEREBY AMENDED: 26 Sec. 3.200 Conditional acceptance of fee for dog not 27 vaccinated. 28 The director may accept the payment of the fee for a license 29 tag and a license for a dog who has not been vaccinated as required 30 by this chapter on condition that the owner of such dog, within 31 five days thereafter, have such dog vaccinated and submit the re- 32 quired veterinarian's certificate to the director. Upon receipt of -1- 1 such certificate the director shall issue the license tag and 2 licenseo 3 SECTION 5: Sec. 3.2l IS HEREBY AMENDED: 4 Sec. 3021. Form of licenseo 5 A license for an individual dog shall be in the form of a 6 receipt for the fee paid for the dog license tag and the additional 7 amount, if any, paid for the license. 8 SECTION 6: Seco 3.22 IS HEREBY AMENDED: 9 Sec. 3.220 Licenses and tags for guide dogs and dogs 10 honorably discharged from armed forces. 11 Every dog license tag issued prior to July 1, 1954, for a dog 12 of either sex which has been honorably discharged from the armed 13 forces of the United States or for a dog of either sex owned by a 14 blind person, if a certificate was filed with the tax collector of 15 the county, executed by some recognized dog training institution 16 which certifies that such dog has been successfully trained to lead 17 the blind, shall continue to be valid as both dog license tag and 18 license so long as the same dog is owned or harbored by the same 19 persono Every person owning or having custody or control of a dog 20 of either sex over the age of four months which has been honorably 21 discharged from the armed forces of the United States, or a dog of 22 either sex owned by a blind person who submits proof to the directo 23 that such dog has been successfully trained to lead the blind perso 24 as a guide dog (for which a dog license tag was not issued prior to 25 July 1, 1954) shall procure a dog license tag and a license, which 26 dog license tag and license shall be good while such dog is owned 27 or harbored by the same persono No fee shall be charged for such 28 license over and above the fee required for the dog license tag. 29 SECTION 7: Seco 3023 IS HEREBY AMENDED: 30 31 Sec. 30230 License fee. Every person owning or having custody or control of any dog 32 or dogs over the age of four months in the city, not covered by -2- 1 the provisions of section 3.22, shall first obtain an annual 1i- 2 cense from the director for each of such dogs, and at the same 3 time obtain a dog license tag, and for the license or licenses, 4 in addition to the fee for the dog license tag, shall pay an addi- 5 tional fee for the dog license as prescribed in Article IX of this 6 chapter 0 Pursuant to Section 30804.5 of the Food and Agricultura 7 Code, any dog license tag and license shall be issued for one-hal 8 of the fee required if a certificate is presented from a licensed 9 veterinarian that the dog has been spayed or neutered. 10 SECTION 8: Sec. 3.24 IS HEREBY AMENDED: 11 Seco 3.24. Vaccination requirements for issuance 12 of licenseo 13 The director shall not issue a dog license unless the appli- 14 cant exhibits a certificate signed by a veterinarian licensed 15 either by this state or by any other state to practice veterinary 16 medicine that: (a) the period of time elapsing from the date of 17 vaccination with approved killed virus vaccine to the date of 18 expiration of the license being issued does not exceed eighteen 19 months, or (b) the period elapsing from the date of vaccination 20 with approved live virus vaccine to the date of expiration of the 21 license being issued does not exceed thirty months or (c) such 22 dog should not be vaccinated with rabies vaccine because such 23 vaccination would jeopardize the health of such dog due to infir- 24 mity or other disability, which infirmity or other disability, 25 and the estimated date of termination thereof, is shown on the 26 face of the certificate to the satisfaction of the director. A 27 person who obtains a license without submitting a certificate of 28 vaccination because of the infirmity or disability of the dog, 29 shall within 10 days after the termination of such infirmity or 30 disability, cause such dog to be vaccinated as required by 31 Article IVo 32 . .0. 