AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING THE TERMS AND CONDITIONS
OF A PROJECT DEVELOPMENT AGREEHENT BETWEEN
SOUTHERN CALIFORNIA PUBLIC POWER AUTHORITY AND
THE CITY OF VERNON, AND AUTHORIZING THE
EXECUTION OF AND DELIVERY OF SAID AGREEMENT
BY OFFICERS OF THE CITY OF VERNON

7 WHEREAS, pursuant to the provisions of Chapter 5,
S Division 7, Title 1 of the Government Code of the State of
!) California, as amended (the "Joint Powers Act"), the City of
10 Vernon and certain other public agencies created pursuant to the
11 laws of the State of California (collectively, the "Members"),
12 have entered into a Joint Powers Agreement (the "Agreement")
13 creating the Southern California Public Power Authority (the
14 "Authority"), a public entity separate and apart from the

16 WHEREAS, In accordance with the Agreement and the Joint
17 Powers Act, the Authority has undertaken or will undertake to,
18 among other things, incur preliminary costs, make (or cause to
19 be made) studies and acquire (or cause to be acquired) options
20
and permits ("Development ~'lork") in connection with a project
21
for the transmission of electric energy, which project (the
22
"Project") is the Mead-Phoenix DC Intertie, a +/-500 KV DC
23 transmission line with AC/DC converter stations at each end and
24
related facilities, to be located in the States of Arizona and

Nevada; and

WHEREAS, the City of Vernon desires to, amonq other
things, participate in, and obtain the benefits of, such
Development Work and to obtain the right of first refusal to
1 output from the Project, and, as such, has determined that it is
2 desirable and in the best interests of the customers of the
:3 electric system of the City of Vernon to enter into a Project
4 Development Agreement (the "Project Development Agreement") in
G the form submitted to this City Council.
6 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
7 DOES ORDAIN AS FOLLm'JS:

SECTION 1: The City Council hereby finds and determines
!) that the terms and conditions of the Project Development
10 Agreement be, and the same are hereby, approved; provided that
11 upon execution thereof the Project Development Agreement will
12 provide the City of Vernon with an option to acquire 35 megawatts
13 of transmission capacity.
14 SECTION 2: The Mayor and the City Clerk of the City
15 of Vernon are authorized to execute and deliver the Project
16 Development Agreement by and on behalf of the City of Vernon in
17 substantially the form submitted to this meeting.

SECTION 3: Pursuant to ~54241 of the Government Code
19 of the State of California, this Ordinance is subject to the
20 provisions for referendum applicable to the City of Vernon.
21 SECTION 4: There being no newspaper printed, published
22 or circulated in the City of Vernon, the City Clerk is hereby
23 directed to certify to the passage of this Ordinance and shall
24 post the same, or cause the same to be posted, in three (3)
25 of the most public places in the City of Vernon, to wit: the
26 northwest corner of 38th Street and Santa Fe Avenue; the
27 northeast corner of Leonis Boulevard and Pacific Boulevard, and
28 on the bulletin board in the lobby of the City Hall of said City,

1 located at 4305 Santa Fe Avenue, all in the City of Vernon,

SECTION 5: The City Council shall cause this Ordinance
4 to be published once within fifteen (15) days of adoption in
f> the Los Angeles Daily Journal, a daily newspaper of general
6 circulation, published in Southern California in accordance
7 with 554242 of the Government Code of the State of California.

SECTION 6: Thirty (30) days from and after its
U enactment, this Ordinance shall take effect and be in full force,
10 in the manner provided by law.
