ORDINANCE NO. 911
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON FIXING RATES TO BE CHARGED FOR
ELECTRICAL ENERGY DISTRIBUTED AND SUPPLIED
BY SAID CITY WITHIN ITS BOUNDARIES AND
REPEALING CERTAIN ORDINANCES OF THE CITY OF
VERNON RELATING THERETO
WHEREAS, the Federal Energy Regulatory Commission in
Docket No. ER79-l50 permitted Southern California Edison Company
to institute new electrical rates applicable to resale purchasers
effective August 16, 1979; and
WHEREAS, the Federal Energy Regulatory Commission in
Docket No. ER8l-l77-000 permitted Southern California Edison
Company to institute new electrical rates applicable to sales
in the interstate market effective July 16, 1981; and
WHEREAS, said rates were permitted to become effective
subject to refunds in the event the Federal Energy Regulatory
Commission finds said rates to be unreasonable at the conclusion
of its consideration of said dockets; and
WHEREAS, the City of Vernon has intervened in both
said dockets questioning the reasonableness of Southern Cali-
fornia Edison Company's wholesale rates; and
WHEREAS, the Federal Energy Regulatory Commission is
not expected to determine the reasonableness of said permitted
rates in the near future; and
WHEREAS, the previous rates for electrical service
within the City of Vernon were adopted by Ordinance No. 895 on
March 4, 1980, as amended by Ordinance No. 898 on April 8, 1980,
as amended by Ordinance No. 905 on August 19, 1980; and
1 WHEREAS, the design of said rates established therein
2 do not adequately reflect the recovery of current costs and
3 their allocation between existing classes of service; and
4 WHEREAS, the City of Vernon is currently purchasing
5 electrical energy for resale under a time-of-use rate schedule
6 permitted by the Federal Energy Regulatory Commission in Dockets
7 No. ER79-l50 and No. ER8l-l77-000; and
8 WHEREAS, the City Council of the City of Vernon intends
9 to establish individualized contractural rates as incentives for
10 customers to alter their peak demand for service; and
11 WHEREAS, the City Council of the City of Vernon finds
12 it necessary to establish a special class of service wherein
13 rates may be established by contract in order to implement said
14 individualized rates; and
15 WHEREAS, said individualized rates shall recover all
16 costs associated with said electrical service; and
17 WHEREAS, said contract shall include sufficient
18 restrictions which will protect the City of Vernon; and
19 WHEREAS, the City of Vernon retained the services of
20 Baker G. Clay & Associates, Inc. to study the cost of revenues
21 applicable to the Vernon system and to recommend new rates for
22 electrical services within the City of Vernon; and
23 WHEREAS, the City Council of the City of Vernon held a
24 public hearing on June 9, 1981 to consider the recommendations
25 of Baker G. Clay & Associates, Inc. and the adoption of this
26 Ordinance.
27 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
28 DOES ORDAIN AS FOLLOWS:

SECTION 1: Purpose and Scope
2 The rates to be charged and collected, and the terms
3 and conditions respecting the distribution of electrical energy
4 supplied by the City of Vernon for such service from and after
5 the effective date of this Ordinance shall be as set forth
6 herein. This Ordinance may be referred to as the City of
7 Vernon's "Electrical Energy Distribution Ordinance".

SECTION 2: General Rates
9 Those rates, terms and conditions set forth in the
10 attached exhibits referenced and identified below, are hereby
11 incorporated by reference and mad~ a part hereof as though
12 fully set forth at length and are hereby adopted as the City's
13 rates, terms and conditions for the distribution of the
14 electrical energy supplied by the City for certain classes of
15 service:

SECTION 3: Special Contract Rate
13 determines that all customers whose monthly maximum demand
12 The City Council of the City of Vernon hereby finds and
14 exceeds 10,000 KW for any month during the preceding 12 months
15 shall receiv~ service pursuant to Schedule No. SC - Special
16 Contract Rate.
17 Further, any customer willing to reduce its demand for
18 service during peak periods may receive service pursuant to
20
19 Schedule No. SC - Special Contract Rate.
SECTION 4: Energy Cost Adjustment
21 The rates charged for the distribution of energy supplie
22 by the City for services rendered from and after the effective
23 date of this Ordinance may include an Energy Cost Adjustment
24 Billing Factor to be determined by the City Council. Such
25 changes in the Energy Cost Adjustment Billing Factor shall be
26 made from time to time by Resolution of the City Council when,
27 in the City Council's opinion, such changes are necessary for
28 the sound financial operation of the Light and Power Operating

