AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE REDEVELOPMENT PLAN FOR THE
INDUSTRIAL REDEVELOPMENT PROJECT AND
ESTABLISHING CERTAIN LIMITATIONS FOR THE
REDEVELOPMENT PLAN PURSUANT TO THE COMMUNITY
REDEVELOPMENT LAW REFORM ACT OF 1993 (ASSEMBLY
BILL 1290)

WHEREAS, the Redevelopment Plan for the Industrial
8
Redevelopment Project was approved and adopted by the City Council
9
of the City of Vernon on November 27, 1990, by Ordinance No. 992;
10
and
11
WHEREAS, in 1993 the California State Legislature enacted
12
the Community Redevelopment Law Reform Act of 1993 (AB 1290),

making various amendments to the Community Redevelopment Law
l4
(Health and Safety Code Section 33000, et seq.), which became
15
effective on January 1, 1994; and
16
WHEREAS, Health and Safety Code Section 33333.6 requires
l7
each redevelopment plan adopted prior to December 31, 1993 to
18
contain certain restrictions and limitations, which must be
19
imposed prior to December 31, 1994; and
20
WHEREAS, Health and Safety Code Section 33333.6 expressly
21
provides that such restrictions and limitations be imposed by way
22
of ordinance and shall be deemed to constitute an amendment of the
23
redevelopment plan without the necessity of compliance with Health
24
and Safety Code Section 33450 or any other provision of the
25
Community Redevelopment Law relating to amendment.

1 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
2 SECTION 1: The City Council of the City of Vernon hereby
3 finds and determines that the recitals contained hereinabove are
4 true and correct.
5 SECTION 2: Amendment of the Redevelopment Plan for the
6 Industrial Redevelopment Proiect. In accordance with the
7 requirements of the Community Redevelopment Law Reform Act of
8 1993, and notwithstanding any other provisions in the
9 Redevelopment Plan for the Industrial Redevelopment Project, the
10 City Council of the City of Vernon establishes the following
11 limitations, subject to all of the provisions of this Ordinance:
12 A. In accordance with Health and Safety Code
l3 section 33333.6(a), the time for establishing loans, advances and
l4 indebtedness to be paid with the proceeds of property taxes
l5 received pursuant to Health and Safety Code section 33670, to
16 finance in whole, or in part, the Industrial Redevelopment
17 Project, shall not exceed November 27, 2010.
l8 B. In accordance with Health and Safety
19 Code 33333.6(b), the effectiveness of the Industrial Redevelopment
20 Project shall terminate on November 27, 2030, after which time the
21 Agency shall have no authority to act except to pay previously
22 incurred indebtedness and to enforce existing covenants, contracts
23 or other obligations.
24 C. In accordance with Health and Safety
25 Code 33333.6(c), except as provided in subdivisions (g) and (h) of
26 Health and Safety Code section 33333.6, the payment of
27 indebtedness or receipt of property taxes pursuant to Health and
28 Safety Code Section 33670 after November 27, 2040, is prohibited.

1 SECTION 3: Application. The limitations established in
2 this Ordinance shall apply to the Redevelopment Plan for the
3 Industrial Redevelopment Project and may only be amended by
4 amendment of the Redevelopment Plan in the manner required and to
5 the extent permitted by law.
6 SECTION 4: Any ordinance or parts of ordinances in
7 conflict with this Ordinance are hereby repealed.
8 SECTION 5: If any section, subsection, sentence, clause,
9 phrase or word of this ordinance is for any reason held to be
lO invalid or unconstitutional, such decision shall not affect the
11 validity of the remaining portions of this ordinance; it being the
12 intention of the city Council of the City of Vernon to pass and
13 adopt this ordinance and each section, subsection, sentence,
14 clause or phrase thereof irrespective of the fact that one or more
15 of the sections, subsections, clauses, sentences or phrases
16 thereof may be declared to be invalid or unconstitutional.
17 SECTION 6: There being no newspaper printed, published
18 or circulated in the City of Vernon, the city Clerk is hereby
19 directed to certify to the passage of this ordinance and shall
20 post the same, or cause the same to be posted, within fifteen (15)
21 days after its passage in accordance with section 36933 of the
22 Government Code, in three (3) of the most public places in the
23 City of Vernon, to wit: the northwest corner of 38th Street and
24 Santa Fe Avenue, the northeast corner of Leonis Boulevard and
25 Pacific Boulevard, and on the bulletin board in the lobby of the
26 City Hall of said City, located at 4305 Santa Fe Avenue, all in
27 the City of Vernon, County of Los Angeles, State of California.

SECTION 7
This ordinance shall be in full force and
2 effect thirty (30) days from and after its passage by the city
3 Council.
