AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE CODE OF THE CITY OF VERNON,
CALIFORNIA, 1959, BY AMENDING SECTIONS 26.5.3-2,
26.5.3-3, 26.5.3-5, 26.5.3-6 AND 26.5.3-7 TO
CHAPTER 26 OF SAID CODE REGARDING ZONING
AMENDMENTS AND REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT THEREWITH

WHEREAS, the Comprehensive Zoning Ordinance of the City
8
of Vernon was adopted on April 18, 1989, by Ordinance No. 982; and
9
WHEREAS, certain sections of the Comprehensive Zoning
10
11
Ordinance pertaining to zoning amendments need to be clarified and
brought into conformity with each other; and
12
WHEREAS, the procedures for initiating a zoning amendment
13
by the City Council are inconsistent with and need to be conformed
14
with the procedures for adopting an ordinance set forth in Article
15
16
IV of the Charter of the City of Vernon; and
WHEREAS, the Acting Director of Community Services has
17
recommended that the changes set forth herein be made.

THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:

SECTION 1: The City Council of the City of Vernon hereby
20

finds and determines that the recitals contained hereinabove are
true and correct.
22
SECTION 2: The City Council of the City of Vernon hereby
23
amends sections 26.5.3-2, 26.5.3-3, 26.5.3-5, 26.5.3-6 and 26.5.3-
24
7 of Chapter 26 of the Code of the city of Vernon, California,

1959, regarding the zoning Amendment procedure to read as follows:
Sec. 26.5.3-2. Amendments. Amendments of this chapter and
27
the map which is a part hereof, may be adopted as follows:

(a) An amendment may be initiated by the verified
application of the owner or owners of property which is proposed
to be changed or reclassified, whenever an amendment, supplement
to, or change in the regulations prescribed for the property is
desired; or
(b) The city council may introduce and adopt an
ordinance as provided in the city charter.
Sec. 26.5.3-3. Hearing notice. Upon presentation of a
completed application by the owner or owners of property, the city
clerk shall set the matter for public hearing.within sixty days
and shall give notice of the time and place of the hearing and the
purpose thereof in the manner described in section 26.5.1-4.
Sec. 26.5.3-5. City council to announce decision after the
public hearing. The city council shall announce its decision and
if approval of the amendment is granted, shall adopt an ordinance
incorporating the decision. The ordinance shall recite the facts
and reasons which, in the opinion of the city council make the
approval of the application for the amendment necessary to carry
out the general purpose of this chapter.
Sec. 26.5.3-6. Notice of decision of city council. At the
time the ordinance becomes effective, one copy of such ordinance
shall be forwarded to the applicant at the address shown upon the
application.
Sec. 26.5.3-7. Map modification. If the amendment involves
an amendment to the official zoning map, the community services
department immediately following the effective date of the
ordinance shall cause the official zoning map to be so modified.

1 Copies of the modified map shall be available to the public on
2 request.
3 SECTION 3: All zoning amendment ordinances which have
4 been adopted by a procedure consistent with Article IV of the
5 Charter are hereby ratified.
6 SECTION 4: Any ordinance, part of an ordinance, or code
7 section in conflict with this ordinance is hereby repealed.
8 SECTION 5: If any section, subsection, sentence, clause,
9 or phrase or word of this ordinance is for any reason held to be
10 void or unconstitutional, such decision shall not affect the
11 validity of the remaining portions of this ordinance; it being the
12 intention of the city Council of the City of Vernon to adopt and
13 pass this ordinance and each section, subsection, sentence, clause
14 or phrase thereof irrespective of the fact that one or more of the
15 sections, subsections, clauses, sentences or phrases thereof may
16 be declared void or unconstitutional.
17 SECTION 6: There being no newspaper printed, published
18 or circulated in the City of Vernon, the City Clerk is hereby
19 directed to certify to the passage of this ordinance and shall
20 post the same, or cause the same to be posted, within fifteen (15)
21 days after its passage in accordance with section 36933 of the
22 Government Code, in three (3) of the most public places in the
23 city of Vernon, to wit: the northwest corner of 38th Street and
24 Santa Fe Avenue, the northeast corner of Leonis Boulevard and
25 Pacific Boulevard, and on the bulletin board in the lobby of the
26 City Hall of said city, located at 4305 Santa Fe Avenue, all in
27 the City of Vernon, County of Los Angeles, State of California.

SECTION 7: This ordinance shall be in full force and
2 effect thirty (30) days from and after its passage of the same.