1 Funds. Any Energy Cost Adjustment Billing Factor charged,
2 pursuant to Ordinance Nos. 895, 898 and 905 and any resolutions
3 adopted pursuant thereto, shall remain in full force and effect
4 until the effective date of this Ordinance.
5 SECTION 5: Other Rules and Regulations
6 The rules and regulations respecting the distribution
7 of electrical energy supplied by the City of Vernon shall be
8 those rules and regulations of Edison applicable to electrical
9 service in the City of Vernon which have been adopted by the
10 City Council and filed with the City Clerk of the City of Vernon
lIon December 27, 1961, and subsequent thereto, up to and including
12 the date of enactment of this Ordinance.
13 The City Council of the City of Vernon may from time
14 to time authorize by resolution changes in the rules and
15 regulations applicable to said electrical service provided said
16 changes are not in conflict with the rate schedules provided for
17 herein and provided said rules and regulations relate to
18 conditions of service, application and interpretation of rates,
19 and relate to other provisions set forth in this Ordinance. Any
20 rule or regulation adopted pursuant to Ordinance Nos. 745, 806,
21 828, 863, 895, 898 and 905 or any resolution adopted pursuant
22 thereto, shall remain in full force and effect until amended or
23 rescinded by this Ordinance or a resolution adopted pursuant to
24 this Ordinance.
25 SECTION 6: Reference to Public Utilities Commission
26 Any provisions of the rules and regulations of Edison
27 adopted by Vernon relating to the exercise of jurisdiction by the
28 Public Utilities Commission of the State of California shall be

deemed to refer to and mean the City Council of the City of
Vernon.
SECTION 7: Other Ordinances Amended
Any other ordinance or portion thereof in conflict with
this Ordinance, is hereby repealed, excepting Ordinance Nos.
806, 828, 839, 849, 863, 873, 895, 898 and 905 which are partiall
repealed by this Ordinance.
SECTION 8: Maintenance of Records
The City Clerk of the City of Vernon is hereby directed
to keep and maintain three (3) copies of the above-mentioned
rate schedules and rules and regulations applicable to electric
service in the City of Vernon in the office of the City Clerk of
the City of Vernon, and make such tariff schedules available
on request for examination in said office.
SECTION 9: Posting of Ordinance
There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby
directed to certify to the passage of this Ordinance and shall
post the same, or cause the same to be posted, in three (3) of
the most public places in the City of Vernon, to wit: the
northwest corner of 38th Street and Santa Fe Avenue; the
northeast corner of Leonis Boulevard and Pacific Boulevard, and
on the bulletin board in the lobby of the City Hall of said
City, located at 4305 Santa Fe Avenue, all in the City of Vernon,
County of Los Angeles, State of California; that this Ordinance
shall be in full force and effect thirty (30) days from and
after the passage of the same.

Incandescent lamps furnished under this provision will be extended service
lamps only. Mercury vapor lamps and high pressure sodium vapor lamps
furnished under this provision will be as specified by the Company. Globes
for renewal shall be furnished by the customer. Maintenance service will be
furnished only where, in the opinion of the Company, no undue hazard or
expense will result because of location, mounting height, or other reasons.
4. Switchinq Facilities: For all night or midnight (Pacific Standard
Time) service under the Company's standard operating schedules, the Company
will furnish, maintain, and operate the necessary switching facilities. For
other operating schedules, the customer shall furnish, maintain, and operate
switching facilities as specified by the Company and take metered service
under Rate B.
5. Hours of Service: Under the Company's standard all night operating
schedule approximately 4,140 hours of service per year will be furnished,
and under the Company's standard midnight (Pacific Standard Time) operating
schedule approximately 2,090 hours of service per year will be furnished.
6. Removal of Equipment: Where the street lighting service and
facilities were ordered removed by a customer and such service and facilities,
or their equivalent, are ordered reinstalled within 36 months from the date
of the order to remove, the customer shall pay to the utility in advance of
reinstallation a nonrefundable amount equal to the cost of removal of the
prior facilities and the estimated cost of such reinstallation. Utility-
owned facilities removed or installed remain the sole property of the utility.
7. Enerqy Curtailment Service: Where the customer requests the in-
stallation and/or removal of equipment in order to curtail energy requirements,
and such request is acceptable to the ut:ility, the utility will comply with
such request provided the customer first: agrees to pay to utility the
estimated cost installed of any additional equipment required and/or the
removal cost of any equipment currently installed. Such payments will not
be refunded and shall be paid in advance or in installments acceptable to
utility over a period of not to exceed three years. Facilities installed

