AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING THE CODE OF THE CITY OF
VERNON, CALIFORNIA 1959 BY AMENDING SUBSECTION
Cd) TO SECTION 4A.5, REPEALING SECTION 4A.15,
AND AMENDING SECTIONS 4A.16 AND 4A.18 OF
CHAPTER 4A OF SAID CODE RELATING TO EMERGENCY
BURGLAR AND ALARM SYSTEMS AND REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT THEREWITH

WHEREAS, the City Council of the City of Vernon finds
7
it necessary to amend Sections 4A.16 and 4A.18 and subsection Cd)
8
to Section 4A.5 and to repeal Section 4A.15 of Chapter 4A of the
Code of the City of Vernon, California 1959 relating to emergency
burglar and alarm systems.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VERNON
DOES ORDAIN AS FOLLOWS:

The City Council of the City of Vernon
hereby repeals Section 4A.15 of Chapter 4A of the Code of the
City of Vernon, California 959 relating to fees.

The Llty Council of the City of Vernon
hereby amends subsection Cd) to Section 4A.5 of Chapter 4A of the
Code of the City of Vernon, California 1959 to read as follows:
Cd) Egg:
The alarm user shall pay fees in amounts
established by resolution of the City Council of the City of
Vernon and said fees shall not be prorated. The alarm user shall
pay an initial permit fee for the first year and an annual
renewal fee every year thereafter while said permit is in force.
If the annual renewal fee is not paid on or before June 30th of
each year, a late charge will be assessed in addition to the
annual renewal fee.
In the event the Chief of Police authorizes
a reissuance of a permit which was previously revoked or

the alarm user shall pay a reinstatement fee.

Permits issued under this Chapter shall expire on
7 June 30th of each fiscal year unless an application for renewal

is granted.

The City Council of the City of Vernon
16 hereby amends Section 4A.l8 of Chapter 4A of the Code of the City
17 of Vernon, California 1959 to read as follows:

Sec.4A.18.
Procedure for Suspension and Revocation.

The Chief of Police may suspend any permit issued
20 under this Chapter for any of the grounds provided for in Section
21
4A.. 17.

In order to suspend such permit,

first serve the permittee with a Notice of Intent to issue
a written order of suspension.
Said Notice shall provide a date
24 for the issuance of said order not later than fifteen (15) days
25
from the date of said Notice.
The Chief of Police shall have the

right to withdraw the Notice of Intent,
establish a new time
27 period for the assessment of service charges under Section 4A.22,

and not
issue a written order of suspension upon receipt of
satisfactory evidence which would indicate that there will be a
significant reduction in future false alarms by making necessary
system modifications or operating policy revisions and/or
additional operator training.. In the event the Notice of Intent
is not withdrawn,
then the Chief shall issue a written order of
suspension which shall state the reasons for such suspension.
The order shall be effective immediately,
if personally served,
or forty-eight (48) hours after the same has been deposited in
the course of transmission in said United States Postal Service.
Immediately upon such an order becoming effective,
the permittee shall
discontinue the use of an alarm system
requiring a permit under this Chapter and cease all
operations
conducted under the authority of any permit issued pursuant to
this Chapter.
Further, in the event permittee fails to cease all
operations,
the police department will not respond to any alarms
issued from the alarm system without a valid and effective permit
in accordance with this Chapter.
9.~GIIQN_~:
That any ordinance or parts of ordinances
in conflict with this ordinance are hereby repealed.
9.~GIIQN_~:
If any section,
subsection,
sentence,
clause,
or phrase or word of this ordinance is for any reason
held to be void or unconstitutional,
such decision shall
not
affect the validity of the remaining portions of this ordinance;
it being the intention of the City Council of the City of Vernon
to adopt and pass this ordinance and each section,
subsection,
sentence,
clause or phrase thereof irrespective of the fact that
one or more of the sections,
subsections,
clauses, sentences or

phrases thereof may be declared void or unconstitutional.

The amending or repealing provisions of

this ordinance shall
not affect any proceeding,
sui t , or
4
prosecution had or commenced in any cause before such amendment
5
or repeal shall take effect;
but every such proceeding,
suit or
6
prosecution had or commenced shall remain in full force and
7
effect to all intents and purposes as if such ordinance or part
8
thereof so amended or repealed had remained in force. No offense
9
10
committed and no liability,
penalt.y,
or frJrf ei tLln~s,
either
civilly or criminally incurred prior to the time when any such
11
ordinance or part thereof shall be amended or repealed,
shall be
12
discharged or affected by such amendment or
Irr=peal ;
but
13
prosecutions and suits for such offenses, liabilities, penalties,
14
or forfeitures shall be instituted and proceeded with in all
15
respects as if such prior ordinance or part thereof had not been
16
amended or repealed.

or circulated in the City of Vernon,
the City Clerk is hereby
19

directed to certify to the passage of this ordinance and shall
post tl-',e same,
or cause the same to be posted,
within fi.fteen

(15) days after its passage in accordance with Section 36933 of
22
the Government Code,
in three (3) of the most public places in
23
the City of Vernon,
to wit: t.he northwest corner of 38th Street
24
and Santa Fe Avenue, the northeast corner of Leonis Boulevard and
25

Pacific Boulevard, and on the bulletin board in the lobby of the
City Hall of said City,
located at 4305 Santa Fe Avenue,
all in
the City of Vernon, County of Los Angeles, State of California;

days from and after the passage of the same.
