Ordinance No. 859 1 ORDINANCE NO. 859 AN ORDINANCE OF THE CITY OF VERNON REGULATING THE INSTALLATION, ARRANGEMENT, ALTERATION, REPAIR, USE AID OPERATION OF ELECTRICAL WIRING, CONNECTIONS, FIXTURES, AND OTHER ELECTRICAL APPLIANCES AND EQUIPMENT ON PREMISES WITHIN THE CITY OF VERNON; ADOPTING BY REFE- RENCE THE NATIONAL ELECTRICAL CODE, 1975 EDITION; ANDAMENDING THE CODE OF THE CITY OF VERNON, 1959. 2 3 4 5 6 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: 7 SECTION l: The City Code of the City of Vernon, 1959, is 8 hereby amended by adding ~7D9 to CHAPTER 7 of said Code and by 9 repealing CHAPTER 9A therein in accordance with this Ordinance. 10 fI ~709 Electrical Code. 11 Sec. 7.9olo Title. The National Electrical Code, 1975 Edi- 12 tion, copyrighted 1974 by the National Fire Protection Association, 13 and the Regulations contained within this Ordinance shall be known 14 as THE ELECTRICAL ORDINANCE OF THE CITY OF VERNON, may be cited as 15 such, and shall be referred to in this Ordinance as "this Code". 16 Seco 7.9.2. Definitions. For the purpose of this Ordinance, 17 certain terms, phrases, words and their derivatives shall be con- 18 strued as set forth in this Section. Words used in the singular 19 include the plural and the plural the singular. The definitions 20 as set forth in this Ordinance shall include, without being limited 21 to, the following: 22 (a) APARTMENT HOUSE is any building or portion thereof, which 23 is designed, built, rented, leased, let or hired out to be occupied 24 or which is occupied, as the home or residence of three or more 25 families living independently of each other and doing their own 26 cooking in said building and the term APARTMENT HOUSE shall include 27 28 flats and apartments. (b) BUILDING is any structure built for the support or shel- 29 ter of persons, animals, chattels or property of any kind. 30 (c) DWELLING is any building or any portion thereof which is 31 not an APARTMENT HOUSE or a HOTEL, as defined in this Ordinance, 32 and said Dwelling shall contain one or more apartments or guest -l- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 rooms used, intended or designed to be built, used, rented, lease , let or hired out to be occupied, or which are occupied for living purposes. (d) ELECTRIC or ELECTRICAL WIRING means the installation or the alteration of any material, fixture, device, appliance or equipment in or on any building, structure or premises used or de- signed or intended to be used to generate, transmit, transform, or utilize electric energy. (e) ELECTRICAL CONTRACTOR is a person who is engaged in the business of installing or repairing electrical wiring or equipment, or who does or holds himself out as willing to do personally, or through his employees, any work or services in connection with the installation, alteration, or repair of any electrical wiring or equipment, or part thereof, and who possesses an appropriate con- tractor's license pursuant to Chapter 9, Division 3 of the Busi- ness and Professions Code of the State of California. (f) HOTEL is any building containing six or more rooms in- tended or designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes b guests. (g) MAINTENANCE ELECTRICIAN is any electrician regularly employed in accordance with the provisions of Sec. 7.9.9(c) of this Ordinance. (h) PERSON is an individual human being, a firm, partner- ship or corporation, his or their heirs, executors, administrators assigns officers or agents. Sec. 7.9.3. Application and Scope. The provisions of this Ordinance shall apply to the construction, installation, altera- tion, moving, repair, maintenance and use of any electrical wiring on anypremises within the City of Vernon. The provisions of this Ordinance shall not apply to public utilities as specified in Sec. 7.9.9(d) herein, or to electrical wiring for street lighting -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 or traffic signals located primarily in the public right-of-way within the City of Vernon. Sec. 7.904. Department having Jurisdiction. The office of the administrative authority is the City Council of the City of Vernon or whoever may be designated by them by resolution or minute order from time to time. Sec. 70905. Duties of the Administrative Authority. The Administrative Authority shall maintain public office hours necessary to efficiently administer the provisions of this Ordi- nance and shall perform the following duties: (1) Require submission of, examine and check plans and specifications, drawings, descriptiorut and/or diagrams necessary to show clearly the character, kind and extent of work covered by applications for a permit and upon approval thereof shall issue the permit for which application is madeo (2) Administer and enforce the provisions of this Ordinance in a manner consistent with the intent thereof and shall inspect all electrical work authorized by any permit to assure compliance with provisions of this Ordinance, approving or condemning said work in whole or in part as conditions require. (3) Issue upon request a Certificate of Acceptance for any work approved by said Administrative Authority. (4) Condemn and reject all work done or being done or materials used or being used which do not, in all respects, comply with the provisions of this Ordinance. (5) Order changes in workmanship and/or materials essen- tial to obtain compliance with all provisions of this Ordinance. (6) Investigate any construction or work regulated by this Ordinance and issue such notices and orders as provided in Sec. 7. 