Ordinance No. 992 L 1 ORDINANCE NO. 992 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND ADOPTING THE REDEVELOPMENT PLAN FOR THE INDUSTRIAL REDEVELOPMENT PROJECT FOR THE CITY OF VERNON 4 5 6 WHEREAS, the Redevelopment Agency of the City of 7 Vernon, hereinafter referred to as the "Agency", formulated and 8 prepared the proposed Redevelopment Plan for the Industrial 9 Redevelopment Project for the City of Vernon, hereinafter called lO the "Redevelopment Plan"; and 11 WHEREAS, the Vernon City Council, hereinafter referred 12 to as the "Council", acting as the planning agency for the city 13 of Vernon submitted its report and recommendations on said 14 proposed Plan, finding that the proposed Plan is in conformity 15 with the General Plan, and recommending that the proposed Plan 16 be approved and adopted; and 17 WHEREAS, the Agency submitted to the Council said 18 proposed Redevelopment Plan, accompanied by the Report to 19 Council of the Agency on said proposed Plan, which Report 20 contains, among other things, the City planning agency's report 21 and recommendations, the Final Environmental Impact Report on 22 said proposed Plan, the Report of the County Fiscal Officer and 23 Analysis thereof by the Agency, and the Report of the Fiscal 24 Review Committee and Analysis thereof by the Agency; and 25 WHEREAS, the Agency adopted rules governing 26 participation by and reasonable preferences to owners and 27 tenants in the Project Area; and 28 WHEREAS, the Agency consulted with the taxing agencies 1 2 which levy taxes, or for which taxes are levied, on property in 3 the Project Area with respect to the Plan and to the allocation 4 of taxes pursuant to Section 33670; and 5 WHEREAS, this Council considered and approved the 6 response of the Agency to the Report of the Fiscal Review 7 Committee; and 8 WHEREAS, the Agency and this Council certified that the 9 Final Environmental Impact Report for the proposed Industrial lO Redevelopment Project was prepared and completed in compliance 11 with the California Environmental Quality Act of 1970, and State l2 and local regulations and guidelines adopted pursuant thereto; l3 and 14 WHEREAS, after due notice, a joint public hearing was 15 held by this Council and the Agency to consider said proposed 16 Redevelopment Plan; and 17 WHEREAS, after said joint public hearing, this Council l8 heard and passed upon all oral and written objections by 19 overruling such objections; and 20 WHEREAS, all actions required by law have been taken by 21 all appropriate public agencies. 22 THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS 23 FOLLOWS: 24 SECTION 1: The purposes and intent of this Council 25 with respect to the Project Area are to: 26 A. Ensure, as far as possible, that the causes of blighting conditions will be either eliminated or protected against; Encourage the alteration, improvement, modernization, reconstruction and rehabilitation of existing obsolete and/or deteriorated industrial, commercial and office sites and buildings, including unreinforced buildings; Encourage the assembly of land into parcels sui table for modern industrial, commercial and office development with proper off-street parking, loading, storage and vehicular and pedestrian circulation; Provide for the elimination of buildings and uses and for the recycling of land where economics do not support the investment to upgrade deteriorated, dilapidated, or obsolete facilities; Encourage the amelioration of hazardous substances and hazardous waste conditions at industrial plants and transportation facilities which necessitate extraordinary coordination and costs for the protection of the public health and safety; Encourage the participation of existing owners and businesses in the revitalization and redevelopment of properties; -3- 1 2 3 4 5 6 7 8 9 lO II 12 13 14 l5 l6 l7 18 19 20 2l 22 23 24 25 26 27 28 H. Provide for the replanning, redesign and reconfiguration of unsafe and inefficient freeway, street and railroad intersections (including grade separations) where necessary to provide adequate vehicular access for trucks, trains and automobiles to and from the properties they serve and through traffic; I. Provide for the consolidation of rail spurs and lines and reuse of right-of-way areas for more productive activities; J. Provide for the replanning, redesign and upgrading of inadequate sewer, water and drainage facilities in connection with remedying obsolete site conditions; K. Encourage the elimination or relocation of inappropriate land uses which are detrimental to the circulation system of the City and/ or adjacent uses and inconsistent with the General Plan; and L. Encourage the amelioration of traffic congestion due to narrow streets, heavy truck traffic (with oversized vehicles), inadequate off-street loading and parking, and buildings located on property 1 ines which 1 imi t street widening and/or reconfiguration of uses on the site. SECTION 2: All written and oral objections to the Redevelopment Plan are hereby overruled. -4- 1 2 3 4 5 6 7 8 9 lO 11 12 13 14 15 l6 17 l8 19 20 21 22 23 24 25 26 27 28 SECTION 3: The proposed Redevelopment Plan for the Industrial Redevelopment Project is hereby approved and adopted and designated the official Redevelopment Plan for the Industrial Redevelopment Project. SECTION 4: The Redevelopment Plan for the Industrial Redevelopment Project is hereby incorporated herein by reference and made a part hereof as if fully set out at length herein. SECTION 5: This Council hereby finds and determines that: (a) The proj ect Area is a bl ighted area, the redevelopment of which is necessary to effectuate the public purposes declared in the Community Redevelopment Law of the State of California; (b) The Redevelopment Plan will redevelop the Project Area in conformity with the Community Redevelopment Law of the State of California and in the interests of the public peace, health, safety and welfare; (c) The adoption and carrying out of the Redevelopment Plan is economically sound and feasible; (d) The Redevelopment Plan conforms to the General Plan of the City of Vernon; (e) The carrying out of the Redevelopment Plan will promote the public peace, health, safety and welfare of the