Ordinance No. 873 II 1 ORDINANCE NO. 873 2 AN ORDINANCE OF THE CITY OF VERNON FIXING RATES TO BE CHARGED FOR ELECTRICAL ENERGY DISTRIBUTED 3 AND SUPPLIED BY SAID CITY WITHIN ITS BOUNDARIES AND REPEALING CERTAIN ORDINANCES OF THE CITY OF 4 VERNON RELATING THERETO. 5 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: 6 SECTION 1: Purpose and Scope 7 The rates to be charged and collected, and the terms, 8 and conditions respecting the distribution of electrical energy 9 supplied by the City of Vernon for such service from and after 10 the effective date of this ordinance shall be as set forth herein. 11 This ordinance may be referred to as the City of Vernon's 12 "Electrical Energy Distribution Ordinance". SECTION 2: General Rates 13 14 Those rates, terms and conditions set forth in that portion 15 of Southern California Edison Company's (hereinafter IIEdison") 16 Advice Letter No. 433-E, dated January 11, 1977, addressed to 17 the Public Utilities Commission of the State of California, set 18 forth below, are hereby incorporated by reference and made a part 19 hereof as though fully set forth at length and are hereby adopted 20 as the City's rates, terms and conditions for the distribution of 21 the electrical energy supplied by the City for certain classes 22 of service: 23 SCHEDULE NO. S- 13 Standby, Sheet No. 3598-E as set forth in, and adopted by, City 14 Ordinance No. 806, is hereby reaffirmed and redopted. 15 16 17 18 SECTION 5: Energy Costs Adjustment The rates charged for the distribution of energys supplied ! by the City for service rendered from and after the effective i date of this ordinance may include an energy cost adjustment billin<tr 19 factor to be determined by the City Council. Such changes in the 20 energy cost and adjustment billing factor shall be made from time 21 to time by Resolution of the City Council when, 1n the City Counci ' 22 opinion, such changes are necessary for the sound financial op- 23 eration of the Light and Power Operating Funds. Any Fuel Clause 24 25 Adjustment charged, pursuant to Ordinances No. 849, 850, and 863, and any resolutions adopted pursuant thereto, shall remain in full 26 force and effect and the same may be amended pursuant to this 27 ordinance. 28 / -3- 1 SECTION 6: Other Rules and Regulations 2 The rules and regulations respecting the distribution of 3 I electrical energy supplied by the City of Vernon shall be those 4 rules and regulations of the Southern California Edison Company 5 applicable to electrical service in the City of Vernon, and filed 6 with the City Clerk of the City of Vernon on December 27, 1961, 7 and subsequent thereto, up to and including the date of enactment 8 of this Ordinance. 9 The City Council of the City of Vernon may from time to 10 time authorize by resolution changes in the rules and regulations 11 applicable to said electrical service, not in conflict with rate 12 schedules, relating to conditions of service and application, and 13 interpretation of rates, and relating to other provisions set 14 forth in this Ordinance. Any rule or regulation adopted pursuant 15 to Ordinance 745,806, 828 and 863 or any resolution pursuant there- 16 to, shall remain in full force and effect until amended or rescin- I 17 ded by this Ordinance. 18 SECTION 7: Reference to Public Utilities Commission 19 Any provision of the rules and regulation of the Southern 20 California Edison Company relating tothe exercise of jurisdiction 21 the Public Utilities Commission of the State of California shall be 22 deemed to refer to and mean the City Council of the City of Vernon. 23 SECTION 8: Rate Adjustment Factor 24 The Rate Adjustment Factor against rates charged for 25 electrical energy, distributed and supplied by the City of Vernon 26 to its electrical consumers, may be used as a percentage of the 27 bill rendered, or any portion thereof, after all other Rate Ad- 28 justment Factors are given as allowed by the applicable Base Rate -4- 1 Schedules. The amount of adjustment to be given shall be de- 2 termined by resolutions adopted from time to time by the City 3 Council when, in its opinion, such adjustment will not affect 4 the sound financial position of the Light and Power Operating 5 Funds. Any Vernon Rate Adjustment Factor given pursuant to this 6 Ordinance, or Ordinance No. 749 or Ordinance No. 855 or 863 or any 7 resolution adopted pursuant thereto, shall remain in full force an 8 effect until amended or rescinded by the City Council of the 9 Ci ty of Vernon. 10 SECTION 9: Other Ordinances Amended 11 Any other ordinance or portion thereof in conflict with 12 I this Ordinance, is hereby repealed, excepting Ordinances Nos. 13 806, 828, 839, 849 and 863, which are partially repealed by this 14 Ordinar ce . 15 SECTION 10: Maintenance of Records 16 The City Clerk of the City of Vernon is hereby directed to 17 keep and maintain three (3) copies of the above-mentioned rate 18 I schedules and rules and regulations applicable to electric service 19 in the City of Vernon in the Office of the City Clerk of the City 20 of Vernon, and make such tariff schedules available on request for 21 examination in said office. 22 SECTION 11: Posting of Ordinance 23 There being no newspaper printed, published or circulated 24 in the City of Vernon, the City Clerk is hereby directed to certify 25 to the passage of this Ordinance and shall post the same, or cause 26 the same to be posted, in three (3) of the most public places in 27 the City of Vernon, to wit: the northwest corner of 38th Street 28 and Santa Fe Avenue; the northeast corner of Leonis Boulevard and -5- 10 11 121 13 ATTEST: 14 15 16 17 18 19 20 21 22 23 24 25 26 I 27 28 1 Pacific Boulevard, and on the bulletin board in the lobby of the 2 City Hall of said City, located at 4305 Santa Fe Avenue, all in th 3 City of Vernon, County of Los Angeles, State of California; that 4 this Ordinance shall be in full force and effect thirty (30) days 5 from and after the final passage of the same. ~ 11977. 8 9 ADOPTED AND APPROVED this lSth day of February / \ F. cf!fci;':;:i ty Clerk -6- 1 2 STATE OF CALIFORNIA ) ) SSe COUNTY OF LOS ANGELES ) 31 I 41 I, F. The resolution is virtually the same as last year's resolution, only the rates have been changed. Section 2 of the Resolution requires the insertion of the effective date of the ordinance when the same has been ascertained. The ordinance format has been significantly changed. Hopefully the changes which we have made will aid in your review of the ordinance. (We are also asking Mr. Hendricks comments on these changes as well as the insertion of the description of certain types of service which were not known or included in the prior ordinance .) Some time in the future we will correspond with you concerning the possibility of adopting such rate changes in the future by resolution rather than ordinance. Because of the time constraints facing us at this juncture, such discussion must be delayed until after the current documents are approved by the City Council.
