AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE CODE OF THE CITY OF VERNON,
CALIFORNIA 1959, BY AMENDING SECTIONS 25.1, 25.2,
25.3, 25.5 AND 25.8 OF SAID CODE, ESTABLISHING THE
RATES FOR THE SALE OF WATER IN SAID CITY; PRE-
SCRIBING PENALTIES FOR THE VIOLATION OF ANY PRO-
VISION OF THIS ORDINANCE AND REPEALING ALL
ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
THEREIN, SPECIFICALLY ORDINANCE NO. 870

8 WHEREAS, The Public Works/Building Director, by letter
9 dated June 26, 1979, has recommended that the City Council of
10 the City of Vernon amend Sections 25.1, 25.2, 25.3, 25.5 and 25.8
11 of the Vernon City Code.
12 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
13 CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
15 finds and determines that the recitals contained hereinabove are
16 true and correct.

SECTION 2: That Section 25.1 is hereby amended to
18 read as follows:

"Sec. 25.1. r.1onthly Rates Established.
The rates to be charged by the Water Depart-
ment for the sale of water from its municipal
water plant for domestic, commercial, industrial,
fire protection purposes, and standby service to
be due and payable to the City monthly, are
hereby fixed as follows:

SECTION 4: That Section 25.3 is hereby amended to read

"Sec. 25.3. Same-For Standby Service.
The monthly consumption allowance and the
minimum monthly charge for standby service to

15 SECTION 5: That Section 25.5 is hereby amended to read

17 "Sec. 25.5. Minimum Rates for Fire Protection
18 Purposes.
19 The rates to be established, which shall
20 be considered the minimum rate for connections
21 to the water system of the City for fire protect-
22 ion purposes, shall be as follows:

The charge for all water used shall be
at the rate shown in Section 25.1 and shall
be payable semi-annually. Any portion of a
month shall be considered a full month."
SECTION 6: That Section 25.8 is hereby amended to read
as follows:
"Sec. 25.8. Rates for Person Conducting Retail
Water Business.
The rate to be charged by the City for the
sale of water from its municipal plant to any
person, firm or corporation conducting a retail
water business shall be, and the same is hereby
fixed at twenty-eight cents (28~) per one
hundred cubic feet. (For the definition of
'retail water business' see Section 1 of Rules
and Regulations.)"
SECTION 7: The City Council of the City of Vernon
hereby declares that the applicable rates contained in this
Ordinance shall be effective for the first regular water reading
for monthly billing purposes, in the month of August, 1979.
SECTION 8: All other Ordinances or parts of Ordinances
thereof in conflict with this Ordinance, specifically Ordinance
No. 870, are hereby repealed.

1 SECTION 9: Any person, firm, or corporation violating
2 any of the provisions of this Article shall be deemed guilty of a
3 misdemeanor, and each such person shall be deemed guilty of a
4 separate offense for each and every day or portion thereof during
5 which any violation of any of the provisions of this Article is
6 committed, continued, or permitted, and upon conviction of any
7 such violation such person shall be punishable by a fine of not
8 more than Five Hundred Dollars ($500.00) or by imprisonment for
9 not more than six (6) months, or by both such fine and imprison-
10 ment.
11 SECTION 10: If any section, subsection, sentence, clause
12 phrase or word of this Ordinance is for any reason held to be void
13 or unconstitutional, such decision shall not affect the validity
14 of the remaining portions of this Ordinance; it being the in-
15 tention of the City Council of the City of Vernon to adopt and
16 pass this Ordinance and each section, subsection, sentence,
17 clause or phrase thereof irrespective of the fact that one or
18 more of the sections, subsections, clauses, sentences or phrases
19 thereof may be declared void or unconstitutional.
20 SECTION 11: There being no newspaper printed, published
21 and circulated in the City of Vernon, the City Clerk is hereby
22 directed to certify to the passage of this Ordnance and shall
23 post the same, or cause the same to be posted, in three of the
24 most public places in the City of Vernon, to wit: the northwest
25 corner of 38th Street and Santa Fe Avenue, the northeast corner
26 of Leonis Boulevard and Pacific Boulevard, and on the bulletin
27 board in the lobby of the City Hall of said City, located at 4305
28 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