9. 7 . (7) Keep a complete record of all the essential trans- actions of the Administrative Authority's office. -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Sec. 7.9.6. Right of Entry. The Administrative Authority and authorized representatives shall carry proper credentials of tl~ir respective offices. Upon exhibition of said credentials, they shall have the right of entry during usual business hours to inspect any and all buildings and premises in the performance of their duties. Sec. 7.9.7. Dangerous and Unsafe Conditions. (a) Any portion of any electrical installation found by the Administrative Authority to be unsafe, as defined herein, is hereby declared to be a nuisance. (b) Whenever brought to the attention of the Department having jurisdiction that any unsafe conditions exist, or that any construction or work regulated by this Ordinance is dangerous, un- safe~ a nuisance, or a menace to life, health or property, or otherwise in violation of this Ordinance, the said Department may request an investigation by the Administrative Authority, who upon determining such information to be fact shall order any person, firm, corporation or governmental agency using or maintaining any such condition or responsible for the use or maintenance thereof, to discontinue the use or maintenance thereof or to repair, alter, change, remove or demolish same as he may consider necessary for the proper protection of life, health or property and may order any person, firm, corporation or governmental agency, supplying electrical energy to the operation or premises in question to dis- continue supplying electrical energy until such unsafe conditions are made safe to life, health and property. Every such order shall be in writing, addressed to the owner, agent or person responsible for the premises in which such condition exists and shall specify the date or time for compliance with such order. (c) Refusal, failure or neglect to comply with any such notice or order shall be considered a violation of this Ordi- nance. -4- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 (d) When any electrical system is maintained in violation of this Ordinance and in violation of any notice issued, pursuant to the provisions of this section, or where a nuisance exists in any building or on a lot on which a building is situated, the Administrative Authority shall institute any appropriate action or proceeding in any court of competent jurisdiction to prevent, re- strain, correct or abate the violation or nuisance. Seco 7.9080 Application for Permits. (a) Permit Requiredo It shall be unlawful for any person to install, remove, alter, repair, or replace or cause to be in- stalled, removed, altered, repaired or replaced any electrical wiring, electrical device or electrical materials in a building or premises without first obtaining a permit to do such work from the Administrative Authority. (b) A separate permit shall be obtained for each building or structure. EXCEPTION~ Applications for single-family dwellings may include all accessory buildings such as garages, sheds, guest houses, and the like that are located on the same lot, erected at the same time, and supplied from the same service as the main building. (c) No person shall allow any other person to do or cause to be done any work under a permit secured by a Permittee except persons in his employ. (d) To obtain a permit the applicant shall first file an application therefor, in writing, on a form furnished for that purpose. Every such application shall: l. Identify and describe the work to be covered by the permit for which application is made; 20 Describe the land on which the proposed work is to be done, by lot, block, tract and house and street address, or similar description that will readily identify and definitely -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 locate the proposed building or work. 3. Indicate the use or occupancy for which the pro- posed work is intended. 4. Be accompanied by plans and specificationso The Administrative Authority may require the plans and specifications to be prepared and designed by an engineer licensedby the State of California to practice as such. 5. State the valuation of the proposed work. 6. The permit shall be made in writing by an electri- cal contractor, maintenance electrician or their authorized repre- sentative. Where a license is required by the State of Califor- nia, a permit shall not be issued unless the applicant has such a license. (e) Information on Plans and Specifications. Plans and specifications shall be drawn to scale upon substantial material and shall be of sufficient clarity to indicate the nature and extent of the work proposed and show, in detail, that it will con- form to the provisions of this Code and all relevant