ORDINANCE NO. 930
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON PROVIDING THAT CONTIGUOUS PARCELS
OWNED BY THE s~m OWNER WHICH ARE NOT IN
CONFORMANCE WITH CURRENT STANDARDS OF MINIMUM
PARCEL SIZE SHALL BE MERGED IN ACCORDANCE
WITH ~66424.2 OF THE GOVERNMENT CODE AND
REPEALING ALL ORDINANCES AND/OR PARTS OF
ORDINANCES IN CONFLICT THEREWITH
8 WHEREAS, the City of Vernon during its long history
9 has approved the subdivision of property which was
10 conformance with legal requirements during the time that they
11 were adopted; and
12 WHEREAS, the legislature of the State of California
13 has modified and substantially altered the Subdivision Map Act;

15 WHEREAS, there exists many parcels of property in the
16 City of Vernon which do not conform to the current requirements
17 of the Subdivision Map Act; and
18 WHEREAS, many of these nonconforming parcels cannot
19 be developed in conformance with current requirements; and
20 WHEREAS, property owners have combined many of these
21 nonconforming parcels and erected buildings thereon; and
22 WHEREAS, ~66424.2 of the Government Code authorizes
23 a local agency to provide that nonconforming contiguous parcels
24 held by the same owner shal1 be merged.
25 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
26 DOES ORDAIN AS FOLLOWS:

SECTION 1
In accordance with ~66424.2 of the
28 Government Code, it is hereby provided that any contiguous
1 parcels or units of property held by the same owner which does
2 not conform to standards for minimum parcel siz~ to permit use
3 or development under a zoning, subdivision or other ordinance of
4 the City of Vernon and at least one of such contiguous parcels
5 or units is not developed with a building for which a permit has
6 been issued by the City of Vernon or which was built prior to the
7 time such permits were required by the City of Vernon, then such
8 parcels shall be merged as provided for therein.
9 SECTION 2: The Director of Community Services is
10 authorized to file for recordation with the Recorder of the County
11 of Los Angeles a notice of such merger specifying the names of the
12 record owners and particularly describing the real property,
13 provided that, at least 30 days prior to the recording of the
14 notice the owner of the parcels or units to be affected by the
15 merger, shall be advised in writing of the intention to record
16 the notice and specifying a time, date and place at which the
17 owner may present evidence to the City Council as to why such
18 notice should not be recorded.
19 SECTION 3: That in implementing ~66424.2 of the
20 Government Code, the Director of Community Services shall
21 specifically consider the parking requirements of the existing
22 property when determining whether the parcels or units conform
23 to standards for development within the City of Vernon.
24 SECTION 4: That it is the intention of the City
25 Council to implement ~66424.2 of the Government Code and that,
26 therefore, said section and related sections and subsequent
27 amendments thereto are hereby incorporated by this reference as
28 though fully set forth at length and shall be considered in

1 interpreting this Ordinance.

SECTION 5: That all ordinances or parts of ordinances
3 in conflict with this Ordinance are hereby repealed.

SECTION 6: There being no newspaper, published or
5 circulated in the City of Vernon, the City Clerk is hereby
6 directed to certify to the passage of this Ordinance and shall
7 post the same, or cause the same to be posted, in three (3) of
8 the most public places in the City of Vernon, to wit: the
9 northwest corner of 38th Street and Santa Fe Avenue; the
10 northeast corner of Leonis Boulevard and Pacific Boulevard, and
11 on the bulletin board in the lobby of the City Hall of said
12 City, located at 4305 Santa Fe Avenue, all in the City of Vernon,
13 County of Los Angeles, State of California; that this Ordinance
14 shall be in full force and effect thirty (30) days from and
15 after the passage of the same.