0 4) -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION 9: Sec. 3.25 IS HEREBY AMENDED: Sec. 3.25. Facts to be shown on license. When the director issues a dog license, he shall show on the receipt the age of the dog, the date of last vaccination and the type of vaccine used as shown on the veterinarian's certificate, or if the license was issued without proof of vaccination, the rea son thereforo SECTION 10: Sec. 3027 IS HEREBY AMENDED: Sec. 3027. Duplicate license tags. In case any license tag for an individual dog is lost or des- troyed, a duplicate thereof may be procured from the director upon the submission to the director of such proof as he may require and upon the payment therefor of the fee prescribed in Article IX of this chapter. SECTION 11: Sec. 3.30 IS HEREBY AMENDED: Sec. 3030. Transfer of tag and license to new owner. If, during a license period a dog is sold or title to the dog is otherwise transferred to a new owner, such new owner may apply to the director for a transfer of such dog's tag and license and pay the prescribed transfer fee. Upon receipt of such application and fee the director shall issue a certificate of transfer of such tag and license showing the number of the tag and the names and addresses of the former and new owners. SECTION 12: Sec. 3.56 IS HEREBY AMENDED: Sec. 3056. Inspection fee. Each new applicant for a license covered by this article shall, in addition to the regular license fee, deposit with the director an inspection fee as prescribed in Article IX of this chapter to cover the cost of inspecting and processing the license application. License fees for wild animals, kennels, etco In addition to any other fees required by this chapter, before receiving an application for the granting of any license required by this article, the tax collector shall require the payment of a license fee as prescribed in Article IX for the following: (a) Dog kennel, (b) Cat kennel, (c) Pet shop, (d) Animal menagerie, (e) Animal exhibition (annual), (f) Animal exhibition (daily), (g) Wholesale wild animal dealer, (h) Wild animal, per animal (if not included in (g)). SECTION 14: Seco 3.72 IS HEREBY AMENDED: Sec. 3072. Fees for holding estray bovine animals, horses, etc. The director shall hold all estray bovine animals, horses, mules and burros impounded by him as provided in chapter 7 (com- mencing with section 17001) of division 9 of the Food and Agri- cultural Codeo If any person appears and claims any animal referred to in this section, prior to the time that it is turned over to the California State Department of Food and Agriculture, the director shall collect fees as prescribed in Article IX of this chapter for the following: (a) Impounding 0 (b) Board and care - for each day or fraction thereof except the day of impounding during which the animal is in the animal shelter, except that the director shall charge only fifty percent of the prescribed fees if the impounded animal is under three months of age. SECTION 15: Seco 3.77 IS HEREBY AMENDED: Seco 3077. Delivery of impounded cat or dog to researc institutiono -5- 1 2 3 4 5 6 7 8 Any approved research institution may, at any time, request the dir ector to deliver to . t d ~ any og or cat impounded by him, Not less than five or more than thirty days after the taking and impounding of any dog or cat, unless such dog or cat has been redeemed by the owner, the d~rector shall d 1" 4 e ~ver to the approved research institution at the place of impounding the dogs or cats 0 both designated by it, upon payment of the fee as prescribed in this chapter, except the director shall not deliver any dog or cat, to any approved research institution if the owner of such dog or cat has instructed the director not to do sOo SECTION 16: Sec. 3.78 IS HEREBY AMENDED: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Seco 30780 Destruction or sale of impounded dog or cato Not less than 5 days after the taking up and impounding of any dog or cat herein provided, unless it be sooner redeemed or delivered to an approved research institution, the director shall destroy such dog or cat or shall dispose of such dog or cat to any other person who will pay the reasonable value of such dog or cat, in no case less than the minimum fees prescribed in Article IX. In the case of the sale of a dog (other than delivery to an ap- proved research institution) the purchaser also shall procure and pay for the required license for such dog for the current year unless such a license already is issued and in full force and effec . SECTION 17: Seco 3.86 IS HEREBY AMENDED: Seco 30860 Fees for redemption; vaccination, etco, of impounded dogs and cats. Fees shall be collected by the director as prescribed in Article IX of this chapter for the following: (a) Redeeming of impounded dog or cat, (b) Vaccination by the county veterinarian, (c) for each day or fraction thereof for feeding and caring for an dog or cat during which such animal is kept in the shelter except the day in which it is impounded 0 -6- 1 SECTION 18: Sec. 3.93 IS HEREBY AMENDED: 2 Sec. 3093. Employment of private veterinarian; re- 3 deeming owner to pay fee. 4 The director may employ a private veterinarian whenever he 5 deems it necessary in order to properly care for and maintain any 6 animal, and the cost thereof, not exceeding the amount prescribed 7 in this chapter, shall be a county charge. When a veterinarian's 8 fees have been paid or incurred for the care or treatment of any 9 animal, such animal shall not thereafter be redeemed without pay- 10 ment by the owner of such fees, in addition to any and all other 11 fees, so as to reimburse the county for its cost for veterinarian 12 service for such animal. 