Ordinance No. 896 1 ORDINANCE NO. 896 2 3 AN ORDINANCE OF THE CITY OF VERNON DETERMINING THAT GRAFFITI OR OTHER INSCRIBED MATERIAL IS OBNOXIOUS AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS/BUILDING TO REMOVE SAID GRAFFITI OR OTHER INSCRIBED MATERIAL IN ACCORDANCE WITH GOVERNMENT CODE ~53069.3 4 5 6 WHEREAS, graffiti on public and private property has 7 increased within the City limits of the City of Vernon; and 8 WHEREAS, said graffiti is and has been visible to people 9 utilizing the public right of way; and 10 WHEREAS, citizens of the City of Vernon have complained 11 that the graffiti and other inscribed material is and was 12 obnoxious. 13 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON 14 DOES ORDAIN AS FOLLOWS: 15 SECTION 1: That the City Council of the City of Vernon 16 hereby finds and determines that the recitals contained herein- 17 above are true and correct. 18 SECTION 2: Graffiti on public and private property is 19 a blighting factor which not only depreciates the value of the 20 21 property which has been the target of such malicious vandalism, but also depreciates the value of the adjacent and surrounding 22 properties, and in so doing, negatively impacts upon the entire 23 community. The City has in the past undertaken to remove graffiti 24 from public property but has been unable to mount a successful 25 program for encouraging the owners of private property to undertake 26 to remove graffiti and other inscribed materials from walls, 27 structures, etc. The last session of the legislature adopted 28 Chapter 330, adding ~53069.3 to the Government Code and authorizing 1 the City under certain circumstances to provide for the removal 2 of graffiti or other inscribed material. The City Council finds 3 and determines that graffiti is obnoxious and unless it and other 4 inscribed material is removed from public and private properties, 5 it tends to remain; and other properties are then in the target 6 of graffiti with the result that entire neighborhoods and indeed 7 the community is depreciated in value and made a less desirable 8 place to be. The City Council therefore determines that it is 9 appropriate that the City of Vernon develop procedures to implement 10 the provisions of ~53069.3 of the Government Code and provide for 11 the removal of graffiti and other inscribed material from both 12 public and private property under the circumstances set forth 13 hereinafter. 14 SECTION 3: Notwithstanding any other provisions of the 15 Vernon Municipal Code to the contrary, whenever the Director of 16 Public Works/Building determines that graffiti or other inscribed 17 material is so located on public or private property as to be 18 capable of being viewed by a person utilizing any public right of 19 way in this City, be this road, parkway, alley, or otherwise, and 20 the owner of the property consents to the removal by the City of 21 the graffiti or other inscribed material and executes such 22 document as the City may provide relative to the removal of the 23 graffiti or other inscribed material, then the Director of Public 24 Works/Building is authorized to provide for the removal of the 25 graffiti or other inscribed material. If the Director of Public 26 Works/Building provides for the removal of the graffiti or other 27 inscribed material, he shall not authorize nor undertake to provide 28 for the painting or repair of any more extensive area than that -2- 1 where the graffiti or other inscribed material is located. 2 SECTION 4: This Ordinance is deemed to be necessary in 3 order to preserve and protect the public peace, health, safety, 4 and general welfare and is adopted as an urgency ordinance and 5 shall take effect immediately. 6 SECTION 5: There being no newspaper printed, published 7 or circulated in the City of Vernon, the City Clerk is hereby 8 directed to certify to the passage of this Ordinance and shall 9 post the same, or cause the same to be posted, in three (3) of 10 the most public places in the City of Vernon, to wit: the 11 northwest corner of 38th Street and Santa Fe Avenue; the northeast 12 corner of Leonis Boulevard and Pacific Boulevard, and on the 13 bulletin board in the lobby of the City Hall of said City, located 14 at 4305 Santa Fe Avenue, all in the City of Vernon, County of 15 Los Angeles, State of California. 16 APPROVED AND ADOPTED this 19th day of February, 1980. 17 18 ,_""--~ i.<~t'''--t {'z._ . 19 'LEONIS Mayor 20 ATTEST: 6~~~----/ BRUCE V.
