ORDINANCE NO. 1032
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE CODE OF THE CITY OF VERNON,
CALIFORNIA, 1959, BY AMENDING SECTIONS 26.2.16,
26.4.2 -6, 26.4.2 -7 AND 26.4.2 -8 AND ADDING
SECTION 26.4.2 -9 TO CHAPTER 26 OF SAID CODE
REGARDING AUTOMOBILE AND TRUCK PARKING AND
LOADING SPACES AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the Comprehensive Zoning Ordinance of the City
of Vernon was effective May 2, 1989, by Ordinance No. 973; and
WHEREAS, certain sections of the Comprehensive Zoning
Ordinance pertaining to automobiles and truck parking and loading
spaces need to be clarified and brought into conformity with each
other; and
WHEREAS, the existing standards for truck parking and
loading on parcels of land with limited building area have created
hardships which can be remedied by providing exceptions therefor;
and
WHEREAS, Section 26.2.16 of the Comprehensive Zoning
Ordinance contains two definitions for trucks which were intended
to interface with Chapter 16A, Interstate Truck Terminal
Designation and Terminal Access, which chapter was repealed by
Ordinance No. 1014 in September 1993, rendering said definitions
obsolete; and
WHEREAS, the Acting Director of Community Services has
recommended that the changes set forth herein be made.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.

SECTION 2: The City Council of the City of Vernon hereby
amends Section 26.2.16 of Chapter 26 of the Code of the City of
Vernon, California, 1959, by deleting therefrom the definitions
for "Truck, interstate" and "Truck, standard."
SECTION 3: The City Council of the City of Vernon hereby
amends Sections 26.4.2 -6, 26.4.2 -7 and 26.4.2 -8 of Chapter 26 of
the Code of the City of Vernon, California, 1959, regarding
automobile and truck parking and loading spaces and development
standards and adds Section 26.4.2 -9, Optional Exceptions to
Development Standards, to said chapter as set forth in Exhibit A
which is attached hereto and made a part hereof by reference.
SECTION 4: Any ordinance, part of an ordinance, or code
section in conflict with this ordinance is hereby repealed.
SECTION 5: If any section, subsection, sentence, clause,
or phrase or word of this ordinance is for any reason held to be
void or unconstitutional, such decision shall not affect the
validity of the remaining portions of this ordinance; it being the
intention of the City Council of the City of Vernon to adopt and
pass this ordinance and each section, subsection, sentence, clause
or phrase thereof irrespective of the fact that one or more of the
sections, subsections, clauses, sentences or phrases thereof may
be declared void or unconstitutional.
SECTION 6: There being no newspaper printed, published
or circulated in the City of Vernon, the City Clerk is hereby
directed to certify to the passage of this ordinance and shall
post the same, or cause the same to be posted, within fifteen (15)
days after its passage in accordance with Section 36933 of the
Government Code, in three (3) of the most public places in the

City of Vernon, to wit: the northwest corner of 38th Street and
Santa Fe Avenue, the northeast corner of Leonis Boulevard and

Code of the City of Vernon, California, 1959
Sec. 26.4.2 -6. Automobile parking requirements. Adequate
off - street parking and loading space shall be provided for each
use, development or property, or for each building, to
accommodate all automobiles or similar vehicles of the officers,
employees, vendors, salesmen, visitors, and other persons
normally transacting business at such enterprise or building. To
meet the intent of this section, the minimum parking space
requirements for certain uses and buildings are declared to be as
follows:

parking and loading facilities for any use, building, or
structure hereafter erected, constructed, altered, or expanded in
the city shall comply with the following minimum standards:

(a) For a lot with a building or buildings totaling 12,000
square feet of gross floor area or less, exceptions in accordance
with the following standards may be granted upon request of the
property owner for the size of truck parking and loading spaces
and maneuvering space as set forth in Section 26.4.2 -8(c) and
(e), subject to recording a covenant by the property owner which
restricts the length of trucks entering the property and, if
applicable, which restricts the use of the property. Signs shall
be posted at all driveway entrances giving notice of the truck
size restriction.

