ORDINANCE NO. 929
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON FIXING RATES TO BE CHARGED FOR
ELECTRICAL ENERGY DISTRIBUTED AND SUPPLIED
BY SAID CITY WITHIN ITS BOUNDARIES AND
REPEALING CERTAIN ORDINANCES OF THE CITY
OF VERNON RELATING THERETO
WHEREAS, the Federal Energy Regulatory Commission
(hereinafter "FERC") in Docket No. ER82-427 permitted Southern
California Edison Company to institute new electrical rates
applicable to resale purchasers effective June 2, 1982; and
WHEREAS, said rates were permitted to become effective
subject to refunds in the event the FERC finds said rates to be
unreasonable at the conclusion of its consideration of said
docket; and
WHEREAS, the City of Vernon has intervened in said
docket questioning the reasonableness of Southern California
Edison Company's wholesale rates; and
WHEREAS, the FERC is not expected to determine the
reasonableness of said permitted rates in the near future; and
WHEREAS, the previous rates for electrical service
within the City of Vernon were adopted by Ordinance No. 911 on
June 16, 1981, as amended by Ordinance No. 915 on July 21, 1981;
and
WHEREAS, the design of said rates established therein
do not adequately reflect the recovery of current costs and
their allocation between existing classes of service; and
WHEREAS, the City of Vernon is currently purchasing.
electrical energy ~or resale under a time-of-use rate schedule
permitted by the FERC in Docket No. ER82-427; and
1 WHEREAS, the FERC in Docket No. ER82-427 provided for
2 a two-step rate increase with the first step being effective
3 on June 2, 1982, and the second step being effective the earlier
4 of the in-service date of Southern California Edison Company's
5 San Onofre Nuclear Generating Station Unit No. 2 which is
6 anticipated to be August 15, 1982 or November 2, 1982; and
7 WHEREAS, the City Council of the City of Vernon intends
8 to establish individualized contractural rates as incentives for
9 customers to alter their peak demand for service; and
10 WHEREAS, the City Council of the City of Vernon finds
11 it necessary to establish a special class of service wherein
12 rates may be established by contract in order to implement said
13 individualized rates; and
14 WHEREAS, said individualized rates sha11 recover all
15 costs associated with said electrical service; and
16 WHEREAS, said contract shall include sufficient
17 restrictions which will protect the City of Vernon; and
18 WHEREAS, the City of Vernon retained the services of
19 Baker G. Clay & Associaties, Inc. to study the cost of service
20 applicable to the Vernon system and to recommend new rates to
21 recover said costs for providing electrical services within
22 the City of Vernon; and
23 WHEREAS, Baker G. Clay & Associates, Inc. has prepared
24 a Report On Rate Design containing their recommendation on new
26 rates and submitted said report to the City Council during a
26 public hearing held on July 13, 1982; and
27 WHEREAS, said Report recommends that rates go into
28 effect on September 1, 1982, that would recover the costs

1 associated with the Step 1 increase provided for in FERC Docket
2 No. ER82-427; and
3 WHEREAS, it is recommended that a surcharge be
4 included in the recommended rates to recover the costs associated
5 with the Step 2 increase permitted by the FERC in ER82-427 at
6 the time said Step 2 rate becomes effective; and
7 WHEREAS, it is intended that said surcharge be adopted
8 by resolution; and
9 WHEREAS, the City Council of the City of Vernon held
10 a public hearing on July 13, 1982 to consider the recommendations
11 of Baker G. Clay & Associates, Inc. and the adoption of this
12 Ordinance.
13 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
14 DOES ORDAIN AS FOLLOWS:
15 SECTION 1: Purpose and Scope
16 The rates to be charged and col1ected, and the terms
17 and conditions respecting the distribution of electrical energy
18 supplied by the City of Vernon for such service from and after
19 the effective date of this Ordinance shall be as set forth
20 herein. This Ordinance may be referred to as the City of
21 Vernon's "Electrical Energy Distribution Ordinance".
22 SECTION 2: General Rates
23 Those rates, terms and conditions set forth in the
24 attached exhibits referenced and identified below, are hereby
26 incorporated by reference and made a part hereof as though
26 fully set forth at length and are hereby adopted as the City's
27 rates, terms and conditions for the distribution of the
28 electrical energy supplied by the City for certain classes of