laws, condi- tions, ordinances and regulations. Sec. 7.9.9. Electrical Permits. (a) Issuance. The application, plans and specifications filed as required by this Section shall be checked by the Adminis- trative Authorityo Such plans may be reviewed by other depart- ments of the City to check compliance with the laws and ordinances under their jurisdictiono If the Administrative Authority is satisfied that the work described in the application for permit and the plans filed therewith conform to the requirements of this Code and other pertinent laws and ordinances, he shall, upon receipt of the required fee, issue a permit therefor. Every permit issued shall be valid only for the location and work on the application therefor. (b) If no portion of the work or construction covered by -6- 1 a permit issued by the Administrative Authority under the provi- 2 sions of this Ordinance has been commenced, the person to whom suc 3 permit has been issued may deliver such permit to the Administra- 4 5 6 7 8 tive Authority with a request that such permit be cancelled. The Administrative Authority shall thereupon stamp or write upon the face of such permit the words, "Cancelled at the Request of the Permittee.". Thereupon such permit shall be null and void and of no effect. 9 (c) Any person regularly employing one or more electricians for the purpose of installation, alteration, maintenance or repair on his or its own premises, shall make periodic reports covering all installations, additions, or alterations and shall pay for each 10 11 12 13 thereof the permit fees provided for in this Ordinance. All such 14 work shall be installed and done in accordance with the provisions 15 of this Ordinance, and such work shall be subject to the inspection 16 of the Administrative Authority. 17 (d) The provisions of this Ordinance shall not apply to any 18 electrical work performed by the Light and Power Department of the 19 City of Vernon as a serving agency, by an electrical corporation, 20 or street railroad corporation on or with any electrical equipment 21 owned or controlled and operated or used by, and for the exclusive 22 benefit of such corporation in the conduct of its business as a 23 public utility, to any other work which any such corporation or may 24 be entitled by law to perform without payment of any local tax; but 25 all provisions of this Ordinance shall apply insofar as they may 26 consistently be applicable with the above to all other electrical 27 work performed by any such corporation. The terms, "electrical 28 corporation", "telephone corporation", "telegraph corporation", 29 'railroad corporation" and 11 street railroad corporation", are herein 30 used as said terms are respectively defined in the Public Utility 31 Act of the Public Utility Code of the State of California; and such 32 terms shall also be deemed to include similar utilities which are -7- 1 municipally or governmentally owned and operated. 2 3 (e) Inspection. lo All electrical work for which a permit is required 4 shall be subject to inspection by the Administrative Authority. 5 6 7 2. Work requiring an electrical permit shall not be commenced until the permit holder or his agent shall have posted an inspection record card in a conspicuous place within the defined 8 work area and in such position as to allow the Administrative 9 Authority conveniently to make the required entries thereon regar- 10 ding inspection of the work. 11 12 13 14 15 16 17 3. It shall be unlawful for any person to lath over, seal, cover or conceal any electrical wiring or other electrical equipment, for the installation or which a permit is provided for herein, until such electric wiring or other electrical equipment shall have been inspected and approved by the Administrative Authorityo Said Administrative Authority shall have the power to remove, or to require the removal of any obstruction which prevents 18 proper inspection of any electrical equipment or installation. 19 20 21 4. No work shall be done on any part of the electrical system beyond the point indicated in each successive inspection without first obtaining the written approval of the Administrative 22 Authority. There shall be a final inspection and approval of all 23 24 25 26 27 electrical work when such work is completed and before the electri- cal system can be energized. 50 In addition to the called inspection specified above, the Administrative Authority may make or require any other inspections of any electrical work requiring compli.ance with the 28 provisions of this Code and other laws which are enforced by the 29 30 31 32 Building Department. 