ENGINEER'S REPORT
ZONING ORDINANCE AMENDMENT
PARKING & LOADING REQUIREMENT
The current comprehensive zoning ordinance for the City of
Vernon was adopted in 1989. The ordinance was amended on
October 22, 1991 and March 25, 1994. These amendments made minor
language revisions to clarify ambiguities.
Section 26.2.16 of the Comprehensive Zoning Ordinance contains
two definitions for trucks which were intended to interface with
Chapter 16A, Interstate Truck Terminal Designation and Terminal
Access, which chapter was repealed by Ordinance No. 1014 in
September 1993, rendering said definitions obsolete and we are
recommending that the definitions be removed from the Zoning
Ordinance.
Section 26.4.2 -7 of the current zoning ordinance outlines the
truck parking and loading requirements. This section outlines the
minimum number of truck parking and loading spaces. It is
recommended that this section be amended to eliminate any
ambiguity. Simply stated, all buildings regardless of size will be
required to provide adequate truck loading and dependent upon the
use may require truck parking. The minimum for truck parking for
industrial and warehouse type operations is based on gross floor
area. For retail, commercial uses and public facilities the
minimum number is based on the number of vehicles stored at the
site when not in use. The minimum number of truck loading spaces
is based on the gross floor area and this section is not being

amended.
Section 26.4.2 -8 of the zoning ordinance sets the development
standards for parking and loading facilities. This section states
the minimum size of the stalls, the location, layouts, access,
markings, barriers, paving, maintenance and requires a plot plan to
be submitted for review. For the most part it was determined that
the majority of this section can remain unchanged. However, minor
changes to (e) Access, and (g) Barriers are recommended. Section
26.4.2 -8 (e) Access currently states in part "all vehicles,
including trucks, using the parking and /or loading facilities may
enter or leave the public street in front - forward manner without
backing or maneuvering on the public right -of- way." It is
recommended that the ordinance be amended to read in part "all
vehicles, including trucks, using parking and /or loading shall
enter or leave the public street in a front forward manner without
backing or maneuvering on the public right -of- way." Essentially
the only change is the word may to shall. Additionally we are
recommending that the reference to minimum required driveway widths
be changed to minimum required aisle widths. This will prevent any
confusion. Driveways are typically considered the curb cut
openings on public streets. The minimum standards referred to in
this section are for on site aisle widths.
Section 26.4.2 -8 (g) Barriers, states in part "Where parking
areas adjoin a public street or streets, a masonry or concrete wall
not less than thirty inches (30 ") in height ". It is recommended
that this be changed to read "Where parking or loading areas adjoin

a public street or streets a masonry or concrete wall not less than
thirty inches (30 ") in height ". We are adding the words or loading
after the word parking. In addition the City has required that a
concrete filled post be installed at the ends of driveways to
protect the sidewalk, barrier wall or landscaping. It is
recommended that the following language be added to the zoning
ordinance in order to codify this requirement. "Where a barrier
wall or a landscaped area adjoins a driveway, a ten inch (10 ")
concrete filled steel pipe or equivalent protective device shall be
installed."
Upon further review of the zoning ordinance, at the request of
some property owners, it was determined that the current zoning
ordinance does not allow for the development of small lots. The
code currently requires that all buildings provide truck loading
spaces. These spaces must be sixty -five (65) feet in length with
a forty (40) foot maneuvering area. The City conducted a survey
and found that over 150 lots currently exist within the City that
have insufficient dimensions to provide space to meet these truck
loading and maneuvering requirements. These buildings are
concentrated along Santa Fe Avenue, 37th and 38th Streets, Pacific
Boulevard, Hampton Street and Leonis Boulevard. The Community
Services Department made a study of these lots and it was
determined that properties that could be developed with a structure
over 12,000 square feet in size could also meet the truck loading
and maneuvering requirements. However, typically lots that were
too small to allow for this size of building, also had trouble

meeting the truck loading and maneuvering requirements. Several
drawings were developed for different sites. Based on these
models, our above mentioned conclusions were formulated. With this
in mind a new code section was developed that allowed property
owners of these smaller lots an exception from the current truck
size and maneuvering requirements. The exception allows buildings
totaling 12,000 square feet of gross floor area, on a single lot,
the option of constructing loading facilities that will accommodate
trucks of forty (40) feet in length with a forty (40) maneuvering
area for industrial, warehousing and similar uses, or truck spaces
of twenty -five (25) feet in length with a thirty (30) foot
maneuvering area for retail, commercial, general offices, public
facilities and other similar uses.
If the property owner elects to construct a building with the
smaller standards he will be required to post signs at the driveway
entrances giving notice of the truck size restriction and recording
a covenant restricting the length of trucks that may enter the
property. Additionally these smaller lots would be allowed to
utilize a public or private alley to satisfy a portion of their
unobstructed maneuvering space requirement. With these new
standards the vast majority of properties within Vernon may now be
developed. The handful of properties that cannot meet these new
requirements are of such odd shape that it is impractical for them
to be developed and they should be consolidated into a larger lot
for proper development.
Finally, It is recommended that we amend Section 26.4.2 -6,

Automobile parking requirements. We are recommending that the
language be changed to clarify the intent. The uses listed in the
automobile parking requirements will be changed to reflect
allowable uses as listed in the various zones. The Community
Services Department was considering changing the parking
requirements for warehouses, wholesale uses, refrigerated
warehouses and similar uses, however it was determined that further
study will be needed and that no changes to the minimum number be
made at this time.
The attached Exhibit "A" outlines the language for the
proposed amendments.

