1 ORDINANCE NO. 1002
2 AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF VERNON AMENDING SECTIONS 16.18-1
3 AND 16.18-3 OF THE CODE OF THE CITY OF
VERNON, CALIFORNIA, 1959, TO CHANGE SPEED
4 LIMITS ON CERTAIN STREETS; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN
5 CONFLICT THEREWITH; AND DECLARING THE
URGENCY THEREOF, AND THAT IT WILL TAKE
6 IMMEDIATE EFFECT
7 WHEREAS, the Community Services Department of the City
8 of Vernon conducted a radar speed survey during April 1991 as
9 part of the Engineering and Traffic Survey for the purpose of
10 evaluating existing speed limits on streets within the City of
11 Vernon; and
12
WHEREAS, the Speed Zone Survey prepared by the
13 Community Services Department in June 1991 recommended retaining
14 existing speed limits on some streets and changing speed limits
15 on other streets, based on the Engineering and Traffic Survey;
16 and
17
WHEREAS, according to the Engineering and Traffic
18 Survey, the recommendations for speed limits of 45, 40, 35 and
19 30 miles per hour on certain streets would facilitate the
20 orderly movement of vehicular traffic and would be reasonable
21 and safe on those streets; and
22
WHEREAS, Vehicle Code Section 22357 authorizes cities
23 to determine and declare prima facie speed limits greater than
24 25 miles per hour on the basis of such an engineering and
25 traffic survey; and
26 WHEREAS, Ordinance No. 999, adopted on August 6, 1991,
27 contained some speed limits which did not agree with the results
28 of the survey referred to above and some incorrect street

references; and
WHEREAS, this Ordinance No. 1002 has been drafted to
amend the previous Ordinance No. 999 to establish the correct
speed limits, in accordance with the survey, and to correct the
street references.
THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS
FOLLOWS:
SECTION 1:
That Section 16.18-1 of the Code of the
City of Vernon, California, 1959, is hereby amended to read in
its entirety as follows:
"Pursuant to Vehicle Code section 22357, the City Council
hereby determines and declares that the prima facie speed limit
on the following streets shall be forty-five (45) miles per
hour:
BANDINI BOULEVARD From Soto Street to Atlantic
Boulevard
37TH STREET From Jewel Avenue to Soto Street
Every violation of this section by propelling a vehicle
in excess of the speed limit provided for herein is hereby
declared to be a public nuisance."
SECTION 2: That Section 16.18-2 of the Code of the
City of Vernon, California, 1959, is hereby amended to read in
its entirety as follows:
"Pursuant to Vehicle Code Section 22357, the City
council hereby determines and declares that the prima facie
speed limit on the following streets shall be forty (40) miles
per hour:

Every violation of this section by propelling a vehicle
in excess of the speed limit provided for herein is hereby
declared to be a public nuisance."
SECTION 3: That section 16.18-3 of the Code of the
City of Vernon, California, 1959, is hereby amended to read in
its entirety as follows:
"Pursuant to Vehicle Code section 22357, the City
Council hereby determines and declares that the prima facie
speed limit on the following streets shall be thirty-five (35)
miles per hour:
ALAMEDA STREET-EAST
ATLANTIC BOULEVARD
From Slauson Avenue to 27th Street
From the north City boundary to the
south City boundary
From Leonis Boulevard to Slauson
Avenue; and the northbound lanes from
Slauson Avenue to Randolph Street
From the north City boundary to
Fruitland Avenue; and the outer
northbound lane from Fruitland Avenue
to Slauson Avenue
BOYLE AVENUE
DOWNEY ROAD

15 Every violation of this section by propelling a vehicle
16 in excess of the speed limit provided for herein is hereby
17 declared to be a public nuisance."
18 SECTION 4: That any parts of Ordinance No. 999 and
19 that any other ordinance or parts of ordinances in conflict with
20 this ordinance are hereby repealed.
21 SECTION 5: If any section, subsection, sentence,
22 clause, or phrase or word of this ordinance is for any reason
23 held to be void or unconstitutional, such decision shall not
24 affect the validity of the remaining portions of this ordinance;
25 it being the intention of the City Council of the City of Vernon
26 to adopt and pass this ordinance and each section, subsection,
27 sentence, clause or phrase thereof irrespective of the fact that

lone or more of the sections, subsections, clauses, sentences or
2 phrases thereof may be declared void or unconstitutional.
3 SECTION 6: There being no newspaper printed, published
4 or circulated in the City of Vernon, the City Clerk is hereby
5 directed to certify to the passage of this ordinance and shall
6 post the same, or cause the same to be posted, within fifteen
7 (l5) days after its passage in accordance with Section 36933 of
8 the Government Code, in three (3) of the most public places in
9 the City of Vernon, to wit: the northwest corner of 38th Street
10 and Santa Fe Avenue, the northeast corner of Leonis Boulevard
11 and Pacific Boulevard, and on the bulletin board in the lobby of
12 the City Hall of said city, located at 4305 Santa Fe Avenue, all
13 in the City of Vernon, County of Los Angeles, State of
14 California.
15 SECTION 7: The adoption of this ordinance is intended
16 to correct the speed limits on some streets and the street
17 references in Code sections 16.8-1 through 16.18-3, and the City
18 Council of the City of Vernon finds that this ordinance is
19 urgently required for the immediate protection of the public
20 safety, health and welfare, and that, absent such immediate
21 correction, there would be a threat to the pUblic safety, health
22 and welfare, and that the ordinance is necessary to preserve and
23 protect the lives and quality of life of residents, employees,
24 and travelers, is necessary to avoid litigation and its expense,
25 and is necessary for the orderly conduct of vehicular traffic on
26 City streets.

1 SECTION 8: That this ordinance shall take effect
2 immediately upon its passage as an emergency ordinance, in
3 accordance with the declaration of urgency above.
