AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE CODE OF THE CITY OF VERNON,
CALIFORNIA, 1959, BY ADDING CHAPTER 17B THERETO
REGARDING PUBLIC INFORMATION AND MATTERS
RELATING THERETO AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT THEREWITH

WHEREAS, the voters of the City of Vernon established a
8
charter to govern the operation of the City of Vernon on April 12,
9
1988; and

WHEREAS, Article XI, section 6 of the Constitution of the
II
State of California grants charter cities home rule as to
12
municipal affairs; and
13
WHEREAS, the territory within the boundaries of the City

of Vernon is encompassed, in whole or in part, within the
l5

boundaries of various districts or governmental entities which
also include areas outside of the boundaries of the City, and the
17
plans, policies, programs andlor tax or assessment policies of
18
such districts or governmental entities may affect the public
19
health, safety and welfare of the residents and property owners or
20
the economic welfare of such residents, property owners, and the

commercial and industrial enterprises within the City; and
22
WHEREAS, the public interest of the city of Vernon and
23
the residents, property owners, business and industrial
24
enterprises in the City may from time to time be deemed by the
25
City Council of the city of Vernon to be served by the
26
dissemination of information communicating the City Council's
27
opinion as to the impact thereof on the city of Vernon, its
28
residents, or property owners, or commercial or industrial
1 enterprises in the City with respect to the plans, policies,
2 programs and tax or assessment policies of such districts or
3 governmental entities; and
4 WHEREAS, the City, its residents, property owners, and
5 commercial and industrial enterprises and the residents, property
6 owners, and commercial and industrial enterprises outside of the
7 City but within the geographical boundaries of such districts or
8 governmental entities have a common interest in the plans,
9 policies, programs andlor tax or assessment policies of such
10 districts or governmental entities.
11 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
12 SECTION 1: The City Council of the City of Vernon hereby
13 finds and determines that the recitals contained hereinabove are
l4 true and correct.
15 SECTION 2: The City Council of the City of Vernon hereby
16 amends the Code of the city of Vernon, california, 1959, by adding
17 Chapter 17B, Public Information, and sections 17B.1, 17B.2 and
18 17B.3 to read as follows:
19 "Chapter 17B. Public Information.
20 Sec. 17B.1. Dissemination of Information.
21 The City council of the city of Vernon may by resolution
22 from time to time authorize to be disseminated throughout the city
23 information communicating the city Council's findings or opinion,
24 regarding matters which the City council of the City of Vernon
25 deems to affect (1) the public interest; or (2) the City of
26 Vernon; or (3) the public health, safety, or welfare, including
27 the economic interest, of the residents, or the property owners,
28 or the commercial or industrial enterprises, within the city.

1 Such dissemination shall be at City expense and may be by mail,
2 hand delivery, electronically, or by such other means of
3 publication, including news media, as the City Council deems
4 appropriate.
5 Sec. 17B.2. Distribution Outside the city.
6 The City Council of the City of Vernon may by resolution
7 from time to time authorize to be disseminated both within and
8 outside of the boundaries of the City of Vernon, information
9 communicating the city Council's findings or opinion, regarding
10 matters which the City Council of the City of Vernon deems to
11 affect (1) the public interest; or (2) the City of Vernon; or (3)
12 the public health, safety or welfare, including the economic
13 interest, of the residents, or property owners, or the commercial
14 or industrial enterprises within the city; or (4) the interests of
15 the residents, or property owners, or commercial or industrial
16 enterprises outside of the City of Vernon and within the
17 boundaries of the district or governmental agency encompassing all
18 or part of the City of Vernon, in which such information is
19 disseminated. Such dissemination shall be at the expense of the
20 city of Vernon paid only from sources of revenue generated within
2l the city of Vernon, and may be by mail, hand delivery,
22 electronically or by such other means of publication, including
23 news media, as the city Council deems appropriate.
24 Sec. 17B.3. Municipal Election Procedures.
25 This Chapter is not intended to affect the procedures
26 provided by the general laws of the State of California governing
27 municipal elections. Notwithstanding the immediately preceding
28 sentence, if this Chapter or any provision thereof should be

1 construed to apply to election procedures within the meaning of
2 Article V, Chapter 5.3 of the Charter of the City of Vernon, this
3 Chapter 17B of the Code of the City of Vernon, California, 1959
4 shall supersede the general laws of the state of California as
5 they may exist from time to time to the extent that such general
6 laws may be inconsistent with the provisions of this Chapter 17B."
7 SECTION 3: Any ordinance or parts of ordinances in
8 conflict with this Ordinance are hereby repealed.
9 SECTION 4: If any section, subsection, sentence, clause,
lO phrase or word of this ordinance is for any reason held to be
11 invalid or unconstitutional, such decision shall not affect the
12 validity of the remaining portions of this ordinance; it being the
13 intention of the City Council of the City of Vernon to pass and
l4 adopt this ordinance and each section, subsection, sentence,
15 clause or phrase thereof irrespective of the fact that one or more
16 of the sections, subsections, clauses, sentences or phrases
17 thereof may be declared to be invalid or unconstitutional.
18 SECTION 5: There being no newspaper printed, published
19 or circulated in the City of Vernon, the City Clerk is hereby
20 directed to certify to the passage of this ordinance and shall
2l post the same, or cause the same to be posted, within fifteen (15)
22 days after its passage in accordance with section 36933 of the
23 Government Code, in three (3) of the most public places in the
24 City of Vernon, to wit: the northwest corner of 38th Street and
25 Santa Fe Avenue, the northeast corner of Leonis Boulevard and
26 Pacific Boulevard, and on the bulletin board in the lobby of the
27 City Hall of said City, located at 4305 Santa Fe Avenue, all in
28 the City of Vernon, County of Los Angeles, State of California.

SECTION 6: This ordinance shall be in full force and
2 effect thirty (30) days from and after its passage by the City
3 Council.