1 shall receive service pursuant to Schedule No. SC - Special
2 Contract.
3 Further, any customer willing to reduce its demand for
4 service during peak periods may receive service pursuant to
5 Schedule No. SC - Special Contract.
6 SECTION 4: Surcharge to Rates
7 The City Council of the City of Vernon is hereby
8 authorized to adopt a resolution to provide for a surcharge to
9 the rates provided for herein to recover the costs associated
10 with a Step 2 rate 'increase authorized by the FERC in Docket
11 No. ER82-427 if said increase is put into effect by Southern
12 California Edison Company.
13 SECTION 5: Energy Cost Adjustment
14 The rates charged for the distribution of energy
15 supplied by the City for services rendered from and after the
16 effective date of this Ordinance may include an Energy Cost
17 Adjustment Billing Factor to be determined by the City Council.
18 Such changes in the Energy Cost Adjustment Billing Factor shall
19 be made from time to time by resolution of the City Council when,
20 in the City Council's opinion, such changes are necessary for
21 the sound financial operation of the Light and Power Operating
22 Funds. Any Energy Cost Adjustment Billing Factor charged,
23 pursuant to Ordinance No. 911 and any resolutions adopted
24 pursuant thereto, shall remain in full force and effect until
25 the effective date of this Ordinance.
26 SECTION 6: Other Rules and Regulations
27 The rules and regulations respecting the distribution
28 of electrical energy supplied by the City of Vernon shall be

1 those rules and regulations of Edison applicable to electrical
2 service in the City of Vernon which have been adopted by the
3 City Council and filed with the City Clerk of the City of Vernon
4 on December 27, 1961, and any amendments which have been approved
5 by resolution subsequent thereto, up to and including the date
6 of enactment of this Ordinance.
7 The City Council of the City of Vernon may from time
8 to time authorize by resolution changes in the rules and
9 regulations applicable to said electrical service provided said
10 changes are not in conflict with the rate schedules provided for
11 herein and provided said rules and regulations relate to
12 conditions of service, application and interpretation of rates,
13 and relate to other provisions set forth in this Ordinance. Any
14 rule or regulation adopted pursuant to Ordinance Nos. 74S, 806,
15 828, 863, 89S, 898, 90S, 911 and 91S or any resolution adopted
16 pursuant thereto which has not been subsequently amended or
17 rescinded, shall remain in full force and effect until amended
18 or rescinded by this Ordinance or a resolution adopted pursuant
19 to this Ordinance.
20 SECTION 7: Reference to Public utilities Commission
21 Any provisions of the rules and regulations of Edison
22 adopted by Vernon relating to the exercise of jurisdiction by
23 the Public utilities Commission of the State of California shall
24 be deemed to refer to and mean the City Council of the City of
25 Vernon.
26 SECTION 8: Other Ordinances Amended
27 Any other ordinance or portion thereof in conflict with
28 this Ordinance, is hereby repealed, excepting Ordinance Nos.

SECTION 9: Maintenance of Records
The City Clerk of the City of Vernon is hereby directed
5 to keep and maintain three (3) copies of the above-mentioned
6 rate schedules and rules and regulations applicable to electric
7 service in the City of Vernon in the office of the City Clerk of
8 the City of Vernon, and make such tariff schedules available
9 on request for examination in said office.
11 There being no newspaper printed, published or

12 circulated in the City of Vernon, the City Clerk is hereby
13 directed to certify to the passage of this Ordinance and shall
14 post the same, or cause the same to be posted, in three (3) of
15 the most public places in the City of Vernon, to wit: the
16 northwest corner of 38th Street and Santa Fe Avenue; the
17 northeast corner of Leonis Boulevard and Pacific Boulevard, and
18 on the bulletin board in the lobby of the City Hall of said
19 City, located at 4305 Santa Fe Avenue, all in the City of Vernon,
20 County of Los Angeles, state of California; that this Ordinance
21 shall be in full force and effect thirty (30) days from and
22 after the passage of the same.

4. Voltage Discount: The demand charges before adjustment
will be reduced by 3J for service delivered and metered at volt-
ages of from 2 KV to 10 KV; by 41 for service delivered and me-
tered at voltages ot from 11 KV to 50 KV; and by 51 for service
delivered and metered at voltages over 50 KV; except that when
only one transformation from a transmission voltage level is in-
volved, a customer normally entitled to a 31 discount will be
entitled to a 4J discount.

