2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING CHAPTER 8 OF THE VERNON
3 l'lUNICIPAL CODE AND REPEALING ORDINANCE NO. 798
4 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
5 DOES ORDAIN AS FOLLOWS:

SECTION 1: Chapter 8 is hereby amended to read as
7 follows:
8 "E~iERGENCY ORGANIZATION AND FUNCTIONS"

"SECTION 8.1. Definition.
10
As used in this ordinance, 'emergency' shall mean the
11 actual or threatened existence of conditions of disaster or of
12 extreme peril to the safety of persons and property within this
13 city caused by such conditions as air pollution, fire, flood,
14 storm, epidemic, riot, or earthquake, or other conditions, in-
15 cluding conditions resulting from war or imminent threat of
16 war, but other than conditions resulting from a labor controversy,
17 which conditions are or are likely to be beyond the control of
18 the services, personnel, equipment, and facilities of this city,
19 requiring the combined forces of other political subdivisions to
20 combat.

SECTION 8.2. Purposes.
22 The declared purposes of this ordinance are to provide
23 for the preparation and carrying out of plans for the protection
24 of persons and property within this city in the event of an
25 emergency; the direction of the emergency organization; and the
26 coordination of the emergency functions of this city with all
27 other public agencies, corporations, organizations, and affected
28 private persons.
1 SECTION 8.3. Disaster Council Membership.
2 The Vernon Disaster Council is hereby created and shall
3 consist of the following:
4 (a) The mayor, who shall be chairman and the director
5 of emergency services.
6 (b) The assistant director of emergency services, who
7 shall be vice chairman.
8 (c) Such chiefs of emergency services as are provided
9 for in a current emergency plan of this city, adopted pursuant to
10 this ordinance.
11 (d) Such representatives of civic, business, labor,
12 veterans, professional or other organizations having an official
13 emergency responsibility, as may be appointed by the director
14 with the advice and consent of the city council.
15 SECTION 8.4. Disaster Council Powers and Duties.
16 It shall be the duty of the Vernon Disaster Council, and
17 it is hereby empowered, to develop and recommend for adoption by
18 the city council, emergency and mutual aid plans and agreements
19 and such ordinances and resolutions and rules and regulations
20 as are necessary to implement such plans and agreements. The
21 Disaster Council shall meet upon call of the chairman or, in his
22 absence from the city or inability to call such meeting, upon call
23 of the vice chairman.
24 SECTION 8.5. Director and Assistant Director of
25 Emergency Services.
26 (a) There is hereby created the office of director of
27 emergency services. The mayor shall be the director of emergency
28 services.

1 (b) There is hereby created the office of assistant
2 director of emergency services, who shall be appointed by the
3 director.
4 SECTION 8.6. Powers and Duties of the Director and
5 Assistant Director of Emergency Services.
6 (a) The director is hereby empowered to:
7 (1) Request the City Council to proclaim the
8 existence or threatened existence of a 'local emergency' if the
9 City Council is in session, or to issue such proclamation if the
10 City Council is not in session. Whenever a local emergency is
11 proclaimed by the director, the City Council shall take action to
12 ratify the proclamation within seven (7) days thereafter or the
13 proclamation shall have no further force or effect.
14 (2) Request the Governor to proclaim a 'state of
15 emergency' when, in the opinion of the director, the locally
16 available resources are inadequate to cope with the emergency.
17 (3) Control and direct the effort of the emergency
18 organization of this city for the accomplishment of the purposes 0
19 this ordinance.
20 (4) Direct cooperation between and coordination of
21 services and staff of the emergency organization of this city; and
22 resolve questions of authority and responsibility that may arise
23 be.tween them.
24 (5) Represent this city in all dealings with
25 public or private agencies on matters pertaining to emergencies
26 as defined herein.
27 (6) In the event of the proclamation of a 'local
28 emergency' as herein provided, the proclamation of a 'state of

1 emergency' by the Governor or the Director of the State Office
2 of Emergency Services, or the existence of a 'state of war
3 emergency', the director is hereby empowered:
4 (a) To make and issue rules and regulations
5 on matters reasonably related to the protection of life and
6 property as affected by such emergency; provided, however, such
7 rules and regulations must be confirmed at the earliest practicabl
8 time by the City Council;
9 (b) To obtain vital supplies, equipment,
10 and such other properties found lacking and needed for the pro-
11 tection of life and property and to bind the city for the fair
12 value thereof and, if required immediately, to commandeer the
13 same for public use;
14 (c) To require emergency services of any
15 city officer or employee and, in the event of the proclamation of
16 a 'state of emergency' in the county in which this city is
17 located or the existence of a 'state of war emergency' to command
18 the aid of as many citizens of this community as he deems
19 necessary in the execution of his duties; such persons shall be
20 entitled to all privileges, benefits and immunities as are pro-
21 vided by state law for registered disaster service workers;
22 (d) To requisition necessary personnel or
23 material of any city department or agency; and
24 (e) To execute all of his ordinary power as
25 mayor, all of the special powers conferred upon him by this
26 ordinance or by resolution or emergency plan pursuant hereto
27 adopted by the City Council, all powers conferred upon him by any
28 statute, by any agreement approved by the City Council, and by