City of Vernon and will -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (f) (g) (h) (i) effectuate the purposes and policies of the Community Redevelopment Law of the state of California; The condemnation of real property, as provided for in the Redevelopment Plan, is necessary to the execution of the Redevelopment Plan and adequate provisions have been made for payment for property to be acquired as provided by law; The Agency has a feasible method and plan for the relocation of families and persons who may be temporarily or permanently displaced from housing facilities in the Project Area; There are or are being provided in the Project Area or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons who may be displaced from the Project Area, decent, safe and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment; Inclusion within the Project Area of any lands, buildings or improvements which are not detrimental to the public health, safety or welfare is necessary for the effective -6- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 redevelopment of the area of which they are a part; any such area included is necessary for effective redevelopment and is not included for the purposes of obtaining the allocation of tax increment revenues from such area pursuant to section 33670 of the Community Redevelopment Law without other substantial justification for its inclusion; (j) The elimination of blight and the redevelopment of the Project Area cannot be reasonably expected to be accomplished by private enterprise acting alone without the aid and assistance of the Agency; and (k) The effect of tax increment financing, as provided for in section 610 of the Redevelopment Plan, will not cause a significant financial burden or detriment on any taxing agency deriving revenues from the Project Area. SECTION 6: This Council is satisfied permanent housing facilities will be available within three (3) years from the time occupants of the Project Area are displaced and that pending the development of such facilities there will be available to such displaced occupants adequate temporary housing facilities at rents comparable to those in the city of Vernon at the time of their displacement. No persons or families of low and moderate income shall be displaced from residences unless and until there is a suitable housing unit available and ready -7- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 for occupancy by such displaced person or family at rents comparable to those at the time of their displacement. Such housing units shall be suitable to the needs of such displaced persons or families and must be decent, safe, sanitary and otherwise standard dwellings. The Agency shall not displace such person or family until such housing units are available and ready for occupancy. SECTION 7: In order to implement and facilitate the effectuation of the Redevelopment Plan hereby approved and adopted, it is found and determined that certain official actions may be required to be taken by the Council with reference, among other things, to changes in zoning, the vacating and removal of streets, alleys, and other public ways, the establishment of new street patterns, the location and relocation of sewer and water mains and other public facilities, and other public action, and accordingly, this Council hereby: (1) Declares its intention to undertake and complete any proceedings necessary to be carried out by the City of Vernon under the provisions of the Redevelopment Plan. (2) Requests the various officials, departments, boards, commissions, and agencies of the City of Vernon having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with such Redevelopment Plan. -8- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 8: The City Clerk is hereby directed to send a certified copy of this ordinance to the Agency, and the Agency is hereby vested with the responsibility for carrying out the Redevelopment Plan, subject to the provisions of the Redevelopment Plan. SECTION 9: The City Clerk is hereby directed to record with the County Recorder of Los Angeles County a description of the land within the Project Area and a statement that the proceedings for the redevelopment of the Project Area have been instituted under the California Redevelopment Law. The Agency is hereby directed to effectuate recordation in compliance with the provisions of Section 27295 of the Government Code to the extent applicable. SECTION 10: The Building Department of the City of Vernon is hereby directed for a period of two (2) years after the effective date of this ordinance to advise all applicants for building permits within the Project Area that the site for which a building permit is sought for the construction of buildings or for other improvements is within a redevelopment project area. SECTION 11: The City Clerk is hereby directed to transmit a copy of the description and statement recorded by the ci ty pursuant to Section 9 of this ordinance, a copy of this ordinance, and a map or plat showing the boundaries of the Project Area to the Auditor and Tax Assessor of Los Angeles County, to the governing body of each of the taxing agencies which levies taxes upon any property in the Project Area, and to -9- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the state Board of Equalization. SECTION 12: There being no newspaper printed, published or circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this ordinance and shall post the same, or cause the same to be posted, within fifteen (15) days after its passage in accordance with section 36933 of the Government Code, in three (3) of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California. SECTION 13: That any ordinance or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 14: If any section, subsection, sentence, clause, or phrase or word of this ordinance is for any reason held to be void or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance; it being the intention of the City Council of the City of Vernon to adopt and pass this ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that one or more of the sections, subsections, clauses, sentences or phrases thereof may be declared void or unconstitutional.
