ORDINANCE NO. 927
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON UNDERTAKING TO COMPLY WITH CERTAIN
FEDERAL ENERGY REGULATORY COMMISSION
REGULATIONS ON ARRANGEMENTS WITH QUALIFYING
COGENERATION AND Sr1ALL POWER PRODUCTION
FACILITIES UNDER SECTION 210 OF THE PUBLIC
UTILITY REGULATORY POLICIES ACT OF 1978
7 WHEREAS, certain obligations are imposed on nonregulated
8 electric utilities by Section 210 of the Public utility
9 Regulatory Policies Act of 1978 ("pURPA") and regulations
10 promulgated thereunder by the Federal Energy Regulatory
11 Commission ("FERC"); and
12 WHEREAS, the City of Vernon's electric utility operation
13 is a nonregu1ated electric utility within the meaning of such
14 statute and regulations; and
15 WHEREAS, the City of Vernon is required by the FERC's
16 regulations, 18 CFR Section 292.401(c), to file a report
17 describing the manner in which the City will implement Subpart C
18 of 18 CFR Part 292.
19 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
20 DOES ORDAIN AS FOLLOWS:

SECTION 1: The City of Vernon hereby undertakes to
22 comply with all lawful regulations of the FERC codified in
23 Subpart C of 18 CFR Part 292 dealing with arrangements with
24 qualifying cogeneration and small power production facilities
25 under Section 210 of PURPA.
26 SECTION 2: The City Administrator/City Clerk and the
27 City Attorney are jointly and severally authorized and directed
28 to file with the FERC a copy of this Ordinance reflecting the
1 City's compliance with 18 CFR Section 292.401(c).

SECTION 3: There being no newspaper of general
3 circulation printed, published or circulated in the City of
4 Vernon the City Clerk is hereby directed to certify to the
5 passage of this Ordinance, and shall post the same, or cause the
6 same to be posted, in three of the most public places in said
7 City, to wit: the northwest corner of 38th Street and Santa Fe
8 Avenue; the northeast corner of Leonis Boulevard and Pacific
9 Boulevard and on the bulletin board in the lobby of the City
10 Hall of said City, located at 4305 Santa Fe Avenue, all in the
11 City of Vernon, Los Angeles County, California; that this
12 Ordinance shall be in full force and effect thirty (30) days
13 from and after said posting.
