ORDINANCE NO. 949
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
3 OF VERNON M1ENDING THE CODE OF THE CITY OF
VERNON, CALIFORNIA 1959 BY ADDING NEW CHAPTER
4 6A REGULATING MOBILE CHECK CASHING SERVICES,
PROVIDING FOR THE ISSUANCE OF PERMITS AND
5 COLLECTION OF FEES THEREFOR, AND PROVIDING
FOR PENALTIES FOR THE VIOLATION OF ANY
6 PROVISION OF THIS ORDINANCE
7 WHEREAS, Bruce V. Malkenhorst, City Administrator/City
8 Clerk has recommended the establishment of rules, regulations
9 and fees respecting mobile check cashing services in the City of
10 Vernon to the Finance Committee; and
11 WHEREAS, the Finance Committee on October 15, 1984,
12 approved said recommendation.
13 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
14 THE CITY OF VERNON AS FOLLOWS:
SECTION 1: That Chapter 6A is hereby added to the

16 Code of the City of Vernon, California 1959 and shall read as
17 follows:

19 MOBILE CHECK CASHING SERVICES

Sec. 6A.l. Permit required; permit to be posted.
21 It shall be unlawful for any person to conduct or
22 assist in conducting any mobile check cashing service within the
23 City of Vernon unless under and by authority of a written permit
24 of the City Council, and no permit issued under this chapter
25 shall be transferable except with the consent of the Ci ty Council.
26 Such permit so issued shall be posted in a con-
27 spicuous place in or on the establishment or vehicle for which
28 it is issued.
1 Sec. 6A.2. Application for permit.
2 A permit to conduct mobile check cashing services wil
3 be issued by the City Council only upon written application.
4 Each written application for a permit shall be presented to the
5 City Council and shall set forth the following facts:
6 (a) The name and residence of the applicant or
7 applicants, and, if the applicant be a firm, the names and
8 residences of the partners thereof; if the applicant be an
9 association, the names and residences of the officers thereof;
10 and if the applicant be a corporation, the names and residences
11 of the officers and directors thereof; and
12 (b) Any other further information as the City Clerk
13 may require. Each applicant for a permit shall pay to the City
14 Clerk a fee as established by Section 6A.4 at the time of making
15 such application.
16 Sec. 6A.3. Prerequisites to issuance of a permit.
17 The City Council, before issuing any permit required
18 by this chapter, will first satisfy itself of the character, rep
19 utation and moral fitness of those who will be in charge of it,
20 or other facts of evidence tending to enlighten the Council in
21 this respect.
22 In addition, before any permit may be issued for
23 mobile check cashing services within the City, it must appear:
24 (a) That there is a minimum liability insurance of
25 One Million Dollars ($1,000,000), naming the City of Vernon as
26 additional insured.
27 (b) That the applicant possesses a Special Vehicle
28 Identification/Permit issued by the California Highway Patrol an

that a copy of said permit be filed with the Vernon Police
Department.
(c) If an operator intends to carry a weapon in his
mobile check cashing vehicle, he must provide written noti-
fication to the Vernon Police Department of such intent.
Sec. 6A.4. Permit fees.
A fee of One Hundred and Fifty Dollars ($150) per
year shall be charged and collected for permits under the
provisions of this chapter.
Sec. 6A.5. Compliance with state laws.
No permit shall be granted by the City Council unless
the applicant has complied with all laws of the state regarding
mobile check cashing services.
Sec. 6A.6. Revocation or suspension of permit.
When the City Council shall issue any permit under th
terms of this chapter, the same may be revoked at any time there
after by the Council if the Council becomes satisfied that the
conduct of such mobile check cashing service does not, or will
not, comport with the public welfare for any reason or that same
has been conducted in an illegal, improper, or disorderly manner.
The City Council may make rules governing such mobile check cash
ing services not in conflict with the laws of the state, and may
revoke or suspend permits issued under this chapter where the
proprietor or persons in charge thereof violate, or permit any
infraction of, any law of the united States, the state, this Cod
or any ordinance of the City; provided, however, that no permit
issued hereunder shall be revoked or suspended under the terms of
this chapter unless a hearing and notice thereof be first given

the permittee; provided, however, that such permit mav be tempo-
rarily suspended without such notice of hearing by the City
Council.
Sec. 6A.7. Inspection by police; right of entry
of police.
It shall be the duty of the Chief of Police and
6 police officers of the City, in addition to their several duties,
7 to inspect any and all places where mobile check cashing service
8 set forth in this chapter are held, and they shall be permitted
9 to enter any place where such mobile check cashing services are
10 held for the purpose of inspection.