1 any other lawful authority.
2 (b) The director of emergency services shall designate
3 the order of succession to that office, to take effect in the
4 event the director is unavailable to attend meetings and otherwise
5 perform his duties during an emergency. Such order of succession
6 shall be approved by the City Council.
7 (c) The assistant director shall, under the supervision
8 of the director and with the assistance of emergency service
9 chiefs, develop emergency plans and manage the emergency programs
10 of this city; and shall have such other powers and duties as may
11 be assigned by the director.
12 SECTION 8.7. Emergency Organization.
13 All officers and employees of this city, together with
14 those volunteer forces enrolled to aid them during an emergency,
15 and all groups, organizations, and persons who may by agreement
16 or operation of law, including persons impressed into service
17 under the provisions of SECTION 8.6(a) subdivision (6) (c) of this
18 ordinance, be charged with duties incident to the protection of
19 life and property in this city during such emergency, shall con-
20 stitute the emergency organization of the City of Vernon.
21 SECTION 8.8. Emergency Plan.
22 The Vernon Disaster Council shall be responsible for
23 the development of the City of Vernon Emergency Plan, which plan
24 shall provide for the effective mobilization of all of the
25 resources of this city, both public and private, to meet any
26 condition constituting a local emergency, state of emergency, or
27 state of war emergency; and shall provide for the organization,
28 powers and duties, services, and staff of the emergency organi-

1 zation. Such plan shall take effect upon adoption by resolution
2 of the City Council.
3 SECTION 8.9. Expenditures.
4 Any expenditures made in connection with emergency
5 activities, including mutual aid activities, shall be deemed
6 conclusively to be for the direct protection and benefit of the
7 inhabitants and property of the City of Vernon.
8 SECTION 8.10. Punishment of Violations.
9 It shall be a misdemeanor, punishable by a fine of not
10 to exceed five hundred ollars ($500.00), or by imprisonment for
11 not to exceed six (6) months, or both, for any person, during an
12 emergency, to:
13 (a) Willfully obstruct, hinder, or delay any member
14 of the emergency organization in the enforcement of any lawful
15 rule or regulation issued pursuant to this ordinance, or in the
16 performance of any duty imposed upon him by virtue of this
17 ordinance.
18 (b) Do any act forbidden by any lawful rule or
19 regulation issued pursuant to this ordinance, if such act is of
20 such a nature as to give or be likely to give assistance to the
21 enemy or to imperil the lives or property of inhabitants of this
22 city, or to prevent, hinder, or delay the defense or protection
23 thereof.
24 (c) Wear, carry, or display, without authority, any
25 means of identification specified by the emergency agency of the
26 State.
27 SECTION 8.11. Repeal of Conflicting Ordinances.
28 Repeals Ordinance No. 798, dated March, 1969, providing

1 that it is the intent of the City Council in enacting this
2 ordinance that it shall be considered a revision and continuation
3 of the ordinance repealed by this ordinance, and the status of
4 volunteers shall not be affected by such repeal; nor shall plans
5 and agreements, rules and regulations, or resolutions adopted
6 pursuant to such repealed ordinance b~ affected by such repeal
7 until amended, modified, or superseded as provided in this
8 ordinance.
9 SECTION 8.12. Effective Date.
10 This ordinance shall become effective thirty (30)
11 days from and after its passage.
12 SECTION ~.13. Severability.
13 If any provision of this ordinance or the application
14 thereof to any person or circumstance is held invalid, such in-
15 validity shall not affect other provisions or applications, and
16 to this end the provisions of this ordinance are declared to be
17 severable. "
18 SECTION 2: There being no newspaper printed, pub-
19 lished and circulated in the City of Vernon, the City Clerk is
20 hereby directed to certify to the passage of this Ordinance and
21 shall post the same or cause the same to be posted in three (3)
22 of the most public places in the City of Vernon, to wit: The
23 northwest corner of 38th Street and Santa Fe Avenue, the northeast
24 corner of Leonis Boulevard and Pacific Boulevard, and on the
25 bulletin board in the lobby of the City Hall of said City, located
26 at 4305 Santa Fe Avenue, all in the City of Vernon, County of
27 Los Angeles, State of California; that this Ordinance shall be
28 in full force and effect thirty (30) days from and after said
