ORDINANCE NO. 978
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF VERNON AUTHORIZING THE CITY ADMINISTRATOR
TO ISSUE A NEWSLETTER FOUR OR MORE TIMES PER
YEAR
WHEREAS, State of California Proposition 73, effec-
tive July 1, 1988 amended Government Code Section 89001 to
prohibit the publication and mailing of newsletters by public
agencies on behalf of candidates for election to public
office; and
WHEREAS, the Fair Political Practices Commission,
which is charged with enforcing Government Code Section
89001, has ruled that public agency newsletters published and
mailed pursuant to an ordinance shall be exempt from its
regulations; and
WHEREAS, the City of Vernon has a large con-

stituency of taxpaying industries and businesses which is af-

fected by decisions of the City Council and the departments
of the City; and

WHEREAS, the City of Vernon does not have a
newspaper to ~ublish reports of the decisions and activities
20

of the City Council and the City staff; and
WHEREAS, the taxpaying industries and businesses
and other interested persons have a right to know how the
revenue and taxes of the City of Vernon are being expended
25
and what personnel are being hired to serve the city.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY
ORDAINS:
SECTION 1: Findinqs.
The City Council of the City of Vernon hereby finds
1 and determines that the recitals contained hereinabove are
2 true and correct.
3 SECTION 2: Enactment:
4 Vernon City Code is hereby amended to add Section
5 2. 8-I.
6 Sec. 2.8-1. Official Newsletter of the City
7 of Vernon.
8 The City Administrator is authorized to
9 publish a newsletter for the City of Vernon
10 four or more times per year. Said newslet-
11 ter shall be distributed by mail or other-
12 wise to industries, businesses, public
13 agencies, and other interested persons who
14 have requested a copy thereof or to whom the
15 City Administrator shall determine.
16 Said newsletter shall report on the
17 decisions and activities of the City Council
18 and staff and any other news or data per-
19 tinent to the operations of the City of Ver-
20 non. Said newsletter shall not be used to
21 publicize the candidacy or views of any per-
22 son seeking election to public office in the
23 City of Vernon.
24 SECTION 3: Severability.
25 If any provision or clause of this Ordinance or the
26 application thereof to any person or circumstances is held
27 invalid, such invalidity shall not affect other provisions or
28 applications of this Ordinance which can be carried out

1 without the invalid provision or application, and to this end
2 the provisions of this ordinance are declared to be
3 severable.

SECTION 4: Notice.
There being no newspaper printed, published or cir-
6 culated in the City of Vernon, the City Clerk is hereby
7 directed to certify to the passage of this Ordinance and
8 shall post the same, or cause the same to be posted, in three
9 (3) of the most public places in the City of Vernon, to wit:
10 the northwest corner of 38th Street and Santa Fe Avenue, the
11 northeast corner of Leonis Boulevard and Pacific Boulevard,
12 and on the bulletin board in the lobby of the City Hall of
13 said City, located at 4305 Santa Fe Avenue, all in the City
14 of Vernon, County of Los Angeles, State of California.

SECTION 5: Conflicts.
Any ordinance or resolution or parts thereof that
17 are found to be in conflict with this ordinance are hereby
superseded and shall have no further force or effect.
