AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF VERNON AMENDING SECTION 15.43 OF
THE CODE OF THE CITY OF VERNON REGARDING
REFUNDS OF BUSINESS LICENSE FEES

WHEREAS, Vernon City Code section 15.43 authorizes the
7
City Clerk to refund business license fees on a pro rata basis
8
upon application by those businesses which discontinue
9
operations in the City of Vernon during the calendar year; and
WHEREAS, the City Clerk has recommended discontinuance
of such refunds because processing refunds results in additional
expenses by the City Clerk's office; and
WHEREAS, the services paid for by such fees are
budgeted on an annual basis, and many of those services are
performed by the City Clerk's office at the start of the
calendar year. No refund is warranted for services already
performed, and the expenses of processing refunds are not
compensated by the businesses which discontinue operations, and
therefore such expenses must be paid from the fees of those
businesses which continue in operation; and
WHEREAS, the City Council has the authority to require
license fees from businesses operating within the corporate
boundaries of the City of Vernon in order to provide services
for the City of Vernon; and
WHEREAS, it benefits the health, safety, and welfare of
the City of Vernon, its residents, businesses, and their
employees, to maintain reasonable business license fees; and

WHEREAS, it is reasonable to require such businesses

which discontinue operations to pay their fair share of the
services provided by the city of Vernon.

THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS
5
FOLLOWS:

SECTION 1:
The City Council of the City of Vernon
7
hereby finds and determines that the recitals contained
8
hereinabove are true and correct.

SECTION 2:
Section 15. 43 of the Code of the City of
Vernon, 1959, is hereby amended to read as follows:
Sec. 15.43. Discontinuance of operations before
expiration date.
All business licenses shall be for the term
prescribed and no refunds shall be granted for
discontinuance of operations prior to expiration
of said term.
SECTION 3:
Any ordinance, part of an ordinance, or
code section in conflict with this Ordinance is hereby repealed.
SECTION 4:
If any section, subsection, sentence,
clause, or phrase or word of this ordinance is for any reason
held to be void or unconstitutional, such decision shall not
affect the validity of the remaining portions of this ordinance;
it being the intention of the City Council of the City of Vernon
to adopt and pass this ordinance and each section, subsection,
sentence, clause or phrase thereof irrespective of the fact that

one or more of the sections, subsections, clauses, sentences or

phrases thereof may be declared void or unconstitutional.

SECTION 5: There being no newspaper printed, published
2 or circulated in the city of Vernon, the City Clerk is hereby
3 directed to certify to the passage of this ordinance and shall
4 post the same, or cause the same to be posted, within fifteen
5 (15) days after its passage in accordance with section 36933 of
6 the Government Code, in three (3) of the most public places in
7 the City of Vernon, to wit: the northwest corner of 38th Street
8 and Santa Fe Avenue, the northeast corner of Leonis Boulevard
10 the City Hall of said City, located at 4305 Santa Fe Avenue, all
9 and Pacific Boulevard, and on the bulletin board in the lobby of
11 in the City of Vernon, County of Los Angeles, State of
12 California.

SECTION 6:
This ordinance shall be in full force and
14 effect thirty (30) days from and after its passage of the same.
