ORDINANCE NO. 932
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING THE CODE OF THE CITY OF
VERNON, CALIFORNIA, 1959, BY AMENDING SECTIONS
13.6 AND 13.7 OF SAID CODE RELATING TO HEALTH
PERHITS FOR CERTAIN TYPES OF SOLID WASTE
FACILITIES AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT THEREWITH
WHEREAS, Section 25185 of the California Health and
Safety Code requires local health departments to enforce State
Hazardous Waste Statutes and Regulations within their
jurisdictions; and
WHEREAS, Sections 13.6 and 13.7 of the Code of the
City of Vernon, California, 1959, currently require health
permits for certain types of solid waste facilities (e.g., Solid
Waste Disposal Site, Solid Waste Processing Facility, Solid Waste
Transfer Station); and
1{HEREAS, the City Council of the City of Vernon desires
to amend Sections 13.6 and 13.7 of the Code of the City of Vernon
California, 1959, to implement State mandates and require
health department permits for companies that store, process or
transfer hazardous waste materials.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That the City Council of the City of Vernon
24 hereby finds and determines that the recitals contained herein-
25 above are true and correct.

SECTION 2: That Section 13.6, the definition entitled
27 "Private Rubbish Disposal Vehicle" is hereby amended to read
28 as follows:
1 "Private Waste Disposal Vehicle. Any
2 vehicle used in whole or in part to convey
3 solid, semi-solid or liquid waste to a waste
4 disposal site, transfer station or processing
5 facility from a location or locations in the
6 City. Private waste disposal vehicle shall
7 not include a vehicle operated by a company
8 in the City to convey waste from its place
9 of business to a waste disposal site, transfer
10 station or processing facility or a vehicle
11 used by a private individual to convey waste
12 from his home to a waste disposal site,
13 transfer station or processing facility, or
14 a vehicle used by a governmental agency."
15 SECTION 3: That Section 13.6, the definition entitled
16 "Rubbish Disposal Business", is hereby amended to read as follows:
17 "Waste Disposal Business. Any person
18 who engages in the business of operating one
19 or more private waste disposal vehicles."
20 SECTION 4: That Section 13.6, the definition entitled
21 "Solid Waste", is hereby amended to read as follows:
22 "Waste. All putrescible and nonputrescible
23 solid, semi-solid and liquid wastes, including
24 garbage, trash, refuse, paper, rubbish, ashes,
25 industrial wastes, hazardous wastes, infectious
26 wastes, demolition and construction wastes,
27 abandoned vehicles and parts thereof, discarded
28 home and industrial appliances, manure, vegetable

or animal wastes, and other discarded wastes."
SECTION 5: That Section 13.6, the definition entitled
"Solid Waste Disposal Site", is hereby amended to read as follows:
"Waste Disposal Site. Any site, facility
or location which is used or maintained for
the final disposal of waste."
SECTION 6: That Section 13.6, the definition entitled
"Solid Waste Processing Facility", is hereby amended to read as
follows:
"Waste Processing Facility. Any site,
facility or location which is used or maintained
for the temporary storage and re-use, recycling,
reduction, separation, treatment, recovery,
conversion or incineration of waste. Waste
processing facility shall not include a company
which is recycling waste material produced as
a result of its own manufacturing process;
provided, that such waste remains on the
premises where produced until re-used."
SECTION 7: That Section 13.6, the definition entitled
"Solid Waste Transfer Station", is hereby amended to read as
follows:
"Waste Transfer Station. Any site,
facility or location which is used or maintained
for the temporary storage of waste until
conveyed to a waste processing facility or
disposal site. Waste transfer station shall
not include a person or company in the City

that temporarily stores waste produced on
the premises; provided, such waste is stored
for less than seven (7) days."
SECTION 8: That subsections (q) , (r) , ( s) , and (t)
of Section 13.7 are hereby amended to read as follows:
"(q) Waste disposal business.
(r) Waste disposal site.
(s) Waste processing facility.
(t) Waste transfer station."
SECTION 9: That all ordinances or parts of ordinances
11 in conflict with this Ordinance are hereby repealed.

SECTION 10: There being no newspaper, published
13 or circulated in the City of Vernon, the City Clerk is hereby
14 directed to certify to the passage of this Ordinance and shall
15 post the same, or cause the same to be posted, in three (3)
16 of the most public places in the City of Vernon, to wit: the
17 northwest corner of 38th Street and Santa Fe Avenue; the
18 northeast corner of Leonis Boulevard and Pacific Boulevard, and
19 on the bulletin board in the lobby of the City Hall of said
20 City, located at 4305 Santa Fe Avenue, all in the City of Vernon,
21 County of Los Angeles, State of California; that this Ordinance
22 shall be in full force and effect thirty (30) days from and
23 after the passage of the same.
