Ordinance No. 890 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 ORDINANCE NO. 890 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF VERNON AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM 3 4 5 6 WHEREAS, the City of Vernon and the Vernon Police Officers' Benefit Association have executed a Memorandum of Understanding on August 1, 1978; and, WHEREAS, said Memorandum of Understanding provides that the City of Vernon will adopt an amendment to its contract wi th the Public Employees Retirement System to provide two percent (2%) at 50 full formula for police safety members; and WHEREAS, there is an urgency in adopting said amendment to comply with the spirit and intent of the Memorandum of Understanding; 7 8 9 NOW, TIIEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That an z.mendment to the Contract between the City Council of the City of Vernon and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked "Exhibit A", and by such reference I made a part hereof as though herein set out in full. SECTION 2: The Mayor of the City of Vernon is hereby authorized empowered and directed to execute said amendment for and on behalf of said Agency; SECTION 8: That there exists an urgency in adopting said amend- ment (Exhibit "A") and, therefore, this ordinance shall be effective imme- diately upon approval by a majority of the City Council of the City of Vernon and thenceforth the same shall be in full force and effect. 1 SECTION 4: There being no newspaper printed, published and 2 circulated in the City of Vernon, the City Clerk is hereby directed to 3 certify to the passage of this Ordinance and shall post the same, or cause 4 the same to be posted, in three of the most public places in the City of 5 Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, 6 the northeast corner of Leonis Boulevard and Pacific Boulevard, and on 7 the bulletin board in the lobby of the City Hall of said City, located at 8 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, 9 State of California; 10 APPROVED and ADOPTED this 28th day of February, 1979. 11 13 1'/'// "V~ ~,'} , /' /'/i/1 l i I (./t. /l'l/ /' i'(ii' ,-"ie; ---~-------__4~~_~____~______ THOMAS A. All words and terms used herein which are defined in the Public Employees' Retirerl1ent Law shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall mean age 60 for misl:::ellaneous mcmbeTs and age 50 for local safety members. 2. Public Agency shall part:lcipate in tho Public Employees' Retirement System from and after November 1, 194B, making its employees as hereinafter provided, metl1bers of said System subject to all provisions of the Public Employees' Retir~aent Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except such as by express provisions thereof apply only on the election of contracting agencies. 3. Employees of Puhlic Agem:y in the following classes shall become members of said Retirement Syatem except such in each such class as are excluded by law or this agreement: a. Local Firemen (herein referred to as local safety members); b. Local Policemen (herein referred to as local safety members); c. Employees other than local safety members (herein referred to as miscellaneous members). In addition to the classes of amployees excluded from membership by said Retirement Law. the following classes of employees shall not become members of aa1d Retirement System: NO ,~DITIm{AL EXCLUSIONS EXHIBIT "A" CeJN-702-l 4. Ttw fraction of final compensation to be provided for each year of credited prior and current service as a miscellaneous member shall be determined in accordance with Section 21251.13 of said Retirement Law (2% at age (0). 5. The fraction of final compensation to be provided for each Yf'.ar of credited prior and current service as a safety member shall be determined in accordance with Section 21252.01 of said Retirement Law (2% at age 50). 6. The follow.Lng additional provisions of the Public Employees' Retirement Law which apply only Upll)n election of a contracting agency shall apply to the Public Agency and its employees: 3. Sections 21380-2130.3 (providing for allowances for survivors of members covered under the 1959 Survivor's Program upon the member's death befo:re retirement). h. Sections 21263 and :21263.1 (providing upon tho death of a meaher who retired :for service or disability for continuance of a post-retiremen't survivor allowance to certain survivors). c. Section 20024.2 (de:fining "final compensatioIl" on the basis of average cOUlpensation earnable during the year immediately preceding retirement or any other one year period elected by the member). for miscellaneous members. d. Section 20930.3 (allowing public service credit under the provisions of Chapter 830, Stats. 1976, for up to four YGars of continuous military or mercl~nt marine service), for mis- cellaneous members. 7. Public Agency, ill accordance with Section 20740, Government Code, ceased to be an "employer" for purposes of Chapter 6 of the Public Employees' RetirelilGnt Law effective on November 1. 1975. Accumulated contributio:ns of Public Agency as of the aforementioned date shall be fixed and determined as provided in Section 20759, Government Code, and accumulated contributions as of the afore- mentioned date and contributions thereafter made shall be held by the Board aa provided in Section 20759, Government Coda. 3. Public Agency shall contribute to said Retirement ~YGtem as follows: a. With respect to miscellaneous members, the agency shall contribute the following percentages of monthly salaries earned as miscellaneous members of said Retirement System: (1) 1.253 percent until June 30, 2000 on account of tl~ liability for prior service benefits. (2) 19.076 percent on account of the liability for current service benefits. (3) 0.602 percunt on accouut of the liability for the 1959 Survivor Proa~am. CON-702-2 b.