60 Validity. The issuance or granting of a permit or approval of plans and specifications shall not be construed to be a permit for, or an approval of, any violation or any of the -8- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 provisions of this Code. No peL~lit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use which it authorizes is lawful 0 The issuance of a permit based upon plans and specifications shall not prevent the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing building operations being carried on thereunder when in violation of this Code or of any other ordinance of the City. 7. Expiration. Every permit issued by the Adminis- trative Authority under the provisions of this Code shall expire by limitation and become null and void, if the electrical work authorized by such permit is not commenced within 120 days from the date of such permit, or if the electrical work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced, a new permit shall be first obtained so to do, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided, further, that such suspension or abandonment has not exceeded one year. 8. Suspension or Revocation. The Administrative Authority may, in writing, suspend or revoke a permit issued under the provisions of this Code whenever the permit is issued in erro or on the basis of incorrect information supplied, or in violatio of any ordinance or regulation or any of the provisions of this Code. Sec. 7.9.l0. Permit Fees. (a) A fee for each electrical permit shall be paid as set forth by Resolution of the City CounciL (b) Any person who shall commence any electrical work for which a permit is required by this Ordinance without first having -9- 1 2 3 4 5 6 7 8 obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay double the permit fee fixed by this Section for such work provided that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such work was urgently necessary and that it was not practical to obtain a permit therefor, before the commencement of the work. In all such cases, a permit must be ob- tained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such a permit, a double fee as herein provided shall be charged. (c) Expiration of Plan Check. Applications for which no 9 10 11 12 permit is issued within 180 days following the date of application 13 shall expire by limitation and plans submitted for checking may 14 thereafter be returned to the applicant or destroyed by the Adminis 15 trative Authority. The Administrative Authority may extend the 16 time for action by the applicant for a period not exceeding 180 17 days upon \rritten request by the applicant showing that circum- 18 stances beyond the control of the applicant have prevented action 19 from being taken. In order to renew action on an application after 20 expiration, the applicant shall resubmit plans and pay a new plan- 21 check fee. 22 (d) 23 be $10.00. Reinspection Fee. In instances where rein- spection fees have been assessed, no additional inspection of the work will be performed until the required fees have been paido Seco 709ollo Wiring-Service Entrance-Coloro (a) The maker's name, trademark, or other identification symbol shall be placed on all electrical material, devices, appli- ances and equipment used or installed under this Ordinance, and said name, trademark or other identification symbol shall be of a type approved by the Administrative Authority. (b) The Administrative Authority is granted the power by the City Council to make slight modifications for individual cases in the provisions of this Ordinance, provided that in each such modification the Administrative Authority shall first find that a special individual reason makes the strict letter of the Ordinanc impractical and that the modification is in conformity with the spirit and purpose of the Ordinance involved. (c) All wiring installed in or on buildings or other structures shall be in a metal protected wiring system of either flexible, non-metallic conduit, thin wall tubing or rigid conduit, provided that other equal or superior installations may be autho- rized by the Administrative Authority. (d) Additions or extension to, and alterations and re- newals of existing installations shall be made in compliance with the provisions of this Ordinance. Where a building or structure, or a portion thereof, has its occupancy changed to a different group, or a different division of the same group, as defined by the Uniform Building Code as adopted by Ordinance of the City of -11- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Vernon, the electrical installation in the affected building or structure or portion thereof shall be made to comply with the requirements of this Ordinance. (e) Underground and overhead services shall be made in accordance with good engineering practices and in compliance with the requirements of the serving agency, together with all appli- cable laws, ordinances, rules and regulation and orders, including those governing clearance at the point of attachment. (f) All service entrance conductors shall be not less in size than No. 2 copper or equivalent. Service entrance conductors from overhead service drops shall be installed in rigid metal raceways, l" minimum in size. Undergrouni services from the serving utilities overhead or underground system shall be installe to conform to the utilities requirements and standards. Under- ground services may be installed in rigid non-metallic conduit. (g) The grounding electrode conductor shall be copper and shall be identified by a continuous green color or bare copper Grounded conductors of different voltage shall be identified by white and natural grey; Grounded conductors of the 277-480 volt system