owned luminaires supplied from the Company's existing 120/240 volt overhead
circuits and mounted on existing Company-owned wood poles as standard
equipment. Where the service requested requires the installation of
additional new wood poles, not more than one new wood pole will be installed
for each luminaire in the installation.
2. Where the customer requests the installation of other than the
standard equipment furnished by the Company and such requested equipment is
acceptable to the Company, the Company vvill install the requested equipment
provided the customer agrees to advance the estimated difference in cost
installed between such equipment and standard equipment. Advances made
for this purpose will not be refunded. Facilities installed in connection
wi th such agreements become and remain 1:he sole property of the Company.
3. This service will be in accordance with Company's specifications
as to equipment, installation, maintenance, and operation.
4. The company will replace lamps on a scheduled basis, and individual
lamps will be replaced upon service failure, as soon as practical after
notification by the customer, subject to Company's operating schedules.
5. A written contract for a term of one year will be required by the
Company when service is first establishE~d under this schedule.
6. This service will be furnished only where the installation is
considered by the Company to be of a permanent and established character.
7. Removal or Modification of Equipment: Where area lighting service
and facilities were ordered removed or rnodified by a customer and such
service and facilities, or their equivalent, are ordered reinstalled within
36 months from the date of the order to remove or to modify, the customer
shall pay to the utility in advance of reinstallation a nonrefundable
amount equal to the cost of removal or rnodification of the prior facilities
and the estimated cost of such reinstallation. Facilities removed or
installed remain the sole property of the utility.

9. Energy Curtailment Service:
a. Where the customer requests the installation and/or removal
of equipment in order to obtain Energy Curtailment Service, and such request
is acceptable to the utility, the utilit:y will comply with such request
provided the customer first agrees to advance the estimated cost installed
or any additional equipment required and/or the removal cost of any
equipment currently installed. Such advances will not be refunded. Facili-
ties installed in connection with such requests become and remain the sole
property of the utility.
b. Under the utility's midnight (PST) or equivalent service
operating schedule, approximately 2,090 hours of service per year will be
furnished.
c. Facilities charges shall be applicable under this schedule
only when the Company has been requested to discontinue the existing service
by the customer and the customer has stipulated that the facilities are to
be left in place for future use.
d. The rates above for midnight or equivalent service are subject
to adjustment as provided for in Part G of the Preliminary Statement. The
applicable energy cost adjustment billing factors and fuel collection
balance adjustment billing factor set forth therein will be applied to 5
KWH per month per 1,000 lumens for mercury vapor lamps and to 2 KWH per
month per 1,000 lumens for high pressure sodium vapor lamps.

SPECIAL CONDITIONS
1. Voltage: Service will be supplied at one standard power
voltage.
2. Connected Load: Connected load is the sum of the rated
capacities of all of the customer's equipment that it is possible
to connect to the Company's lines at the same time. determined to
the nearest 1/10 hp. In no case will charges be~based on less
than 2 hp for single-phase service or no less than 3 hp for
three-phase sservice. The rated capacity of the customer's
equipment will be the rated horsepower output of standard rated
motors. the rated horsepower of welders determined in accordance
with the section designated Welder Service in Rule No.2. and the
rated kilovolt-ampere input capacity of other equipment, with
each kilovolt-ampere of input considered equal to one horsepower.
Normally such ratings will be based on the manufacturer's rat.rg
as shown on the nameplate or elsewhere but may, at the option of
the Company. be based on tests or other reliable information.
3. Overloaded Motors: Whenever, upon test, any motor under
normal operating conditions is found to be delivering more than
115 percent of its capacity as indicated by its nameplate rating,
the Company may disregard the nameplate rating and base its
charges upon the output as calculated from test. Any motor
which is billed on a basis in excess of its nameplate rating in
accordance with this special condition shall be tested at
intervals to be determined by the Company or upon notification by
the customer of a permanent change in operating conditions.

4. Temporary Reduction of Connected Load: Where the use of energy
is seasonable or intermittent, no adjus1:ment will be made for any temporary
reduction of connected load. Any customer resuming service on such
connected load within twelve (12) months after it was disconnected will
be required to pay all charges which would have been billed if the temporary
reduction of connected load had not been made.
5. X-Ray Installation: Where a medical X-ray installation is served
from transformer capacity required to SE~rve other load, the rating capacity
of the X-ray installation will be 3 hp. Where the Company installs the
transformer capacity requested by a cus1:omer to serve separately an X-ray
installation, the rated capacity of the X-ray installation will be that of
the transformer installed. Each kilovolt-ampere of such transformer
capacity will be considered equal to one horsepower.
6. Energy Cost Adjustment: The rates above are subject to adjustment
as provided for in Part G of the Preliminary Statement. The applicable
energy cost adjustment billing factors and fuel collection balance
adjustment billing factor set forth therein will be applied to KWH billed
under this schedule.

