Ordinance No. 879 1 2 ORDINANCE NO. 879 3 AN ORDINANCE OF THE CITY OF VERNON AMENDING SECTION 1.8-1 (a) OF THE 4 VERNON CITY CODE AUTHORIZING CERTAIN CITY OFFICERS AND EMPLOYEES TO ARREST 5 WITHOUT WARRANT 6 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN as follows: 7 SECTION 1: Sec. 1.8-1 (a) of the Vernon City Code 8 9 10 11 12 is hereby amended to read as follows: .. Sec. 1. 8--1. Authority of certain City officers and employees to arrest without warrant; issuance of notice to appear; posting of bails; failure to comply with notice to appear. "(a) Certain public officers or city employees may arrest a person without a warrant whenever they have reasonable cause to believe that the person to be arrested has committed a misdemeanor in their presence which is a violation of a statute or ordinance which such officer or city employee has the duty to enforce. Such public officers or city employees who are authorized pursuant to this section to make such arrest as. set forth in this section, in addition to those employees who have previously been so authorized by other ordinances or state laws, are as follows: 13 14 15 16 17 18 19 25 (I) The Health Officer. (2 ) The Director of Environmental Health. (3) The Chief Deputy Director of Environmental Health. (4 ) The Senior Environmental Specialist. (5 ) The Environmental Specialist. (6 ) The Fire Chief. (7 ) The Assistant Fire Chief. (8 ) The Fire Marshal." 20 21 22 23 24 26 SECTION 2: Except as hereby amended said Vernon City 27 Code Section 1.8-1 shall remain in effect. 28 1 2 3 4 5 SECTION 3: There being no newspaper of general circulation, printed, published and circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this ordinance, and shall post the same~ or 6 places in said city, to wit: The Northwest corner of 38th cause the same to be posted, in three of the most public 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Street and Santa Fe Avenue; the Northeast corner of Leonis Boulevard and Pacific Boulevard; and on the Bulletin board in the lobby of the City Hall of said city, located at 4305 Santa Fe Avenue, all in the City of Vernon, Los Angeles County, California. ""'l.1 l. l tAlA.I' Honorable Members: In order to correct an inconsistency in the Vernon City Code, we are requesting your consideration to the amendment of Section 1.8-l(a) to remove an obsolete Health Department title and insert two new titles. This amendment would correct the existing City Code section and would permit our Environmental Specialist, John Anderson, to issue citations to secure conformance to City ordinances and State statutes which he is empowered to enforce. Mr. Anderson will have completed six months of service as of April 30th and we believe he has been thoroughly trained and instruct- ed as regard to City policy and approved procedures for securing con- formance. It is the policy of this department that a citation is issued only as a last resort after our normal procedures of education, consultation, and the use of written notices have failed to secure compliance. We are requesting that Section 1.8-1(a) of the Vernon City Code be amended as follows: That Item "(4) The Deputy Director of Environ- mental Hea1th.tJ be deleted and a new Item tJ(4) The Senior Environ- mental Specialist.tJ be added, and a new Item "(5) The Environmental Specia1ist.tJ be added and that the subsequent titles tJ(5) The Fire r:ITY OF VERNON CALIFORNIA IN REPLY REFER TO: City Council City of Vernon Re: Amende of Sec.. 1..8-1(a)~ VCC 3/8/77 Page 2 Chief. (8) The Fire Marshall,," Taking action to amend the ordinance at this time would assure that the amendments would be effective prior to May 1, 1977, at which time we would hope that Mr. Anderson would be permitted to issue citations.. His training is continuing and supervisory personnel are working closely with him.. To date, we are very satisfied with his performance and his ability to make decisions in the field and we feel assured that he will be able to handle this additional responsi- bility without any problems..