Power Factor Adjustment: The charges will be adjusted
month for the power factor as follows:
The charges will be decreased by 20 cents per kilowatt of
measured maximum demand and will be increased by 20 cents
per kilovar ot reactive demand. Hoever, 1n no case shall
the kilovars used for the adjustment be less than one-
fifth of the number of kilowatts.
The kilovars of reactive demand shall be calculated by
multiplying the kilowatts of measured maximum demand by
the ratio of the kilovar-hours to the kilowatt-hours.
Demands in kilowatts and kilovars shall be determined on
the kilovar-hour meter to prevent its reverse operation
on leading power factors.
6. Tem~orary Discontinuance of Service: Where the use of
energy is seasonal or intermittent. no adjustments will be made
for a temporary discontinuance of service. Any customer prior
to resuming service within twelve months after such service was
discontinued will be required to pay all charges which would have
been billed if the service had not been discontinued.

8. Contracts: An additional initial thre~-year facilities
contract may be required where Applicant requires new or added
serving capacity exceeding 2,000 KVA.
9. Customer's Right to Terminate: In the event the net bill
for electric service to the customer is increased during the term
of the requirements contract, provided for herein, as a result of
changes in this schedule, the customer shall have the right to
terminate the requirements contract on not less than 30-months
notice to the utility. Ssuch notice shall be given within 180
days after the effective date of such change.
10. Ener,gy Cost Adjustment: The rates above are subject to
adjustment as provided for in Part G of the Preliminary Statement.
The applicable energy cost adjustment billing factors and fuel
collection balance adjustment billing factor set forth therein
will be applied to KWHR billing under this schedule.
11. Excess Transformer Capaci~: The transformer capacity in
excess of a customer's contract demand which is either required by
the Company because of the nature of the customer's load or
requested by the customer. Excess transformer capacity shall be
billed at $1.00 per kVA per month.
12. Contract Demand: A contract demand will be established by
the Company, based on applicant's demand requirements for any
customer newly requesting service on this schedule and for any
customer of record on this schedule who requests an increase or
decrease in transformer capacity in accordance with Rule No. 120.
A contract demand arrangement is available upon request for all
customers of record on this schedule. Contract demand is based
upon the nominal kilovolt-ampere rating of the Company's serving
transformer(s) or the standard transformer size determined by the
Company as required to serve the customer's stated measurable
kilowatt demand, whichever is less and is expressed in kilowatts.
13. Minimum Demand Charge: Where no contract demand is
involved, the monthly minimum demand charge shall be computed by
multiplying the billing demand by the demand charge per kilowatt.
Where a contract demand is involved, the monthly minimum demand
charge shall be the greater of:
a. The charge as computed by multiplying the billing
demand by the demand charge per kilowatt; or
b. A facilities charge of $1.00 per kilowatt of contract
demand.

reduced by 3% for service delivered and rcetered at voltages of 2 kV
to 10 kV; by 4% for service delivered and rcetered at voltages of 11 kV
to 50 kV; and by 5% for service delivered and rcetered at voltages over
50 kV; except that when only one transforrration fran a transmission
voltage level is involved, a cus1:aIer norrrally entitled to a 3%
discount will be entitled to a 4 % discount.

5. Power Factor Adjustment: The charges will be adjusted each month
for the power factor as follows:

in any month where the maximum demand exceeds 500 KW, any kilowatts of
maximum demand in excess of the on-peak demand will not be considered in
establishing the billing demand for computing the energy charge, but will
be considered in establishing the billing demand for computing the demand
charge, by adding one-half of the amount that the maximum demand exceeds
the on-peak demand, to the on-peak demand. The on-peak demand will be the
maximum demand occurring between the hours of 6:30 a.m. and 10:30 p.m.,
Pacific Standard Time, of any day except Sundays and the following holidays:
New Years, Washington's Birthday, Memorial Day, Independence Day, Labor
Day, Thanksgiving Day, and Christmas.
8. Contracts: An initial three-year contract may be required where
applicant requires new or added serving capacity exceeding 2,000 KVA.