5. Payment of Service Charges: The annual service charge will be
payable in six equal monthly installmeni:s beginning with the first month
of each contract year.
6. Contracts: A contract for a period of one year will be required
for service under this schedule and will remain in effect from year to
year thereafter unless cancelled. When service is first rendered under this
schedule, the contract year and billing basis shall commence with the
first regular meter reading date after i:he date service is begun.
7. Chanqe of Customer: Any customE~r taking over service on a premises
which has previously been served under 1:his schedule shall have the option
of (a) assuming the benefits and liabilities of the former customer's
contract by paying all charges which would have accrued for continuous
service, in which case the beginning da1:e of the contract year and billing
basis shall remain the same as that established in the former customer's
contract, or (b) the new customer may elect to have the contract year and
billing basis commence with the first regular meter reading date after the
date service is changed to his account.
8. Change of Connected Load: When there is an increase or decrease
in connected load during a contract year, no adjustment in billing to date

multiplying the kilowatthours to date of change by the ratio of the new
connected load to the old connected load.
9. Change of Contract Year: Any contract may, at the customer's
option, be superseded by a new contract beginning with the regular meter
reading date in April of any year and covering the balance of the original
contract period, in which case the annual service charge and the size of
the energy blocks will be prorated according to the proportion that the
number of days from date of beginning of the contract year to the April
reading date bears to 365 days, and credit for any excess payments will be
applied in the new contract year.

1. Standard Equipment Furnished: Bracket or mast arm construction
will be furnished. Where feasible with existing facilities, center
suspension construction may be furnished. Enclosed luminaires will be
furnished for lamps of 2,500 lumens, or larger, and open reflector lighting
units will be furnished for lamps of 1,000 lumens. Such standard lighting
equipment will be attached to wood poles.
2. Other Than Standard Equipment: Where the customer requests the
installation of other than the standard equipment furnished by the Company
and such requested equipment is acceptable to the Company, the Company will
install the requested equipment provided the customer agrees to advance
the estimated difference in cost installed between such equipment and
standard equipment. Advances made for this purpose will not be refunded.
Facilities installed in connection with such agreements become and remain
the sole property of the Company.
3. Hours of Service: Under the Company's standard all night operating
schedule approximately 4,140 hours of service per year will be furnished.
4. Removal or Modification of Equipment: Where street lighting service
and facilities were ordered removed or modified by a customer and such
service and facilities, or their equivalent, are ordered reinstalled
within 36 months from the date of the order to remove or to modify, the
customer shall pay to the utility in advance of reinstallation a non-
refundable amount equal to the cost of removal or modification of the prior
facilities and the estimated cost of such reinstallation. Facilities
removed or installed remain the sole property of the utility.
5. Energy Cost Adjustment: The rates above for all night service
are subject to adjustment as provided for in Part G of the Preliminary
Statement. The applicable energy cost adjustment billing factors and fuel
collection balance adjustment billing factor set forth therein will be
applied to 29 KWH per month per 1,000 lumens for incandescent lamps, to
10 KWH per month per 1,000 lumens for mercury vapor lamps, and to 4 KWH
per month for 1,000 lumens for high pressure sodium vapor lamps.
6. Energy Curtailment Service:
a. Where the customer requests the installation and/or removal

of equipment in order to obtain Energy Curtailment Service, and such
request is acceptable to the utility, the utility will comply with such
request provided the customer first agrees to pay to utility the estimated
cost installed or any additional equipment required and/or the removal
cost of any equipment currently installed. Such payments will not be
refunded and shall be paid in advance or in installments acceptable to
utility over a period of not to exceed three (3) years. Facilities
installed in connection with such requests become and remain the sole
property of the utility.
b. Under the utility's midnight (PST) or equivalent service
operating schedule, approximately 2,090 hours of service per year will
be furnished.
c. Facilities charges shall be applicable under this schedule
only when the utility has been requested to discontinue the existing
service by the customer and the customer has stipulated that the facilities
are to be left in place for future use.
d. The rates above for midnight or equivalent service are
subject to adjustment as provided for in Part G of the Preliminary Statement.
The applicable energy cost adjustment billing factors and fuel collection
balance adjustment billing factor set forth therein will be applied to
15 KWH per month per 1,000 lumens for incandescent lamps, to 5 KWH per
month per 1,000 lumens for mercury vapor lamps, and to 2 KWH per month per

1. Ownership of Facilities:
a. For multiple systems the Company will deliver service at
120, 120/240 volts, or, at the option of the Company, at 240/480 volts,
three wire, single phase. For series systems the Company will furnish
and maintain constant current regulating transformers and deliver service
at the secondary side of such transformers.
b. The customer will furnish and maintain all utilization
equipment beyond the point of delivery except for maintenance service
provided by the Company in accordance with Special Condition 3.
c. Meter locations for multiple systems shall be at points
mutually agreed upon. Meter locations for series systems shall be on
the primary supply circuit to the constant current regulating transformer
at a point acceptable to the Company.
