ZZ OOC/) HHp:::: E-tC/)W HO~$: P.....:lO IJ;JP-'P-' 1 2 3 ORDINANCE NO. 878 AN ORDINANCE OF THE CITY OF VERNON ADOPTING THE UNIFORM FIRE CODE, 1976 EDITION, PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION, AND ESTAB- LISHING A BUREAU OF FIRE PREVENTION AND PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES 4 5 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN as follows: 6 7 8 9 10 Section I. Sec. 7.61 of the Vernon City Code is hereby amended to read as follows: "Sec. 7.61 Uniform Fire Code - Adopted by Reference. The Uniform Fire Code, 1976 Edition, its Appendices A through G, published by the International Conference of Building Officials and the Western Fire Chiefs Association, except as provided in this Article, is hereby adopted. " 11 12 13 Section 2. Sec. 7.62 of the Vernon City Code is hereby amended to read as follows: 14 15 "Sec. 7.62 Same - Definitions. (a) Wherever the word 'jurisdiction' is used in the Uniform Fire Code, it shall be held to mean the City of Vernon. 16 17 (b) Wherever the term 'Corporation Counsel' is used in the Uniform Fire Code, it shall be held to mean the Attorney for the City of Vernon." 18 19 Section 3. Sec. 7.63 of the Vernon City Code is hereby 20 21 amended to read as follows: "Sec. 7.63 Establishment of Limits of Districts in Which Storage of Flammable or Combustible Liquids in Outside Above Ground Tanks is to be Prohibited. 22 23 (a) The limits referred to in Sec. 15.201 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside above ground tanks is prohibited, are hereby established as follows: Fire Zone II and III as defined in the 1976 Uniform Building Code." 24 25 26 Section 4. Sec. 7.64 of the Vernon City Code is hereby 27 amended to read as follows: 28 II I 1 2 3 4 5 6 7 8 9 10 11 121 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "Sec. 7.64 Amendments Made in the Uniform Fire Code. The Uniform Fire Code is hereby amended as follows: (A) Sec. 1.212(a) is hereby amended to read: 'Compliance Sec. 1.212. (a) Any person operating or maintaining any occupancy, premises or vehicle subject to this Code who shall permit any fire hazard to exist on premises under his control or who shall fail to take immediate action to abate a fire hazard when ordered or notified to do so by the Chief or his duly authorized representative shall be guilty of a misdemeanor.' (B) Sec. 1.215 is hereby amended to read: 'Allowance of Variance or Exception from Requirements of Code Sec. 1.215. Whenever the Fire Chief shall find that changes or modifications in the requirements contained in this Code are necessary because of local conditions, he may, in his discretion and subject to such conditions and limitations as he may impose, relieve an applicant from one or more of the requirements of this Code, and, without limiting the foregoing, may authorize the sub- stitution of materials, types of construction and safety equipment or devices. The Fire Chief shall, prior to his making his findings, solicit and include therein the recommendations of other departments of the City, which may be affected by the request for a variance or exception from the requirements of this Code. No change or modification in the requirements in this Code shall -be authorized as to any hotel, lodging house, motel, apartment house or dwelling, or portion thereof, or any building accessory thereto, unless the City Council shall first make a written finding that such modifica- tions or changes are needed, make such findings avail- able as a public record and transmit a copy thereof, together with the modification or change, to the Depart- ment of Housing and Community Development. Any applicant seeking a variance or exception from the requirements of this Code, which variance or excep- tion has been denied or granted subject to conditions or limitations, pursuant to the foregoing provisions of this Section 1.215, may request a hearing before the City Council for the purpose of obtaining a new or different decision with respect to said request for a variance or exception. Such request for a hearing must state the following: 1. The name and mailing address of the applicant for the purposes of the requested hearing. -2- 1 2. A method of identification of the application or applications involved and the previous decision of the Fire Chief or of the City Council, if any, with respect to each such application. 2 3 4 3. The specific ruling which the applicant requests be made by the City Council with respect to each such application. 5 6 7 4. A brief summary in non-technical language of the points or contentions to be made by applicant at the requested hearing, which summary shall be suf- ficient to inform any interested person who may wish to meet or refute applicant's presentation at the hearing. 