At the City Council meeting of August 15, 1995, you were advised
that staff has reviewed the development standards and parking and
loading requirements of the Comprehensive Zoning Ordinance as it
pertains to smaller parcels, and it was determined that the truck
loading, parking, and maneuvering requirements would preclude
these parcels from being developed.
The Community Services Department, in conjunction with the City
Attorney's office has designed new development standards,
parking, and loading requirements. These new standards will
allow lots that contain less than 12,000 square feet of gross
floor area to utilize smaller trucks. The type of uses will
determine the size of the trucks, i.e., office, commercial, and
similar uses will only require 25 foot truck spaces and 30 foot
maneuvering areas; all other uses will require 40 foot spaces
with 40 foot maneuvering areas. All buildings, regardless of
size, will be required to provide adequate truck loading and,
dependent on the use, may require truck parking.
It has also been determined that Sections 26.5.3 -2, 26.5.3 -5,
26.5.3 -6 and 26.5.3 -7 which pertain to zoning ordinance
amendments need to conform with procedures for adopting an
ordinance as set forth in Article IV of the Charter of the City
of Vernon. It is hereby recommended that the changes addressed
hereon be approved and that Sections 26.2.16, 26.4.2 -6, 26.4.2 -7,
26.4.2 -8, 26.5.3 -2, 26.5.3 -3, 26.5.3 -5, 26.5.3 -6, and 26.5.3 -7 of
the Comprehensive Zoning Ordinance be amended and that Section
26.4.2 -9 be added.

amendments. It has been determined that the procedures are
inconsistent with, and need to be conformed with, the procedures
for adopting an ordinance as set forth in Article IV of the
Charter of the City of Vernon. This has been reviewed by the
City Attorney and it is recommended that Ordinance No. 1033 be
adopted amending the above referenced sections.

The City of Vernon adopted its most recent zoning ordinance on
April 18, 1989. Minor amendments to clarify the ordinance were

In Reply Refer to:
Staff has reviewed the truck parking and loading space requirements of
the Code of the City of Vernon, and determined that the current truck
loading, parking, and maneuvering requirements preclude smaller
parcels from being developed.
New development standards have been designed allowing lots that
contain less than 12,000 square feet of gross floor area to utilize
smaller trucks. Office, commercial, and similar uses will require
only 25 foot truck spaces and 30 foot maneuvering areas and will be
given relief from the truck parking requirements. All other uses will
require 40 foot spaces with 40 foot maneuvering areas.
This has been reviewed by the Acting Director of Community Services
and the City Attorney, and it is hereby recommended that the new
parking requirements and development standards be approved and that
Code Sections 26.4.2 -7 and 26.4.2 -8 be amended to reflect the changes
and that Section 26.4.2 -9 be added. The changes are exempt from the
California Environmental Quality Act since they are minor.

SUBJECT: ZONING ORDINANCE CHANGE
The City of Vernon adopted its most recent Zoning Ordinance
on April 18, 1989. Minor amendments to clarify the ordinance
were made on October 22, 1991 and March 25, 1994. Recently the
Community Services Department has begun to review the truck
parking and loading space requirements of the code. Property
owners of smaller parcels have approached the City to determine
how their sites could be developed. Upon examination of the code
as it exists today it was determined that the current truck
loading, parking and maneuvering requirements would preclude
these parcels from being developed. The space required for
maneuvering and parking of trucks could not be attained on these
smaller parcels.
With the understanding that smaller buildings do serve a
beneficial use to the City, a remedy was sought. Working with
the City Attorney's office the Community Services Department has
designed new development standards and parking and loading
requirements. The new standards allow lots that contain less
than 12,000 square feet of gross floor area to utilize smaller
trucks. The type of use will dictate the size of trucks.
Office, commercial and similar uses will only require 25 foot
truck spaces and 30 foot maneuvering areas. All other uses will
require 40 foot spaces with 40 foot maneuvering areas. Office
and commercial uses will be given relief from the truck parking
requirements.
It is my recommendation that the City Council approve new
parking requirements and development standards. This requires
code Sections 26.4.2 -7, Minimum Truck Parking and Loading
Facility Requirements and 26.4.2 -8, Development Standards to be
changed. The City Attorney will prepare the required ordinance.
The changes are exempt from the California Environmental Quality
Act since they are minor in nature.