8. Contract Demand: A contract demand will be established by
the Company, based on applicant's demand requirements for any
customer newly requesting service on this schedule and for any
customer of record on this schedule who requests an increase of
decrease in transformer capacity in accordance with Rule No. 120.
A contract demand arrangement is available upon request for all
customers of record on this schedule. Contract demand is based
upon the nominal kilovol t-ampere rat ing of the Company's serving
transformer(s) or the standard transformer size determined by the
Company as required to serve the customer's stated measurable
kilowatt demand, whichever is less and is expressed in kilowatts.
9. Minimum Demand Charge: Where no contract demand is
involved, the monthly minimum demand charge shall be computed by
multiplying the billing demand by the demand charge per kilowatt.
Where a contract demand is involved, the monthly minimum demand
charge shall be the greater of:
a. The charge as computed by multiplying the billing demand
by the demand charge per kilowatt; or
b. A facilities charge of $1.00 per kilowatt of contract

customer shall pay to the utility in advance of reinstallation a non-
refundable amount equal to the cost of removal or modification of the prior
facilities and the estimated cost of such reinstallation. Facilities
removed or installed remain the sole property of the utility.
5. Energy Cost Adjustment: The rates above for all night service
are subject to adjustment as provided for in Part G of the Preliminary
Statement. The applicable energy cost adjustment billing factors and fuel
collection balance adjustment billing factor set forth therein will be
applied to 29 KWH per month per 1,000 lumens for incandescent lamps, to
10 KWH per month per 1,000 lumens for mercury vapor lamps, and to 4 KWH

3. Overloaded Motors: Whenever, upon test, any motor under normal
operating conditions is found to be delivering more than 115 percent of
its capacity as indicated by its nameplate rating, the Company may
disregard the nameplate rating and base its charges upon the output as
calculated from test. Any motor which is billed on a basis in excess
of its nameplate rating in accordance with this special condition shall
be tested at inervals to be determined by the Company or upon notification
by the customer of a permanent change in operating conditions.
4. Temporary Reduction of Connected Load: Where the use of energy
is seasonable or intermittent, no adjustment will be made for any
temporary reduction of connected load. Any customer resuming service
on such connected load within 12 months after it was disconnected, will
be required to pay all charges which would have been billed if the
temporary reduction of connected load had not been made.

to the nearest one-tenth (0.1) unit. A ratchet device
will be installed on the kilovar-hour meter to prevent
its reverse operation on leading power factors.
5. Temporary Discontinuance of Service: Where the use of energy is
seasonable or intermittent, no adjustments will be made for a temporary
discontinuance of service. Any customer resuming service within twelve
(12) months after such service was discontinued will be required to
pay all charges which would have been billed if service had not been
discontinued.
6. Energy Cost Adjustment: The rates above are subject to adjustment
as provided for in Part G of the Preliminary Statement. The applicable
energy adjustment billing factors and fuel collection balance adjustment
billing factor set forth therein will be applied to KWH billed under this
schedule.

SPECIAL CONDITIONS
1. Contract Demand: In case the customer desires the utility to
stand ready to supply the entire connected load of the customer's
plant, or an issolated part thereof, then such maximum load will be
estimated by the utility, based on tests and other information
available. In case the customer desires the utility to stand ready to
supply a number of kilowatts less than the maximum demand of the
entire customer's plant, or an isolated part thereof, then the
customer and the utility shall agree upon the number of kilowatts the
utility will stand ready to supply; and the customer shall, at his own
expense, furnish and install a suitable circuit breaker enclosed in a
steel box equipped with a lock, all to be approved by and under the
sole control of the utility, and adjustment and operation of said
circuit breaker to be in no way interfered with by the customer. This
circuit breaker shall be set to break the connection with the
utility's service when the customer's maximum demand exceeds the
number of kilowatts which the utility stands ready to supply, in which
case the utility will renew the connections upon due notice.
2. Contract: This schedule will apply only where the customer
will sign a service contract for at least one year.

SPECIAL CONDITIONS
1. The service establishment charge provided for herein is in
addition to the charges calculated in accordance with the applicable
schedule and may be made each time an account is established. As used
herein, establishment means each time an account is opened, including
a turn on of electric service or a change of name which requires a
meter reading.
2. In case the customer requests that electric service be
established on the day of his request or outside of regular business
hours, an additional charge of $5.00 may be made.
3. The service establishment charge is not applicable by customers
of the Company to service rendered through submeters to tenants.