shall be grey; Grounded conductors of the lower voltage systems shall be white. (h) Conductors No. 4 or smaller in wire gauge size shall be copp er . Sec. 7.9.l2. Allowance of Variance or Exception from Requirements of Code. Whenever the Administrative Authority shall find, upon the basis of reliable evidence, information or opinion placed before him that the public health, safety, and welfare will not be adversely affected or, in the alternative, will be well served thereby, he may, in his discretion, and subject to such conditions and limitations as he may see fit to impose, relieve an applicant for an electrical permit from one or more of the requirements of this Code, and, tvithout limiting the foregoing, -12- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 may authorize the substitution of materials, types of installation and safety equipment or devices. All requests seeking the allo- wance of a variance or exception from the requirements of this Code shall be presented to the Chief of the Fire Department for recommendations, if applicable, for allowance or rejection and for the terms, conditions and limitations, if any, which said Fire Chief and said Administrative Authority recommend be imposed upon such permit, if granted. The Administrative Authority shall, prio to his making his findings, solicit and include therein the recom- mendations of other departments of the City which may be affected by the request for a variance or exception from the requirements of this Codeo Any application for an electrical permit seeking a variance or exception from the requirements of this Code, which variance or exception has been denied or granted subject to the conditions and limitations, pursuant to the foregoing provisions of this Sec. 7.9.l2, may request a hearing before the City Council for the purpose of obtaining a new or different decision with respect to said request for a variance or exception. Such request for a hearing must state the following: I. The name and mailing address of the applicant for the purposes of the requested hearing. 2. A method of identification of the application or applications involved, and the previous decision of the Administrative Authority or of the City Council, if any, with respect to each such application. 3. The specific ruling which the applicant requests be made by the City Council with respect to each such application 4. A brief summary in non-technical language of the points or contentions to be made by applicant at the requested hearing, which summary shall be sufficient to inform any inte- rested person who may wish to meet or refute applicant's pre- sentation at the hearing. -l3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 The City Council shall set a time and place for a hearing on such application, providing it shall comply with the foregoing require- ments, which hearing shall take place not more than thirty (30) days after receipt of the applicant's request. In the event that the request for hearing does not comply with the foregoing require ments, no hearing shall be set and the City Clerk shall advise the applicant of the City Council's findings and that no hearing shall be set until such requirements are met. Such latter notice shall be mailed by the City Clerk to the applicant by United States mail postage prepaid, to the address shown on the request for hearing, and if no adequate address is shown thereon, the City Clerk shall make a reasonable effort to locate an address for the applicant, to which the notice may be mailed and, failing to find such ad- dress, no notice shall be sent. Sec. 7.9.13. Legal Liabilities. The Administrative Authority or any employee charged with the enforcement of this Code, acting in good faith and without malice for the City in the discharge of his duties, shall not thereby render himself liable personally. He is thereby relieved from all personal liability for any damages that may accrue to persons or property as a re- sult of any act required, or by reason of any act or omission in the discharge of his duties. Any suit brought against the Administrative Authority, or the employee, because of the act or omission perfo~d by him in the enforcement of any provisions of this Code, shall be defended by the legal department of the City of Vernon until final determination of the proceedingso Sec. 7.9.l4. If any section, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portion or portions of this Ordinance. -14- 1 Sec. 7.9.l5. Every violation of this Ordinance is hereby 2 declared to be a public nuisance. 3 4 5 6 7 8 Seco 709016. Any person, firm, or corporation found to be violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding Three Hundred Dollars ($300.00), or be imprisoned in the County Jail of the County of Los Angeles, or the City Jail of the City of Vernon, as the committing magistrate may direct, for not more than ninety (90) days, or by both such fine and in~risonment, in the discretion of the Courto Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder." SECTION 2: All other ordinances or parts of ordinances thereof in conflict with this Ordinance are hereby repealed, and CHAPTER 9A Electricity.
