Ordinance No. 999 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 ORDINANCE NO. 999 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING SECTIONS 16.18-1 AND 16.18-2 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, AND ADDING NEW SECTIONS 16.18-3 AND 16.18-4, TO RETAIN AND CHANGE SPEED LIMITS ON CERTAIN STREETS 3 4 5 6 WHEREAS, the Community Services Department of the City of Vernon conducted a radar speed survey during April 1991 as 7 8 part of the Engineering and Traffic Survey for the purpose of evaluating existing speed limits on streets within the City of 9 Vernon; and WHEREAS, the Speed Zone Survey prepared by the Community Services Department in June 1991 recommended retaining existing speed limits on some streets and changing speed limits on other streets, based on the Engineering and Traffic Survey; and WHEREAS, according to the Engineering and Traffic Survey, the recommendations for speed limits of 45, 40, 35 and 30 miles per hour on certain streets would facilitate the orderly movement of vehicular traffic and would be reasonable and safe on those streets; and WHEREAS, Vehicle Code Section 22357 authorizes cities to determine and declare prima facie speed limits greater than 25 miles per hour on the basis of such an engineering and traffic survey. THE CITY COUNCIL OF THE CITY OF VERNON DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 16.18-1 of the Code of the City of Vernon, California, 1959, is hereby amended to read in 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 its entirety as follows: "Pursuant to Vehicle Code Section 22357, the City Council hereby determines and declares that the prima facie speed limit on the following streets shall be forty-five (45) miles per hour: BANDINI BOULEVARD From Soto Street to Atlantic Avenue Every violation of this section by propelling a vehicle in excess of the speed limit provided for herein is hereby declared to be a public nuisance." SECTION 2: That Section 16.'18-2 of the Code of the City of Vernon, California, 1959, is hereby amended to read in its entirety as follows: "Pursuant to Vehicle Code Section 22357, the City Council hereby determines and declares that the prima facie speed limit on the following streets shall be forty (40) miles per hour: From the north City boundary to the south City boundary From Downey Road to Atlantic Avenue From the north City boundary to Downey Road and from the next under- pass to the east City boundary Every violation of this section by propelling a vehicle in excess of the speed limit provided for herein is hereby declared to be a public nuisance." SECTION 3: That Section 16.18-3 is hereby added to the Code of the City of Vernon, California, 1959, to read as ALAMEDA STREET-WEST DISTRICT BOULEVARD WASHINGTON BOULEVARD -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 follows: "Pursuant to Vehicle Code Section 22357, the City Council hereby determines and declares that the prima facie speed limit on the following streets shall be thirty-five (35) miles per hour: From the north City boundary to the south City boundary From the north City boundary to the south city boundary From Leonis Boulevard to Randolph Street From the north City boundary to Slauson Avenue From Santa Fe Avenue to Downey Road From Pacific Boulevard to Downey Road From Santa Fe Avenue to Fruitland Avenue From the north City boundary to the south City boundary From Boyle Avenue to Downey Road From the north City boundary to the south City boundary From Washington Boulevard to Atlantic Avenue 37TH STREET From Santa Fe Avenue to Soto Street 38TH STREET From Santa Fe Avenue to 37th Street Every violation of this section by propelling a vehicle ALAMEDA STREET-EAST ATLANTIC AVENUE BOYLE AVENUE DOWNEY ROAD FRUITLAND AVENUE LEONIS BOULEVARD PACIFIC BOULEVARD SANTA FE AVENUE SLAUSON AVENUE SOTO STREET 26TH STREET -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 in excess of the speed limit provided for herein is hereby declared to be a public nuisance." SECTION 4: That section 16.18-4 is hereby added to the Code of the City of Vernon, California, 1959, to read as follows: "Pursuant to Vehicle Code Section 22357, the City Council hereby determines and declares that the prima facie speed limit on the following streets shall be thirty (30) miles per hour: ALCOA AVENUE BOYLE AVENUE From Vernon Avenue to Slauson Avenue From Vernon Avenue to Leonis Boulevard Every violation of this section by propelling a vehicle in excess of the speed limit provided for herein is hereby declared to be a public nuisance." SECTION 5: That any ordinance or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 6: If any section, subsection, sentence, clause, or phrase or word of this ordinance is for any reason held to be void or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance; it being the intention of the City Council of the City of Vernon to adopt and pass this ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that one or more of the sections, subsections, clauses, sentences or phrases thereof may be declared void or unconstitutional. SECTION 7: There being no newspaper printed, published or circulated in the City of Vernon, the city Clerk is hereby -4- 1 directed to certify to the passage of this ordinance and shall 2 post the same, or cause the same to be posted, within fifteen 3 (15) days after its passage in accordance with Section 36933 of 4 the Government Code, in three (3) of the most public places in 5 the City of Vernon, to wit: the northwest corner of 38th street 6 and Santa Fe Avenue, the northeast corner of Leonis Boulevard 7 and Pacific Boulevard, and on the bulletin board in the lobby of 8 the City Hall of said City, located at 4305 Santa Fe Avenue, all 9 in the City of Vernon, County of Los Angeles, State of 10 California. 11 SECTION 8: That this ordinance shall be in full force 12 and effect thirty (30) days from and after its passage of the 14 13 same. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 APPROVED AND ADOPTED this 6th day of August , 1991.
