Ordinance No. 963 Document Not Found INITIATIVE ORDINANCE NO. 963 AN ORDINANCE OF THE CITY OF VERNON RELATING TO SALARIES AND COMPENSATION OF CERTAIN APPOINTED OFFICERS AND EMPLOYEES OF THE CITY OF VERNON THE PEOPLE OF THE CITY OF VERNON DO ORDAIN AS FOLLOWS: Section 1. The Gann Fair Pay Amendment has qualified for placement on the ballot for the November 4, 1986 general election and may be adopted in that election. The proposed amendment would, among other provisions, add Section 26 to Article XX of the California Constitution, and place rigid limits on the salary and compensation of appointed officers and employees of cities, subject to the right of the electorate of any city to adjust the compensation- of its city officers and employees to exceed the proposed limitations. The salary and compensation of certain appointed officers and employees of the City of Vernon exceed the limits proposed by said proposed amendment. The arbitrary reduction in compensation of such officers and employees of the City of Vernon would be disruptive of the city government and destructive of the quality of service provided by such officers and employees. The People of the City of Vernon deem it necessary for the public health, safety and welfare of the City of Vernon, its citizens and employees of businesses located in the City and for the protection of property, to maintain the salary and compensation of those appointed officers and employees who are currently or may in the future be paid in excess of the / limitation contained in the Amendment. ,'. ...... .".:.:1 ........... ~. It lS hereby declared to be the policy 0: the City of Vernon to attract and retain highly qualified persons to serve as of:icers and employees for the City's paid public positions, and to compensate its appointed officers and employees in an adequate amount, commensurate with their training, duties, responsibilities, experience, skill, performance, previous compensation, and education, a:ter considering increases in the cost of living as determined by the Department of Labor, the salary and compensation level of positions of equal responsibility in public and priva~e employment, and the unique working and living condi~ions in the City. Section 3. The current salary structure, including current salary ranges, placement of individuals within the salary ranges, and current procedures and mechanisms for initially placing and advancing individuals in the salary ranges as currently existing and implemented in the rules, regulations, and practices of the City of Vernon, are hereby adopted in their entirety as mo=e :u::y se~ :o~~h in Sala~y Resolu~ion No. 5294: / / Section 4. The current fringe-benefits, including but not limited to, contributions to pension and retirement -2- fl50610 j I w 0250TRT :i. .I ',I benefits, health and welfare benefits, education incentives, . , , ! holidays, sick leave, and vacation, and current procedures and ! mechanisms for increasing those fringe benefits, as currently existing and implemented in the rules, regulations and practices of the City of Vernon, are hereby adopted in their entirety for said positions specified in said salary resolution. Section S. The future increases in salary and compensation which are currently provided for in the rules, regulations and practices of the City of Vernon, and the procedures and mechanisms for implementing those increases are hereby adopted in their entirety for said positions. Section 6. The City Council (or City Administrator, as appropriate) shall determine the initial placement in the salary range of an appointed officer or employee who is first employed by the City of Vernon in one of said positions after the effective date of this Or,dinance, based upon the skill, knowledge, experience, education, prior salary, and other relevant factors in the discretion of the assigning authority. Section 7. The City Council (or City Administrator, as appropriate) may, annually, advance an appointed officer or employee within the salary range for his/her position, based upon the official's or employee's duties, responsibilities, performance, increased education or skill, seniority, experience, increases in the annua~ cost of living as deter- / /. mined by the United States Department of Labor, and prevailing -3- ~10 jlw 0250TRT 3 wages of comparable positions in public and private employment, and the unique quality of the individual's services. The advancement of an individual within the salary range is subject to Section 10. Section 8. The City Council may annually adjust the salary ranges governed by this Ordinance, and to increase the minimum and maximum salaries specified in any such range, after considering increases in the annual cost of living as deter- mined by the United States Department of Labor and the prevail- ing wages of comparable positions in public and private employ- ment. The percentage increase of any salary adjustment to a salary range shall be between 0% and 200% of the annual percen- tage increase in the cost of living for the year immediately preceding the effective date of such annual adjustment. Section 9. The City Council (or City Administrator, as appropriate) is hereby authorized to add to or increase the fringe benefits, including but not limited to, contributions to pension and retirement benefits, health and welfare benefits, education incentives, holidays, sick leave, and vacation leave, of said positions, based upon seniority, experience, duties, responsibilities, annual increases in the cost of living as determined by the Department of Labor, and the fringe benefits of comparable positions in public and private employment in the/ State of California. The percentage increase in the total annual salary and compensation payable to an individual in any of said positions shall be between 0% and 200% of the total percentage of the annual increase in the cost of living as determined by the Department of Labor for the immediately preceding year. Section 11. The City Council is authorized to annually decrease the salary ranges, fringe benefits, and total salary and compensation of any of said positions, after considering any decrease in the annual cost of living as determined by the Department of Labor, salaries and compensation of comparable positions in public and private employment in the State of California. Any annual decrease in the salary ranges, fringe benefits, and total salary and compensation of said positions shall be between 0% and 200% of the decrease in the annual cost of living. Section 12. The City Council is authorized to allow the accumulation, from one calendar year to another, of vacation and sick leave accrued by said positions. Section l3. The City Council is authorized to establish the salary range and fringe benefits of any positions which it might hereafter create and which it makes subject to this -Ordinance. The City Council is authorized and empowered to take such steps as may be necessary or appropriate to carry out the policies herein provided and to implement and effect the provisions of this Ordinance, including but not limited to, the adoption of all necessary ordinances, resolutions, rules, regulations, and policies. Section 15. If, at said general election to be held on November 4, 1986, the Gann Fair Pay Amendment is adopted, then this Ordinance shall go into effect immediately upon such adoption. Section 16. If at said general election to be held on November 4, 1986, the Gann Fair Pay Amendment is not adopted, then this Ordinance shall not be of any force or effect. Section l7. This Ordinance may be amended by the City Council provided that no such amendment shall be made which would defeat its purpose to satisfy the requirements of the Gann Fair Pay Amendment. / / / " -6- 860610 jlw 0250TRT 3