8 9 The City Council shall set a time and place for a hear~ ing on such application, providing it shall comply with the foregoing requirements, which hearing shall take place not more than thirty (30) days after receipt of the applicant's request. In the event that the request for a hearing does not comply with the foregoing require ments, no hearing shall be set and the City Clerk shall advise the applicant of the City Council's findings and that no hearing shall be set until such requirements are met. Such latter notice shall be mailed by the City Clerk to the applicant by United States mail, postage prepaid, to the address shown on the request for hearing, and if no adequate address is shown thereon, the City Clerk shall make a reasonable effort to locate an address for the applicant, to which the notice may be mailed and, failing to find such address, no notice shall be sent.' 10 11 12 13 14 15 16 17 18 19 (C) Sec. 15.201(a) is amended to read: 20 'The storage of flammable and combustible liquids in above ground tanks outside of buildings is prohibited except as provided in Sec. 7.63 of the Vernon City Code. 21 (D) Sec. 15.201(b) is amended to read: 22 'Fire protection shall be provided in accordance with nationally recognized standards. When required by the Chief, foam fire protection shall be provided for any above ground tank: 23 24 25 I. When such tank or tanks are used for the storage of crude oil. 27 2. When such tank or tanks are used for in-process products handling and are located within 100 feet of any fired still, heater, related fractioning or processing apparatus, or similar device at a processing plant or petroleum refinery as herein defined. 26 28 -3- 1 3. In addition to the above requirements the Chief may require foam fire protection when an unusual exposure hazard exists because of topographical condi- tions; nature of occupancy and proximity on the same or adjoining property and height and character of con- struction of such buildings; capacity, construction and maintenance of such tanks and character of liquids to be stored; degree of private fire protection to be provided, and facilities of the fire department to cope with flammable and combustible liquid fires.' 2 3 4 5 6 7 (E) Sec. 15.201(d) is amended to read: 8 'Where foam fire protection is required, installationl shall meet the requirements of National Fire Protection Association pamphlet No. II, "Foam Extinguishing Sys- tems," except that where tank shells are accessible for the erection of portable foam applicators, for at least three-quarters of their perimeter, portable foam appli- cators may be approved.' 9 10 11 12 (F) Sec. 15.201(e) is repealed." 13 Section 5. Sec. 7~65 of the Vernon City Code is amended to 14 read as follows: 15 "Sec. 7.65 New Materials, Processes or Occupancies Which May Require Permits. The Director of Public Works/Building, the Fire Chief and the Chief of the Bureau of Fire Prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in said Code. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons." 16 17 18 19 20 21 22 Section 6. Sec. 7.66 of the Vernon City Code is amended to 23 read as follows: 24 "Sec. 7.66 Violations and Penalties. 25 26 Any person, firm, or corporation violating any of the provisions of this Article shall be deemed guilty of a mis- demeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Article is committed, continued, or permitted, and upon con- viction of any such violation such person shall be punishable 27 28 -4- 1 by a fine of not more than $500 or by imprisonment for not more than six months, or by both such fine and imprisonment. 2 3 The application of the above penalty or penalties shall not be held to prevent the enforced removal of the prohibited conditions. The violation of any of the pro- visions of the Code adopted herein shall be deemed a public nuisance." 4 5 6 Section 7. Public Hearing. 7 A public hearing shall be convened by the City Council on 8 March IS, 1977, at 2:00 o'clock p.m., or as soon thereafter as the 9 matter may be heard, at the (temporary) Council Chambers of the 10 Vernon City Council located at 4305 Santa Fe Avenue, Vernon, Cali- 11 fornia, for the purpose of considering adoption of the 1976 Edition 12 of the Uniform Fire Code. The City Clerk shall post a notice of 13 said hearing, in the same manner as provided for the posting of 14 ordinances, stating that said hearing shall be conducted, the pur- 15 pose of said hearing, and the copies of said Code are on file with 16 the City Clerk and are available for public inspection. Such 17 notice shall also be published in accordance with Government Code 18 19 Section 6060 in the Los Angeles Daily Journal which the City Council finds to be a newspaper of general circulation nearest to the City 20 21 I most appropriate for this purpose. I i Section 8. Ordinance Posting. I There being no newspaper printed, published and circulated I in the City of Vernon, the City Clerk is hereby directed to certifyl to the passage of this Ordinance and shall post the same, or cause 22 23 24 25 the same to be posted, in three of the most public places in the 26 City of Vernon, to wit: the northwest corner of 38th Street and 27 Santa Fe Avenue, the northeast corner of Leonis Boulevard and 28 Pacific Boulevard, and on the bulletin board in the lobby of the -5- 1 2 3 4 5 6 7 City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California; that this Ordinance shall be in full force and effect thirty (30) days from and after the final passage of the same.
