Ordinance No. 923 1 2 3 4 5 6 ORDINANCE NO. 923 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTION 16.14-1 OF CHAPTER 16 OF THE CODE OF THE CITY OF VERNON, CALI- FORNIA 1959, BY AUTHORIZING THE REMOVAL OF SEMI-TRAILERS UPON VIOLATION OF THE REQUIREMENTS CONTAINED THEREIN AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH 7 WHEREAS, persons and businesses owning and operating 8 semi-trailers have been leaving said semi-trailers unattended 9 and parked upon City streets; and 10 WHEREAS, the parking of said semi-trailers on City 11 streets prevents the free flow of traffic; and 12 WHEREAS, the majority of semi-trailers have 13 registrations that are out of state and the issuance of citations 14 is not adequate to prevent the parking of said semi-trailers 15 on City streets; and 16 WHEREAS, ~22651 of the Vehicle Code authorizes the 17 removal of vehicles from a highway by a peace officer or any 18 regularly employed and salaried employee who is engaged in 19 directing traffic or enforcing parking laws and regulations of 20 a City in which a vehicle is located within the territorial 21 limits of said City provided said local agency adopts a 22 resolution or ordinance providing therefor; and 23 WHEREAS, there is an urgency in adopting this Ordinance 24 for the immediate preservation of the public peace, health, 25 safety, comfort, convenience and general welfare of the City 26 of Vernon and its inhabitants. 27 28 III III III III 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON 2 DOES ORDAIN AS FOLLOWS: 3 SECTION 1: Any person, association of persons or 4 corporation who violates any of the provisions set forth in 5 Section 16.14-1 shall be deemed guilty of a traffic infraction, 6 and upon conviction thereof shall be punished upon a first 7 conviction by a fine not exceeding fifty dollars ($50.00), and 8 for a second conviction within a period of one (1) year by a 9 fine not exceeding one hundred dollars ($100.00), and for a 10 third or any subsequent conviction within a period of one (1) 11 year by a fine not exceeding two hundred fifty dollars ($250.00). 12 SECTION 2: In addition, a peace officer or any regular- 13 ly employed and salaried employee who is engaged in directing 14 traffic or enforcing parking laws and regulations shall remove 15 said semi-trailers from, the public streets if said semi-trailers 16 violate Section 16.14-1. 17 SECTION 3: That the Chief of Police and Director of 18 Community Services are hereby instructed to cooperate in the 19 securing and placing of signs to comply with ~2265l(n) of the 20 Vehicle Code of the State of California. 21 SECTION 4: That the City Council of the City of Vernon 22 hereby declares that there exists an urgency in adopting this 23 Ordinance, and therefore this Ordinance shall be effective 24 immediately upon the approval of a majority of the City Council 25 of the City of Vernon and thenceforth the same shall be in full 26 force and effect. 27 SECTION 5: All ordinances or parts of ordinances in 28 conflict with this Ordinance are hereby repealed. -2- 1 SECTION 6: There being no newspaper printed, published 2 or circulated in the City of Vernon, the City Clerk is hereby 3 directed to certify to the passage of this Ordinance and shall 4 post the same, or cause the same to be posted, in three (3) 5 of the most public places in the City of Vernon, to wit: the 6 northwest corner of 38th Street and Santa Fe Avenue; the 7 northeast corner of Leonis Boulevard and Pacific Boulevard, and 8 on the bulletin board in the lobby of the City Hall of said City, 9 located at 4305 Santa Fe Avenue, all in the City of Vernon, 10 County of Los Angeles, State of California. 11 APPROVED AND ADOPTED this 15th day of December, 1981. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ATTEST: ~~//~ BRUCE V.
