Ordinance No. 899 r 10 11 12 1 ORDINANCE NO. 899 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVIN~, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILDING OR STRUCTURES IN THE CITY OF VERNON, STATE OF CALIFORNIA, AND PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND ADOPTING THE UNIFORM BUILDING CODE 1979 EDITION, INCLUDING APPENDICES, CHAPTERS 23, 38, 48 and 57, PROMULGATED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH 4 5 6 7 8 9 WHEREAS, Uniform Building Code, 1979 Edition, Volume I, including Appendices, Chapters 23, 38, 48 and 57, was promulgated 13 by the International Conferen~e of Building Officials; and . 14 WHEREAS, Arthur E. Nelson, Director of Public Works/ 15 Building, by memo dated June 4, 1980, has recommended that the 16 City Council of the City of Vernon adopt the Uniform Building 17 Code, 1979 Edition, Volume I, including Appendices, Chapters 23, 18 38, 48 and 57, except as provided in this Article, copyrighted by 19 the International Conference of Building Officials; and 20 WHEREAS, the City Council of the City of Vernon is 21 authorized pursuant to S50023.2 of the California Government Code 22 to adopt by reference said Code. 23 NOW, THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 24 THE CITY OF VERNON AS FOLLOWS: 25 SECTION 1: Section 7.2 of the Vernon City Code is hereby 26 amended to read as follows: 27 "Sec. 7.2. Uniform Building Code, Volume 1, 1979 Edition-Adopted. 28 1 The Uniform Building Code, 1979 Edison, 2 including Appendices, Chapters 23, 38, 48 and 3 57, copyrighted by the International Con- 4 ference of Building Officials, except as 5 provided in this Article, is hereby adopted 6 as the Building Code of the City of Vernon." 7 SECTION 2: Section 7.3 of the Vernon City Code is hereby 8 amended to read as follows: 9 "Sec. 7.3. Amendments. 10 The Uniform Building Code, 1979 Edition 11 is hereby amended as follows: 12 (A) Section 204 is hereby deleted. 13 (B) Table 3-A - 'Building Permit Fees' 14 is amended to read as follows: 15 As set forth by resolution of the City 16 Council. 17 (C) Section 307(a) is amended to read 18 as follows: 19 'CERTIFICATE OF OCCUPANCY' 20 Section 307(a). Use or Occupancy. No 21 building or structure of Groups A, E, I, H, 22 B or R, Division 1 Occupancy, shall be used 23 or occupied, and no change in the existing 24 occupancy classification of a building or 25 structure or portion thereof shall be made 26 until the Building Official has issued a 27 Certificate of Occupancy therefor as provided 28 therein. Where a special inspection is -2- r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 required to determine compliance with the provisions of this Code for a Certi- ficate of Occupancy or acceptance of a conforming use in a conforming or non- conforming building, an inspection fee shall be paid as set forth by resolution of the City Council. (D) Section 1704 is amended to read as follows: Section 1704. Roof covering of all buildings shall be fire retardant as specified in Section 3203(e). Skylights shall be constructed as re- quired in Chapter 34. Penthouses shall be constructed as required in Chapter 36. For use of plastics in roof, see Chapter 52. For Attics: Access and Area, see Section 3205. For roof drainage, see Section 3207. (E) Section 4401 is amended to read as follows: 'GENERAL' Section 4401. No person shall use or occupy a street, alley or public sidewalk for the performance of work under a building permit except in accordance with the provisions of this Chapter. No person shall perform any work on any -3- r 1 building or structure adjacent to a public 2 way in general use by the public for 3 pedestrian travel, unless the pedestrians 4 are protected as specified in this Chapter. 5 Any material or structure temporarily 6 occupying public property, including fences 7 and walkways, shall be adequately lighted 8 between sunset and sunrise. 9 Nothing contained herein shall be con- 10 strued to grant permission to use the public 11 street, right-of-way or public property, 12 either permanently or temporarily, without 13 first obtaining a permit from the Director ~ 14 of Public Works. 15 (F) Section 4404 is hereby deleted. 16 (G) Section 4501 is amended to read as 17 follows: 18 Section 4501. No part of any structure 19 or any appendage thereto shall project beyond 20 the property line of the building site, except 21 as specified in this Chapter. 22 Structure or appendages regulated by this 23 Code shall be constructed of materials as 24 specified in Section 1710. 25 The projection of any structure or 26 appendage shall be the distance measured 27 horizontally from the property line to the 28 outermost point of the projection. -4- r 1 Nothing in this Code shall prohibit 2 the construction and use of a structure 3 between buildings and over or under a public 4 way provided the structure complies with all 5 requirements of this Code. 6 No provisions of this Chapter shall be 7 construed to permit the violation of other 8 laws or ordinances regulating the use and 9 occupancy of public property. 10 Nothing contained herein shall be con- 11 strued to grant permission to use the public 12 street, right-of-way, or public property, 13 either permanently or temporarily, without , ~ 14 first obtaining a permit from the Director 15 of Public Works. 16 (H) Section 4503 is hereby deleted. 