ORDINANCE NO. 951
AN INTERIM ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF VERNON PROHIBITING THE USE OF
PROPERTY WITHIN THE CITY WHOSE PRINCIPAL
PURPOSE WOULD BE FOR WAREHOUSE, TRUCK TERMINAL
AND DISTRIBUTION FACILITY USES AND
ESTABLISHING A MORATORIUM ON THE ISSUANCE OF
BUILDING PEID1ITS FOR BUILDINGS OR FACILITIES
TO BE CONSTRUCTED AND lOR OCCUPANCY PERMITS
OR ANY OTHER PERMIT REQUIRED BY THE PROVISIONS
OF THE VERNON CODE WHOSE PRINCIPAL PURPOSE
WOULD BE WAREHOUSE, TRUCK TERMINAL AND
DISTRIBUTION FACILITY USES, MAKING FINDINGS
WITH RESPECT THERETO, DECLARING THE URGENCY
THEREOF, AND THAT IT WILL TAKE IMMEDIATE
EFFECT
11 WHEREAS, the City Council of the City of Vernon
12 established the General Plan on November 18, 1975 and adopted
13 Zoning Ordinance No. 856 on July 1, 1975; and
14 WHEREAS, substantial changes have occurred in the City
15 since the adoption of said General Plan and Zonin0 Ordinance;
16 and
17 WHEREAS, it appears that there has been a substantial
18 shift from manufacturing to warehouse, truck terminal and
19 distribution facility uses; and
20 WHEREAS, the City Council of the City of Vernon intends
21 to study the effects of said shifts of land uses and intends to
22 declare a moratorium while studying said land use purposes; and
23 WHEREAS, California Government Code ~65858 authorizes
24 the adoption as an urgency measure an interim ordinance pro-
25 hibiting any uses which may be in conflict with a contemplated
26 zoning proposal which the legislative body, Planning Commission,
27 or the Planning Department is considering or studying or
28 intends to study within a reasonable time.
1 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: Intent and Purpose.
4 It is recognized that the shift of land uses from
5 manufacturing to warehouses, truck terminals and distribution
6 facilities creates different demands upon the services provided
7 by the City and presents detrimental impacts upon the general
8 health, safety and welfare of the citizens residing in or
9 working within the City of Vernon. Special regulation of the
10 uses of property for warehouse, truck terminal and distribution
11 facility purposes is necessary to insure that the danger to the
12 public safety, health and welfare is mitigated by the implemen-
13 tation of proper zoning controls which may include, amonq other
14 things, the utilization of conditional use permits. Defined
15 uses subject to this interim ordinance include buildings or
16 other facilities whose principal purpose would be warehouse,
17 truck terminal or distribution facility uses.
18 SECTION 2: Prohibition.
19 No person shall cause or permit the establishment in
20 the City of Vernon of a defined use listed in Section 1 hereof.
21 SECTION 3: Violation.
22 Violation of this Ordinance is punishable by a fine of
23 not more than Five Hundred Dollars ($500), or by imprisonment
24 in the County Jail for a period of not more than six (6) months,
25 or by both such fine and imprisonment. Each day during any
26 portion of which any violation of any provision of this Ordinance
27 is committed, continued or permitted, constitutes a separate and
28 individual offense.

1 SECTION 4: Definitions.
2 For the purpose of this Ordinance, the prohibited uses
3 as listed in Section 1 hereof are defined as warehouse, truck
4 terminal or distribution facility uses of any type where the
5 principal utilization of the property or building is for
6 warehouse, truck terminal or distribution facility purposes.
7 These uses are further defined for all pruposes herein as Major
8 Group 42, Motor Freight Transportation and Warehousing, as
9 established in the standard industrial classification manual.
10 SECTION 5: Severability.
11 If any provision or clause of this Ordinance or the
12 application thereof to any person or circumstance is held
13 invalid, such invalidity shall not affect other provisions or
14 applications of the ordinance which can be effected without the
15 invalid provision or application, and to this end, the
16 provisions of this Ordinance are declared to be severable.
17 SECTION 6: Declaration of Urgency.
18 This interim Ordinance is in contemplation of an
19 amendment to the Vernon Municipal Code, Appendix IV, Zoning
20 Ordinance, and the City Council of the City of Vernon finds that
21 the prohibition of the establishment of the defined uses listed
22 herein is urgently required to protect the public safety, health
23 and welfare, and that, absent such an interim ordinance, there
24 would be an immediate threat to the public health, safety, or
25 welfare and that the ordinance is further necessary to preserve
26 and protect the present and future character of property, for
27 the orderly study of applicable zoning alternatives and uses,
28 and in order to permit the preparation and implementation of

1 proper and necessary zoning amendments and controls.
2 The City Council finds that further facts constituting
3 urgency are as follows:
4 A. That the City of Vernon currently has no authorized
5 zone which srecifically authorizes the construction of buildings
6 or the utilization of buildings or property for warehouse, truck
7 terminal or distribution facility uses.
8 B. That the City of Vernon has no established
9 regulations or controls with respect to buildings or property
10 principally used for warehouse, truck terminal or distribution
11 facility purposes; what parking requirements, if any, should be
12 imposed upon a business engaging in the storage or warehousing
13 of commodities or products, or the maintenance and repair of
14 trucks and related activities of a truck terminal; what type
15 of planning fee should be instituted and whether or not
16 conditional use permits should be employed to effect necessary
17 and valid controls.
18 C. That there is, based upon the evidence presented
19 to the City Council, a current and immediate threat to the
20 public health, safety and welfare, and that the approval of
21 additional subdivisions, rezonings, land use permits, variances,
22 building permits or any other applicable entitlement for use
23 which is required in order to comply with the City of Vernon's
24 current zoning ordinance, if applied to warehouse, truck
25 terminal and distribution facility uses, would result in a
26 current and imminent threat to the public health, safety or
27 welfare.
28 SECTION 7: The City Council of the City of Vernon

hereby instructs the City Engineer and the Director of
Community Services not to issue any building permits for new
buildings or occupancy permits which would change the use of
existing buildings to a building whose primary purpose would
be for warehouse, truck terminal or distribution facility use
and that the Director of Community Services is hereby instructed
to perform a study on the changes occurring within the City from
manufacturing to warehouses, truck terminals and distribution
facilities, and that said study should be submitted to the
Finance Committee for consideration prior to being submitted to
the City Council.
SECTION 8: That any ordinance, or parts of ordinances,
resolutions, or parts of resolutions, specifically Resolution
No. 5161, that are in conflict with this Ordinance, are hereby
repealed.
SECTION 9: There being no newspaper printed, published
or circulated in the City of Vernon, the City Clerk is hereby
directed to certify to the passage of this Ordinance and shall
post the same, or cause the same to be posted, in three (3) of
the most public places in the City of Vernon, to wit: the north-
west corner of 38th Street and Santa Fe Avenue, the northeast
corner of Leonis Boulevard and Pacific Boulevard and on the
bulletin board in the lobby of the City Hall of said City,
located at 4305 Santa Fe Avenue, all in the City of Vernon,
County of Los Angeles, State of California.
SECTION 10: This Ordinance shall take effect
immediately upon its passage.

SECTION 11: This Ordinance shall be in effect for a
2 period of time not to exceed that specified in Government Code
3 ~65858.
