ORDINANCE NO. 905
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON A~lliNDING SECTION 2 OF ORDINANCE NO. 895
AS AMENDED BY ORDINANCE NO. 898 PROVIDING FOR
RATES TO BE CHARGED FOR ELECTRICAL ENERGY DIS-
TRIBUTED AND SUPPLIED BY SAID CITY WITHIN ITS
BOUNDARIES AND REPEALING ALL ORDINANCES AND
PARTS OF ORDINANCES IN CONFLICT THERmHTH
WHEREAS, the City Council of the City of Vernon adopted
Ordinance No. 895 on March 4, 1980; and
WHEREAS, the City Council of the City of Vernon amended
Section 2 of Ordinance No. 895 by adopting Ordinance No. 898 on
April 8, 1980; and
WHEREAS, said rate ordinance provides that all customers
of electrical energy in said City are divided into certain de-
fined classes of service based on the amount of electricity
utilized during the prior billing period; and
WHEREAS, the City of Vernon is currently purchasing
electrical energy for resale under a time of use rate schedule
perrnitted by the Federal Energy Regulatory Commission in Docket
No. ER79-150; and
WHEREAS, it is possible for the City of Vernon to reduce
its cost of purchased electrical energy if its consumers are
willing to reduce their dernand for service during peak periods;
and
~VHEREAS, the City Conncil of the City of Vernon intends
to establish an industrialized contractural rate as an incentive
for consumers to alter their demand for service; and
WHEREAS, the City Council of the City of Vernon finds I
it necessary to establish a special class of service wherein ratesl

1 I may be established by contract in order to implement said cost
2 savings; and
3 WHEREAS, said contract will require a customer to alter
4 its demand for services in order to qualify for an individualized
5 contractual rate; and
6 WHEREAS, said individualized rate shall recover all
7 costs associated with said electrical service; and
8 ~\THEREAS, said cont.ract shall include sufficfent re-
9 strictions which will protect the City of Vernon.
10 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
11 THE CITY OF VERNON AS FOLLOWS:

The City Council of the City of Vernon
13 hereby finds and determines that the recitals contained herein-
14 above are true and correct.

Section 2 is hereby amended to read as

Section 2: General Rates
18 Those rates, terms and conditions set forth in the
19 attached exhibits referenced and identified below, are hereby
20 incorporated by reference and made a part hereof as though fully
21 set forth at length and are hereby adopted as the City's rates,
22 terms and conditions for the distribution of the electrical energy
23 supplied by the City for certain classes of service:

SECTION 3: That all references to the Company in all
18 of the Schedules, Exhibits "A" through "0", shall be deemed to
19 refer and mean the City of Vernon.
SECTION 4: Any other ordinance or portion thereof in
21 conflict with this Ordinance, is hereby repealed.

SECTION 5: There being no newspaper printed, published
or circulated in the City of Vernon, the City Clerk is hereby
directed to certify to the passage of this Ordinance and shall
post the same, or cause the same to be posted, in three (3) of
26 the most public places in the City of Vernon, to wit: the north-

west corner of 38th Street and Santa Fe Avenue; the northeast
corner of Leonis Boulevard and Pacific Boulevard, and on the

1 'bUlletin board in the lobby of the City Hall of said City located
2 at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los
3 Angeles, State of California; that this Ordinance shall be in full

SPECIAL CONTRACT
APPLICABILITY
This schedule is applicable when, in the opinion of the
Company, the customer offers to enter into a contract wherein
the cus-tomer' s load and use characteristics are altered and said
alteration provides savings to the City of Vernon.
TERRITORY
Within the City limits of the City of Vernon.
RATES
Rates are to be established pursuant to contract.
SPECIAL CONDITIONS
1. Conditions: Conditions are to be established
pursuant to contract, h6wever, in the event said contract is not
complied with, then the rates previously applicable except for
the contract shall be applied to all electrical services supplied
during the contract period.
2. Energy Cost Adjustment: The rates above are subject
to adjustment as provided for in Part G of the Preliminary
Statement. . The applicable energy cost adjustment billing factor
and fuel collection balance adjustment billing factor set forth
therein will be applied to KWH billed under this schedule.

It was moved by Gonzales, seconded by McCormick, that the reading of
Ordinance No. 905 in full be waived; and that Ordinance No. 905 receive a
.second and final reading by title.. Motion carried.

°Payroll Warrant Register No. 278" covering Claims. and Demands presented
during the period June 29 to July 26, which includes Demands Nos.-3102 to 3123
(both inclusive) drawn on the Crocker National Bank, totaling $512,313.92 (Ac-
counting Period July, 1980) was examined and audited.
Tt was moved by Gonzales, seconded by McCormick, that "Payroll-Warrant
Register No. 279!' be approved and payment authorized for Demands Nos. 3102 to
-3123 (both inclusive), with no exceptions. Motion carried.
Communication from Bruce V. Malkenhorst, Director of Finance, dated
August. l9, 1980, transmitting minutes of the Finance Corrmdttee held August
18,.1980, was presented. (Copy to_each member: of the City Council)
It was moved by McCormick, seconded by Gonzales, that the minutes of
the Finance Committee meeting held August 18, 1980_,. be approved and that the
recommendations contained therein be adopted. Motion carried.
Communication from-Bruce V. Malkenhorst, City Administrator/City Clerk,
dated August 19, 1980, recorrmending that Contract No. 411, Traffic Signal
Maintenance, be extended for one year, based on the agyeement with the present
contractor to increase their rates only 13%, was presented.
Resolution No. 4752 - A Resolution of the City Council of the City of
Vernon Extending Contract No. 411 for Traffic Signal Maintenance,. 1877-198Q
with.Signal Maintenance, Tnc. for a Period of One Year, September 1, 1880 to
August 31; 1881; and Approving the Execution of Said Contract.
It was moved by McCormick, seconded by Gonzales, that Resolution No. 4752
be approved and adopted. .Motion carried.

Communication from Bruce V. Malkenhorst; City AdmirLtstrator/City Clerk,
dated August 18, 1g80, advising that the Dixector of Public Works reported
that Transamerica Delaval; 5125. Alcoa Avenue was issued a permit on August
16, 1978 for two temporary mobile trailers, 10 ft. X 55 ft., ,joined together
on their property to house a light soldering assembly .operation. They are now
soliciting bids for a new building and this operation will be relocated in the.
new building. upon its completion and the trailers removed, recoiranending a one-
year extension of the permit,. until August 16, 1981, was presented.
It was. moved by McCormick, seconded by Gonzales, that Transamerica
Delaval be granted a one-year extension permit for. two temporary trailers at
5125 Alcoa Avenue,. until August 16, 1981. Motion carried.