17 (I) Section 4504 is amended to read as 18 follows: 19 'BALCONIES AND APPENDAGES' 20 Section 4504. Oriel windows, balconies, 21 unroofed porches, cornices, belt courses and 22 appendages, such as watertables, sills, 23 capitals, bases and architectural pro- 24 jections, may project over the public property 25 26 of the building site as provided in Ordinance 796, or as permitted by the Director of Public 27 Works of the City of Vernon, and upon such 28 terms and conditions as may be reasonably -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 imposed by said Director of Public Works. (J) Section 4505 is amended to read as follows: 'MARQUEES' Section 4505. (a) General. For the purpose of this Section, a marquee shall include any object or decoration attached to or a part of said marquee. The projection, clearance length, and thickness of the marquee will be subject to the approval of the Director of Public Works of the City of Vernon. (b~ ConstruGtion. A marquee shall be supported entirely by the building and constructed of noncombustible material or when supported by a building of Type V con- struction may be of I-hour fire-resistive construction. (c) Roof Construction. The roof or any part thereof may be a skylight, provided wire glass is used not less than 1/4 inch thick with no single pane more than 18 inches wide. (K) Section 4507 is hereby deleted. (L) Section 5206 is hereby deleted. (M) Section 5207 is hereby amended to read as follows: 'SKYLIGHTS' Section 5207(a). Regardless of the -6- w 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 provisions in Chapter 34, no plastic shall be used in skylights installed on any roof in the City of Vernon unless the skylight is constructed of approved plastics and protective measures are taken to insure safety to any persons on the roof. Such safety measures, details, installation and construction standards shall be approved by the Building Official and the Fire Chief of the City of Vernon. (b) Plastic skylights, flat or corrugated, shall be provided with a suppor~ing barrier immediately above or below and in contact with the skylight. This barrier shall be the equivalent of the galvanized steel wire mesh with a maximum wire spacing of one inch (1") and minimum wire diameter (0.10"). The connections of the Larrier to its supports shall be de- signed for a concentrated load of 300 Ibs. placed at any point. (c) Each skylight unit may have a maximum- area of 32 square feet. (d) The aggregate area of skylights shall not exceed 25 percent of the floor area of the room or space sheltered by the roof in which they are installed. (e) All existing plastic skylights -7- r 1 which may be determined to be hazardous 2 to any person or persons on any roof in the 3 City of Vernon shall be examined by the 4 Building Official or his authorized agent 5 and/or the Fire Chief of the City of Vernon 6 or his authorized agent. If said plastic 7 skylight or skylights shall be determined 8 to be hazardous, the Building Official shall 9 require that the owner or person in charge 10 of the affected building shall remove the 11 affected skylight or protect it in conformity 12 with Section 5207(b). If the skylight or 13 skylights are to be removed, they shall be 14 replaced with a roof construction conforming 15 to this Code for the location, type of con- 16 struction and occupancy of the building." 17 SECTION 3: Section 7.4 of the Vernon City Code is hereby 18 amended to read as follows: 19 "Section 7.4. Requirements for Issuance of Building Permits and Certificates of Occupancy. 20 21 (a) Before any building permit or 22 certificate of occupancy may be issued for 23 the construction or occupancy of any structure 24 within the City, it must appear: 25 26 (1) That all laws of the City per- taining to zoning, subdivision, setback lines, 27 fire and other laws and rules and regulations, 28 applicable to the property for which the -8- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 permits or certificate of occupancy is sought have been complied with and that the granting of the permit or certificate of occupancy will not result in a contra- vention of any law or rule or regulation of the City. (2) That the lot, parcel or unit of land for which the permit or certificate of occupancy is sought has a reasonable minimum frontage, for the purpose of which the permit or certificate of occupancy is sought, on a dedicated street or otherwise public~y travele~ street of a reasonable width. The street shall be suitably improved in accordance with standards and specifications now or hereafter approved by the City Council, and is adequate in respect to the public health, safety and general welfare for the special circumstances of a particular street or highway. In the absence of such standards and specifications, the suitability of such improvements shall be approved by the Director of Public Works of the City of Vernon, and he shall determine the improvements required." SECTION 4: Section 7.5 of the Vernon City Code is hereby amended to read as follows: "Section 7.5. Ordinance Repealed. Ordinance No. 874 and all ordinances -9- r 1 amendatory thereto and all ordinances or 2 parts of ordinances in conflict with this 3 Ordinance are hereby repealed." 4 SECTION 5: Public Hearing. 5 A public hearing shall be convened by the City Council on 6 July 15, 1980, at 2:00 p.m., or as soon thereafter as the matter 7 may be heard at the Council Chambers of the Vernon City Council 8 located at 4305 Santa Fe Avenue, Vernon, California, for the 9 purpose of considering adoption of the 1979 Edition of the Uniform 10 Building Code. The City Clerk shall post a notice of said hearing, 11 in the same manner as provided for the posting of ordinances, 12 stating that said hearing shall be conducted, the purpose of said 13 hearing, and the copies of sa~d Code are on file with the City 14 Clerk and are available for public inspection. Such notice shall 15 also be published in accordance with Government Code ~6060 in 16 the Los Angeles Daily Journal, which the City Council finds to be 17 a newspaper of general circulation nearest to the City most 18 appropriate for this purpose. 19 SECTION 6: Ordinance Posting. 20 There being nO newspaper printed, published and circulate 21 in the City of Vernon, the City Clerk is hereby directed to certif 22 to the passage of this Ordinance and shall post the same, or cause 23 the same to be posted, in three of the most public places in the 24 City of Vernon, to wit: the northwest corner of 38th Street and 25 Santa Fe Avenue, the northeast corner of Leonis Boulevard and 26 Pacific Boulevard; and on the bulletin board in the lobby of the 27 City Hall of said City, located at 4305 Santa Fe Avenue, all in th 28 City of Vernon, County of Los Angeles, State of California, that -10- 22 - 23 1 this Ordinance shall be in full force and effect thirty (30) days 2 from and after the final passage of the same. 3 APPROVED AND ADOPTED this 4th day of DeceIrJber.~.+~80. 4 5 6 7 ATTEST: /fr(~ 8 ~ --' 9 10 BRUCE V.
