Ordinance No. 954 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20' 21 22 23 24 25 26 27 28 ORDINANCE NO. 954 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON REPEALING ORDINANCE NO. 936 AND PROVIDING FOR SALARY AND EXPENSE ALLOWANCE FOR MEMBERS OF THE CITY COUNCIL OF THE CITY OF VERNON AND DECLARING THE URGENCY THEREOF, TO TAKE EFFECT IMMEDIATELY WHEREAS, Ordinance No. 936 was enacted on August 2, 1983, which provided that each member of the City Council was to receive a salary of Two Hundred Twenty-One Dollars and Sixty-Two Cents ($221.62) per month; and WHEREAS, S365l6 of the Government Code of the State of California provides for the salaries for the members of the City Council; and WHEREAS, S365l6(c) of the Government Code of the State of California provides that increases in salaries for the members of the City Council shall not exceed five percent (5%) for each calendar year; and WHEREAS, pursuant to S365l6.6 of the Government Code, a city council, one or more members of which were elected or re- elected to a term of office which commenced on or after January 1, 1984, may, by an ordinance adopted by the council which becomes effective on or prior to December 31, 1986, increase the salaries of all council members in accordance with the schedule prescribed in S365l6 of the Government Code: and WHEREAS, the City of Vernon is a city with fewer than 35,000 people in population and, pursuant to S365l6(a) (1) of the Government Code, as modified by S365l6(c) of the Government Code, may establish a salary by ordinance up to and including Three Hundred Thirty Dollars and Seventy-Five Cents ($330.75); 1 and 2 WHEREAS, S365l4.5 of the Government Code of the State 3 of California provides that members of the City Council may be 4 reimbursed for actual and necessary expenses incurred in the 5 performance of official duties; and 6 WHEREAS, the actual and necessary expenses incurred by 7 councilmen for the City of Vernon in the performance of their 8 official duties is at least equivalent to, if not greater than, 9 Two Hundred Twenty-Five Dollars and No Cents ($225.00) per month; 10 and 11 WHEREAS, there is an urgency in adopting this ordinance 12 for the immediate preservation of the public peace, health, 13 safety, comfort, convenience and general welfare of the City of 14 Vernon and its inhabitants. 15 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON 16 DOES ORDAIN AS FOLLOWS: 17 SECTION 1: That the City Council of the City of Vernon 18 does hereby determine and order that each member of the City 19 Council of the City of Vernon shall receive a salary of Three 20' Hundred Thirty Dollars and Seventy-Five Cents ($330.75) per 21 month for their duties as members of the City Council. 22 SECTION 2: That the City Council of the City of Vernon 23 does hereby find and determine that the actual and necessary 24 expenses incurred by the City Councilmen for the City of Vernon 25 in the performance of their official duties is at least equal to, 26 if not greater than, Two Hundred Twenty-Five Dollars and No Cents 27 ($225.00) per month and orders that each member of the City 28 Council of the City of Vernon shall receive a monthly expense -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20' 21 22 23 24 25 26 27 28 allowance of Two Hundred Twenty-Five Dollars and No Cents ($225.00) per month as reimbursement for actual and necessary expenses incurred in their duties as members of the City Council. SECTION 3: This ordinance is hereby declared to be urgently required for the immediate preservation of the public peace, health, safety, comfort, convenience and general welfare of the City of Vernon and its inhabitants, and shall take effect immediately upon its adoption. The following is a statement of the facts necessitating the urgency: (a) In order that the City of Vernon may implement the salary increases for city council members authorized by Chapter 100 of the Statutes of 1984, prior to councilmanic elections in 1986. SECTION 4: Ordinance No. 936 and all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: There being no newspaper printed, published and circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this ordinance and shall post the same or cause the same to be posted in three (3) of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of said City located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California.
