AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING SECTIONS 23.1, 23.2, 23.3, 23.4,
23.6 AND 23.11 OF THE CODE OF THE CITY OF VERNON
REGARDING TAXICABS AND TAXICAB STANDS IN THE CITY
OF VERNON

WHEREAS, the city Council has the authority to require
7
license fees for taxis and taxicab stands operating within the
8
corporate boundaries of the City of Vernon pursuant to Vernon City
9
Code sections 23.10 and 23.12; and

WHEREAS, the provisions for taxicabs and taxicab stands
II
contained in Vernon City Code Sections 23.1 through 23.4 were

adequate when established by Ordinance No. 590, but need to be
l3
updated because of changes in the industry; and

WHEREAS, the taxicab license and taxicab stand insurance
15
l6
policy and bond amounts required by Vernon City Code section 23.6
were reasonable when established by Ordinance No. 590, but are no
l7
longer sufficient, and such amounts should be subject to increases
l8
by resolution; and

WHEREAS, it will benefit the health, safety, and welfare
20
of the City of Vernon, its residents, businesses, and their

employees, to maintain reasonable controls over taxicab stands and
22
taxicabs operating therefrom.

THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:

SECTION 1: The City council of the City of Vernon does
25
26
hereby find and determine that the recitals contained hereinabove
are true and correct.

SECTION 2: section 23.1 of the Code of the City of
28
Vernon, California, 1959, is hereby amended to read as follows:
1 Sec. 23.1. Definitions.
2 For the purposes of this chapter, the following words and
3 phrases shall when used in this chapter have the meanings
4 respectively ascribed to them by this section:
5 Taxicab Stand shall mean a place on a public street
6 designated by a taxicab stand permit and shown by appropriate
7 signs, curb markings, and pavement striping.
8 Taxicab shall mean every vehicle for hire operated from a
9 taxicab stand. Each such vehicle (i) shall have a distinct color
lO and signs; (ii) shall be of public appearance such as in common
II usage in this county for taxicabs; (iii) shall be equipped with a
l2 taximeter; (iv) shall be used for the transportation of one or
l3 more passengers for hire over the streets of this city and not
l4 over a definite route, irrespective of whether the operation
l5 extends beyond the limits of the city, at rates for distance
l6 traveled or for waiting time, or for both; and (v) shall be routed
l7 under the direction of the passenger or person hiring the same.
18 Taximeter shall mean an instrument or device by which the
19 charge for hire of a taxicab is calculated and displayed to the
20 passenger either for distance traveled or for waiting time, or for
21 both.
22 SECTION 3: section 23.2 of the Code of the City of
23 Vernon, California, 1959, is hereby amended to read as follows:
24 Sec. 23.2. Permit-Required.
25 No person shall operate a taxicab stand or a taxicab
26 therefrom without first having obtained a written permit from the
27 city council.

SECTION 4: section 23.3 of the Code of the City of
2 Vernon, California, 1959, is hereby amended to read as follows:

Sec. 23.3. Same-Application.
4 Applicants for a permit required by Section 23.2 shall
5 file with the city council an application setting forth the place
6 or stand to be occupied, the number of taxicabs to be used, the
7 charges to be made for the carrying of passengers, and the extent,
8 character and quality of service of the taxicabs to be used.

SECTION 5: section 23.4 of the Code of the City of
10 Vernon, California, 1959, is hereby amended to read as follows:

Sec. 23.4. same-same-Applicant to be a legal resident
and at least twenty-one years of age.

Every applicant for a permit to operate a taxicab stand
or to drive a taxicab must be a legal resident of the United

States of America and must be at least twenty-one years of age.
SECTION 6: section 23.6 of the Code of the City of

Vernon, California, 1959, is amended to read as follows:

Sec. 23.6. same-Liability Insurance or Bond Required.

Before any permit is issued, the owner of any taxicab
20
stand and any taxicab shall be required to file with the city
2l
council, and thereafter keep in full force and effect, a policy of
22
insurance in such form as the city council may deem proper,
23
executed by an insurance company approved by the city council,
24
insuring the public against any loss or damage that may result to
25
any person or property from the operation of such taxicab stand or
26
taxicab; provided, that the maximum amount of recovery in such
27
policy of insurance specified, shall not be less than the amounts
28
set by resolution of the city council from time to time.

Such person may, in lieu of the aforesaid policy of
liability insurance, file with the city council, a bond in such
form as the city council may deem proper, executed by a
responsible and solvent corporation authorized to conduct a
bonding insurance business under the laws of the state, which bond
shall be conditioned upon the payment of all final judgments which
may be rendered against any such person for damages on account of
injuries to property or person, including both passengers and the
public, occasioned by the operation of any such taxicab stand or
taxicab, and which bond shall be in the amounts set by resolution
of the city council from time to time.
SECTION 7: Section 23.11 of the Code of the City of
Vernon, California, 1959, is amended to read as follows:
Sec. 23.11. operation from stand, garage or parking lot.
"No taxicab or automobile for hire shall be operated from
any place on the public streets except a taxicab stand
designated a permit and as approved by the police
department, or from a public or private garage or parking
lot."
SECTION 8: Any ordinance, part of an ordinance, or code
section in conflict with this ordinance is hereby repealed.
SECTION 9: If any section, subsection, sentence, clause,
or phrase or word of this ordinance is for any reason held to be
void or unconstitutional, such decision shall not affect the
validity of the remaining portions of this ordinance; it being the
intention of the City Council of the City of Vernon to adopt and
pass this ordinance and each section, subsection, sentence, clause

1 or phrase thereof irrespective of the fact that one or more of the

sections, subsections, clauses, sentences or phrases thereof may
3 be declared void or unconstitutional.
4 SECTION 10: There being no newspaper printed, published
5 or circulated in the city of Vernon, the City Clerk is hereby
6 directed to certify to the passage of this ordinance and shall
7 post the same, or cause the same to be posted, within fifteen (15)
8 days after its passage in accordance with Government Code S36933,
9 in three (3) of the most public places in the City of Vernon, to
lO wit: the northwest corner of 38th Street and Santa Fe Avenue, the
II northeast corner of Leonis Boulevard and Pacific Boulevard, and on
12 the bulletin board in the lobby of the City Hall of said City,
l3 located at 4305 Santa Fe Avenue, all in the City of Vernon, County
l4 of Los Angeles, state of California.
l5 SECTION 11: This ordinance shall be in full force and
l6 effect thirty (30) days from and after its passage of the same.