13 SECTION 19: That there shall be added to and made part of 14 this Animal Ordinance the following Article: 15 ARTICLE IX. Amount of Fees 16 Sec. 3.111. Fees; same as Los Angeles County Animal 17 Ordinance. 18 Wherever fees are prescribed for tags, licenses, duplicate 19 license tags, transfer of tags or licenses, inspections, kennels, 20 wild animals, vaccinations, impounding, care and feeding, sale of 21 animals, veterinarian services, or for any other purposes require 22 23 24 25 26 27 SECTION 21: There being no newspaper printed, published 28 and circulated in the City of Vernon, the City Clerk is hereby 29 directed to certify to the passage of this Ordinance and shall 30 post the same, or cause the same to be posted, in three of the 31 most public places in the City of Vernon, to wit; the northwest 32 corner of 38th Street and Santa Fe Avenue; the northeast corner -7- by this chapter, the amount of said fees shall be the same as those prescribed in the Los Angeles County Animal Ordinance and as may be amended by the Los Angeles County Board of Supervisors. Sec. 3.25. Facts to be shown on license. (9943 2-13-70) The Director may accept the payment of the fee for a license tag and a license for a dog who has not been vaccinated as required by this ordinance on condition that the owner of such dog, within five days thereafter, have such dog vaccinated and submit the required veterinarian's certificate to the Director. Upon receipt of such certificate the Director shall issue the license tag and license. Sec. 409. A license for an individual dog shall be in the form of a receipt for the One Dollar ($1.00) paid for the dog license tag and the additional amount, if any, paid for the license. Sec. 410. Every dog license tag issued prior to July 1, 1954, for a dog of either sex which has been honorably discharged from the armed forces of the United States or for a dog of either sex owned by a blind person, if a certificate was filed with the Tax Collector executed by some recognized dog train- ing institution which certifies that such dog has been suc- cessfully trained to lead the blind, shall continue to be valid as both dog license tag and license so long as the same dog is owned or harbored by the same person. Every person owning or having custody or control of a dog of either sex over the age of four (4) months which has been honorably dis- charged from the armed forces of the United States, or a dog of either sex owned by a blind person who submits proof to the Director that such dog has been successfully trained to lead the blind person as a guide dog (for which a dog license tag was not issued prior to July 1, 1954) shall procure a dog license tag and a license, which dog license tag and license shall be good while such dog is owned or harbored by the same person. No fee shall be charged for such license over and above the One Dollar ($1.00) required for the dog license tag. *Sec. 411. (10,961 9-6-74) Dog Licenses, Fees. Every person ~wning or having custody or control of any dog over the age of four (4) months in the unincorporated territory of the County of Los Angeles not covered by the provisions of Section 410 shall first obtain an annual license from the Director for each of such dogs and at the same time obtain a dog license tag, and for such license or licenses, in addition to the One Dollar ($1.00) fee for the dog license tag, shall pay Six Dollars ($6.00), a total of Seven Dollars ($7.00) in all. A person shall not attach to or keep upon, or cause or permit to be attached to or kept upon any dog, any tag provided for in Section 409 of this ordinance except a tag issued for such dog under the provisions of this ordinance, or attach or keep upon or cause or permit to be attached to or kept upon any dog or make or cause or permit to be made or have in possession, any counterfeit or imita- tion of any tag provided for in this ordinance. Sec. 419. (9943 2-13-70) If, during a license period a dog is sold or title to the dog is otherwise transferred to a new owner, such new owner may apply to the Director for a transfer of such dog's tag and license and pay a transfer fee of One Dollar ($1.00). Upon receipt of such application and fee the Director shall issue a certificate of transfer of such tag and the names and addresses of the former and new owners. Sec. ~20. An individual dog license shall be obtained for each dog in addition to a kennel license when such dog is not kept exclusively on the premises. No individual license shall be required for any dog in transit, or when attending a dog show in the care of a kennel representative. *Sec. 421. (10,961 9-6-74) Spayed or Neutered Dogs; Reduction in License Tag Fee. Pursuant to Section 30804.5 of the Food and Agricultural Code, any dog license tag issued pursuant to Section 411 of this ordinance shall be issued for one-half of the fee required if a certificate is presented from a licensed veterinarian that the dog has been spayed or neutered.