Sec. 6A.8. Operating requirements.
(a) Mobile check cashing services shall be operated
13 Monday through Friday from 8:00 a.m. until 5:00 p.m.

(b) The Vernon Police Department shall be notified
15 of all locations where stops will be made, and the day or days
16 and approximate time of each stop.

(c) All stops shall be limited to thirty (30)
18 minutes.

(d) No stop is to be made in a public right-of-way
20 and the operator must be in possession of written authorization
21 to park (stop) on any private property.

Sec. 6A.9. Violation.
23 Any mobile check cashing service who operates said
24 service without first obtaining a permit as required by this
25 Chapter, or who, after having a permit revoked or suspended and
26 after exhausting his rights to hearing, continues to provide sai
27 services in said City, shall be in violation of this chapter.

1 Sec. 6A.IO. Penalties for violation.
2 Any person violating any of the provisions of this
3 chapter shall be guilty of a misdemeanor and upon conviction
4 thereof shall be punishable by a fine of not more than Five
5 Hundred Dollars ($500) or by imprisonment in the county jail for
6 a period of not more than six (6) months, or by both such fine
7 and imprisonment.
8 Sec. 6A.ll. Fraudulent, etc. statements in application.
9 No person shall make any false, misleading or
10 fraudulent statement or misrepresent any facts in any applicatio
11 for a mobile check cashing permit required to be filed with the
12 City Clerk. In addition to any other penalties provided for by
13 this chapter, such conduct shall be grounds for suspending or
14 revoking any permit issued to such person.
15 Sec. 6A.12. Permit renewal.
16 Permits issued under this chapter shall expire on
17 December 31 of the year for which it is issued and each such
18 permit shall be renewed annually. Application for the renewal
19 shall be made in the same manner as application for the initial
20 permit. At the time the application is made, there shall be pai
21 to the City Clerk the annual fee as set forth in Section 6A.4.
22 Annual permits are due and payable January 1 of each year. The
23 annual fee, if unpaid, is delinquent on January 31 at 4:30 p.rn.
24 following the date it is due and thereafter a penalty shall be
25 imposed in the manner prescribed in Section 6A.13.
26 Sec. 6A.13. Penalty for delinquent payment of fees.
27 After receiving written notification from the City
28 Clerk, any person who fails for a period of thirty (30) days to

1 file an application and obtain a permit required by this chapter
2 shall incur a penalty equal to twenty-five percent (25%) of the
3 fee and for each additional month or fraction of a month after
4 the expiration of the thirty (30) day period that the applicant
5 fails to file such application and obtain such permit, there
6 shall be added an additional penalty equal to twenty-five percen
7 (25%) of the fee. The imposition or payment of the penalty
8 imposed by this section shall not prevent the imposition of any
9 other penalty prescribed by any local ordinance or a criminal
10 prosecution for violation of this chapter.
II Sec. 6A.14. Rules and regulations.
12 The City Clerk is hereby authorized to adopt
13 reasonable rules and regulations governing mobile check cashing
14 services. Such rules and regulations shall be effective only
15 after approval by the City Council by its minute order. Upon
16 approval, such rules and regulations shall have the same force
17 and effect as other provisions of this chapter.
18 Section 2: If any section, subsection, sentence,
19 clause, phrase or word of this Ordinance is for any reason held
20 to be void or unconstitutional, such decision shall not affect

25 one or more of the sections, subsections, clauses, sentences,
26 nhrases thereof may be declared void or unconstitutional.
27 SECTION 3: That any ordinance or parts of ordinances
28 in conflict with this Ordinance are hereby repealed.

the validity of the remaining portions of this Ordinance; it
being the intention of the City Council of the City of Vernon to
adopt and pass this Ordinance and each section, subsection,
sentence, clause or phrase thereof irrespective of the fact that

SECTION 4: There being no newspaper printed,
2 published or circulated in the City of Vernon, the City Clerk is
3 hereby directed to certify to the passage of this Ordinance and
4 shall post the same, or cause the same to be posted, in three
5 (3) of the most public places in the City of Vernon, to wit: th
6 northwest corner of 38th Street and Santa Fe Avenue, the north-
7 east corner of Leonis Boulevard and Pacific Boulevard and on the
8 bulletin board in the lobby of the City Hall of said City,
9 located at 4305 Santa Fe Avenue, all in the City of Vernon,
10 County of Los Angeles, State of California; that this Ordinance
II shall be in full force and effect thirty (30) days from and afte
12 the passage of the same.
