ORDINANCE NO. 947
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING ORDINANCE NO. 941 TO
ESTABLISH SAID ORDINANCE AS AN URGENCY ORDINANCE
AMENDING SECTION 20.12 OF THE CODE OF THE CITY
OF VERNON, CALIFORNIA 1959 IMPOSING A SALES
AND USE TAX TO BE ADMINISTERED BY THE STATE
BOARD OF EQUALIZATION AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
THEREWITH
WHEREAS, the City Council of the City of Vernon adopted
Ordinance No. 941 on December 6, 1983 in accordance with Section
36937 of the Government Code; and
WHEREAS, Section 36937(d) provides that an ordinance
takes effect immediately after its final passage if it is an
ordinance relating to taxes for the usual and current expenses
of the city; and
WHEREAS, said Ordinance failed to provide that there
is an urgency in adopting this Ordinance in accordance with
Section 36934 of the Government Code; and
WHEREAS, the City Council of the City of Vernon wishes
to amend Ordinance No. 941 to provide that in accordance with
Sections 36934 and 36937(d) of the Government Code of the State
of California there is an urgency in adopting this Ordinance
for the immediate preservation of the public peace, health,
safety, comfort, convenience and general welfare of the City
of Vernon and its inhabitants based upon the following facts:
The deletion of the exemption for operators of
waterborne vessels in accordance with 1979 changes to the
Bradley-Burns Uniform Local Sales and Use Tax law will be
applicable on January 1, 1984 and the exemption provided for in

accordance with Section 20.12 of the Code of the City of Vernon,
California 1959 will no longer be valid; therefore, it is
necessary that this Ordinance take effect immediately in order
to collect the tax to meet the usual and current expenses
required to provide the services not only required by law but
necessary for the immediate preservation of the public peace,
health and safety of the city; and
WHEREAS, in accordance with Sections 36934 and 36937(d)
of the Government Code of the State of California there is an
urgency in adopting this Ordinance for the immediate
preservation of the public peace, health, safety, comfort,
convenience and general welfare of the City of Vernon and its
inhabitants based upon the facts set forth above.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
DOES ORDAIN AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECTION 2: The City Council of the City of Vernon
hereby amends Ordinance No. 941 by declaring that there exists
an urgency in adopting Ordinance No. 941 and finds and
determines that in order to collect the necessary taxes to meet
the usual current expenses required to provide services within
the City of Vernon in accordance with State law it is necessary
that Ordinance No. 941 be effective December 6, 1983 upon the
approval of a majority of the City Council of the City of Vernon
and thenceforth the same shall be in full force and effect.

1 SECTION 3: The City Council of the City of Vernon
2 hereby declares that there exists an urgency in adopting
3 Ordinance No. 947 and finds and determines that in order to
4 collect the necessary taxes to meet the usual current expenses
5 required to provide services within the City of Vernon in
6 accordance with State law it is necessary that this Ordinance
7 be effective immediately upon the approval of a four-fifths
8 majority of the City Council of the City of Vernon and thence-
9 forth the same shall be in full force and effect.
10 SECTION 4: That any ordinance or parts of ordinances
II in conflict with this Ordinance are hereby repealed.
12 SECTION 5: If any section, subsection, sentence,
13 clause, or phrase or word of this Ordinance is for any reason
14 held to be void or unconstitutional, such decision shall not
15 affect the validity of the remaining portions of this Ordinance;
16 it being the intention of the City Council of the City of Vernon
17 to adopt and pass this Ordinance and each section, subsection,
18 sentence, clause or phrase thereof irrespective of the fact
19 that one or more of the sections, subsections, clauses, sentences
20 or phrases thereof may be declared void or unconstitutional.
21 SECTION 6: There being no newspaper printed, published
22 or circulated in the City of Vernon, the City Clerk is hereby
23 directed to certify to the passage of this Ordinance and shall
24 post the same, or cause the same to be posted, in three (3)
25 of the most public places in the City of Vernon, to wit: the
26 northwest corner of 38th Street and Santa Fe Avenue; the
27 northeast corner of Leonis Boulevard and Pacific Boulevard, and
28 on the bulletin board in the lobby of the City Hall of said

I City, located at 4305 Santa Fe Avenue, all in the City of Vernon,
2 County of Los Angeles, State of California.

SECTION 7: The City Clerk is hereby directed to
4 forward four (4) certified copies of this Ordinance to the State
5 Board of Equalization.
6 APPROVED AND ADOPTED this 3rd day of January, 1984.
