ORDINANCE NO. 942
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING THE CODE OF THE CITY OF
VERNON, CALIFORNIA 1959 BY AJ,illNDING SECTIONS
25.1, 25.2, 25.3, 25.5, 25.46 25.48 AND 25.51
OF SAID CODE ESTABLISHING THE RATES FOR THE
SALE OF WATER IN SAID CITY TO BE SET BY
RESOLUTION AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT THEREWITH,
SPECIFICALLY ORDINANCE NO. 933
WHEREAS, the Director of Water has recommended by
letter dated December 1, 1983, that the rates established for
water services be increased to reflect the increased cost of
providing said services and that the Code of the City of
Vernon, California 1959 be amended to allow water rates to be
adjusted from time to time by resolution in order to adjust
water rates in a more timely fashion; and
WHEREAS, the City Council of the City of Vernon adopted
Ordinance No. 933 on December 21, 1982; and
WHEREAS, pursuant to Resolution No. 4814 and Ordinance
No. 914 the City Council of the City of Vernon established a
special district which is referred to as the "Special C!1D
District" and established fees, charges and surcharges for
services provided for therein; and
WHEREAS, the area serviced by the City of Vernon which
is outside of the Special CMD District shall be entitled
24 "Vernon 1" and the area serviced by the City of Vernon within

the Special CMD District shall be entitled "Vernon 2"; and
WHEREAS, the City Council of the City of Vernon wi~hes
to establish that the fees, charges and surcharges on servic~s

provided for in said Special CMD District (Vernon 2) as well ~s
1 the rest of the service area within the City of Vernon (Vernon 1)
2 be set by resolution; and
3 WHEREAS, the City Council of the City of Vernon finds
4 it necessary to amend Sections 25.1, 25.2, 25.3, 25.5, 25.46,
5 25.48 and 25.51 of the Code of the City of Vernon, California
6 1959 in accordance with the recommendation of the Director of
7 Water.
8 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
9 OF THE CITY OF VERNON AS FOLLOWS:

SECTION 1: That the City Council of the City of Vernon
11 hereby finds and determines that the recitals contained herein-
12 above are true and correct.

SECTION 2: That Section 25.1 of said Code is hereby
14 amended to read as follows:

Sec. 25.1. Monthly Rates Established.
16 The rates to be charged by the water department
17 for the sale of water from its municipal water plant for
18 domestic, commercial, industrial, fire protection purposes, and
19 standby service to be due and payable to the City monthly,
20 shall be set by resolution.

SECTION 3: That Section 25.2 of said Code is hereby
22 amended to read as follows:

Sec. 25.2. Monthly Minimum Charge With Zero
Consumption-For Consumers Generally.
The monthly minimum charge to be charged to
consumers of water from the municipal plant shall be set by
resolution.
The charge for water in excess of the monthly
minimum charge shall be the minimum charge plus the rates

1 to be set in accordance with Section 25.1. Any portion of a
2 month shall be considered a full month.
3 SECTION 4: That Section 25.3 of said Code is hereby
4 amended to read as follows:
5 Sec. 25.3. Same-For Standby Service.
6 The monthly consumption allowance and the minimum
7 monthly charge for standby service to be charged to consumers
8 of water from the municipal plant shall be set by resolution.
9 The charge for water in excess of the monthlv
10 consumption allowance shall be the minimum charge plus the
11 rates to be set in accordance with Section 25.1. Any portion
12 of a month shall be considered a full month.
13 SECTION 5: That Section 25.5 of said Code is hereby
14 amended to read as follows:
15 Sec. 25.5. Minimum Rates For Fire Protection Purposes.
16 The rates to be established, which shall be
17 considered the minimum rate for connections to the water system
18 of the City for fire protection purposes, shall be set by
19 resolution.
20 The charge for all water used shall be at the
21 rate to be set in accordance with Section 25.1 and shall be
22 payable semi-annually. Any portion of a month shall be
23 considered a full month.
24 SECTION 6: That Section 25.46 of said Code is hereby
25 amended to read as follows:
26 Sec. 25.46. Monthly Water Rates Established.
27 The rates to be charged by the water department
28 for the sale of water in the Special CMD District from its

1 public works system for domestic, commercial, industrial, fire
2 protection purposes, and standby service to be due and payable
3 to the City's Special CMD District Fund monthly, shall be set
4 by resolution.

SECTION 7: That Section 25.48 of said Code is hereby
6 amended to read as follows:

Sec. 25.48. Minimum Rates For Fire Protection Purposes
In Special CMD District.
9 The rates to be established, which shall be
10 considered the minimum rate for connections to the water system
11 of the City for fire protection services, shall be set by
12 resolution.
13 The charge for all water used shall be at the
14 rates to be set in accordance with Section 25.46 and shall be
15 payable semi-annually. Any portion of a month shall be
16 considered a full month.

SECTION 8: That Section 25.51 of said Code is hereby
18 amended to read as follows:

Sec. 25.51. Monthly Standby Service Charge.
20 The monthly consumption allowance and the minimum
21 monthly charge for standby service to be charged to consumers of
22 water in the Special CMD District from the public works system
23 shall be set by resolution.
24 The charge for water in excess of the monthly
25 consumption allowance shall be the minimum charge plus the rates
26 to be set in accordance with Section 25.46. Any portion of a
27 month shall be considered a full month.

SECTION 9: That any ordinance or parts of ordinances

in conflict with this Ordinance are hereby repealed.
SECTION 10: If any section, subsection, sentence,
clause, phrase or word of this Ordinance is for any reason held to
be void or unconstitutional, such decision shall not affect the
validity of the remaining portions of this Ordinance; it being the
intention of the City Council of the City of Vernon to adopt and
pass this Ordinance and each section, subsection, sentence, clause
or phrase thereof irrespective of the fact that one or more of the
sections, subsections, clauses, sentences or phrases thereof may

be declared void or or unconstitutional.

SECTION 11: There being no newspaper printed, published
13 or circulated in the City of Vernon, the City Clerk is hereby
14 directed to certify to the passage of this Ordinance and shall
15 post the same, or cause the same to be posted, in three (3) of the
16 most public places in the City of Vernon, to wit: the northwest
17 corner of 38th Street and Santa Fe Avenue, the northeast corner of
18 Leonis Boulevard and Pacific Boulevard, and on the bulletin board
19 in the lobby of the City Hall of said City, located at 4305 Santa
20 Fe Avenue, all in the City of Vernon, County of Los Angeles, State
21 of California; that this Ordinance shall be in full force and
22 effect thirty (30) days from and after the passage of the same.
