AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING, ADDING, AND RENUMBERING VARIOUS
SECTIONS IN CHAPTER 7, BUILDINGS, OF THE CODE OF
THE CITY OF VERNON; ADOPTING BY REFERENCE THE
1994 EDITION OF THE UNIFORM FIRE CODE, VOLUMES 1
AND 2, INCLUDING SPECIFIED APPENDICES AND THE
UNIFORM FIRE CODE STANDARDS; AND REPEALING ALL
ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
THEREWITH

8 WHEREAS, Section 7.4 of the City of Vernon Charter provides
9 that the City Council shall provide for officers of the City and
10 shall fix the duties, tenure and compensation of such officers by
11 ordinance; and
12 WHEREAS, the City of Vernon by Ordinance 1013 adopted the
13 Uniform Fire Code, 1991 Edition, including specified Appendices, and
14 the Uniform Fire Code Standards; and
15 WHEREAS, the 1994 Editions of the Uniform Fire Code (Vol.
16 1) and Uniform Fire Code Standards (Vol. 2), copyrighted by the
17 International Conference of Building Officials and the Western Fire
18 Chiefs Association, have been issued; and
19
WHEREAS, the City Council of the city of Vernon is
20 authorized, pursuant to Section 50022.2, et seq. of the California
21 Government Code and Section 13143.2(b) of the California Health and
22 Safety Code, to adopt said codes by reference and to amend them; and
23 WHEREAS, miscellaneous changes to Chapter 7, Buildings, of
24 the Code of the City of Vernon are necessary to clarify and to
25 improve the effectiveness of the code; and
26 WHEREAS, the City Council has adopted Ordinance No. 1036
27 conSOlidating other uniform codes under Chapter 24, Building and
28 Construction, of the Code of the City of Vernon; and

1 WHEREAS, pursuant to Government Code section 50022.3, the
2 city council on February 20, 1996, gave a first reading for the
3 title of this Ordinance and the title of said code and standards and
4 scheduled a public hearing for March 5, 1996 at 5:00 p.m.; in
5 accordance therewith notice was duly published on February 22, 1996,
6 and the public hearing was held for the purpose of considering the
7 adoption of the 1994 Edition of the Uniform Fire Code, Volume 1,
8 including Appendices I-A, I-C, II-A, II-B, II-D, II-E, II-F, II-G,
9 II-H, II-I, III-A, III-B, III-C, III-D, IV-A, V-A, VI-A, VI-B, VI-D,
10 VI-F and VI-G and Volume 2 with the Uniform Fire Code Standards,
11 copyrighted by the International Conference of Building Officials
12 and the Western Fire Chiefs Association.
13 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
14 SECTION 1: The City Council of the City of Vernon hereby
15 finds and determines that the recitals contained hereinabove are
16 true and correct.
17 SECTION 2: Chapter 7, Buildings, of the Code of the City
18 of Vernon is hereby amended as follows:
19 A. The title of Chapter 7 is changed from "Buildings" to
20 "Fire Regulations."
21 B. Article I, In General, and sections 7.1 and 7.2 are
22 hereby added to said Chapter 7 as follows:
23 Sec. 7.1. Fire department.
24 There is hereby created and ratified in the service
25 of the city the fire department. The fire chief shall
26 administer the fire department of the city subject to the
27 provisions of section 2.8 of the Code of the City of
28 Vernon.

1 Sec. 7.2. Fire chief: duties.
2 Except as otherwise provided, the fire chief shall
3 enforce the fire regulations of the city and shall perform
4 such other duties as set forth in state statutes or as
5 prescribed by the city council.
6 C. Existing Section 7.68 shall become Section 7.3 of
7 said Article I, In General.
8 D. Existing Section 7.82 shall become Section 7.4 of
9 said Article I, In General, and is amended to read as follows:
10 Sec. 7.4. violations and penalties.
11 No person, firm or corporation, whether as owner,
12 lessee, sublessee or occupant, shall erect, construct,
13 enlarge, alter, repair, move, improve, remove, demolish,
14 equip, use, occupy or maintain any building or premises, or
15 causes or permit the same to be done, contrary to or in
16 violation of any of the provisions of the Fire Code or any
17 order issued by the fire chief or the building official
18 thereunder. Any person violating the provisions of this
19 section shall be guilty of a misdemeanor for each day such
20 violation continues.
21 SECTION 3: Chapter 7 of the Code of the City of Vernon and
22 Article VI thereof are amended as follows:
23 A. Article VI, Fire Code, of Chapter 7 is hereby
24 reconstituted as Article II, Fire Code, of Chapter 7.
25 B. Existing section 7.61 shall become section 7.10 of
26 said Article II, Fire Code, of Chapter 7 and is amended to read as
27 follows:

1 Sec. 7.10. Uniform Fire Code, 1994 Edition, adopted.
2 The 1994 Edition of the Uniform Fire Code, Volume 1,
3 including Appendices I-A, I-C, II-A, II-B, II-D, II-E, 11-
4 F, II-G, II-H, II-I, III-A, III-B, III-C, III-D, IV-A, V-A,
5 VI-A, VI-B, VI-D, VI-F and VI-G and Volume 2, the Uniform
6 Fire Code Standards, copyrighted by the International
7 Conference of Building Officials and the Western Fire
8 Chiefs Association, except as provided in this article, are
9 adopted as the Fire Code of the City of Vernon.
10 C. Existing Section 7.62 shall become Section 7.11 of
11 said Article II, Fire Code, of Chapter 7.
12 D. Existing Section 7.64 shall become section 7.12 of
13 said Article II, Fire Code, of Chapter 7 and is amended to read as
14 follows:
15 Sec. 7.12. Amendments, additions, and deletions.
16 The Uniform Fire Code, 1994 Edition, is amended as follows:
17 (a) Uniform Fire Code section 101.5 is amended to delete
18 the clause at the end of the first paragraph which
19 reads: "and any judgment resulting therefrom shall be
20 assumed by this jurisdiction."
21 (b) Uniform Fire Code sections 103.1.4 and 103.4.6 are
22 hereby deleted.
23 (c) Uniform Fire Code section 105.8 is amended by adding
24 the following activities to the specified
25 subparagraphs:
26 Sec. 105.8. Permit required.
27 f. 6. Fire extinguishing and protection systems of all
28 types.

(d) Uniform Fire Code section 902.2.2.1 is hereby amended
to read as follows:
Sec. 902.2.2.1. Dimensions.
Fire apparatus access roads shall have an unobstructed
width of not less than 20 feet (6096mm) and an unobstructed
vertical clearance of not less than 15 feet (4572mm).
(e) Uniform Fire Code section 4502.1 is hereby amended to
read as follows:
Sec. 4502.1. Location of spray-finishing operations.
All inside or outside spray-finishing operations shall
be conducted in an approved spray booth constructed in
accordance with all applicable codes.
(f) Uniform Fire Code section 7701.7 is hereby amended to
read as follows:
Sec. 7701.7. Prohibited and limited acts.
Explosive materials shall not be manufactured, tested
or stored within the limits of the City of Vernon.
(g) Uniform Fire Code section 7902.2.2.1 is hereby amended
to read as follows:

1 Sec. 7902.2.2.1. storage of Class I and Class II
2 liquids.
3 storage of Class I and Class II liquids in aboveground
4 tanks outside of buildings is permitted within the limits
5 of the City of Vernon except within the shaded areas shown
6 on Exhibit "A", which is attached hereto and made a part
7 hereof by reference.
8 EXCEPTION: storage of Class I and Class II liquids not
9 exceeding two (2) 1,000 gallon tanks per parcel in approved
10 containers is permitted in all areas within the limits of
11 the City of Vernon.
12 (h) Uniform Fire Code section 8204.1 is hereby amended to
13 read as follows:
14 Sec. 8204.1. storage of liquified petroleum gases.
15 Storage and transportation of Lp-gas and the
16 installation and maintenance of pertinent equipment shall
17 be in accordance with U.F.C. standard No. 82-1. Storage is
18 permitted within the limits of the City of Vernon except
19 within the shaded areas shown on Exhibit "A", which is
20 attached hereto and made a part hereof by reference.
21 EXCEPTION: Storage of Lp-gas not exceeding 2,000 gallons
22 per parcel in approved containers is permitted in all areas
23 within the limits of the City of Vernon.
24 (i) Uniform Fire Code Appendices I-B, II-C, IV-B, VI-C,
25 and VI-E are hereby deleted.
26 E. Existing Exhibit F of Chapter 7 is deleted, having
27 been replaced by Exhibit A.
28 F. Existing section 7.67 shall become Section 7.13 of

said Article II, Fire Code, of Chapter 7.
SECTION 4: Enactment of Penalty sections.
Pursuant to Government Code section 50022.4 the following
penalty sections are specifically enacted and published as set forth
in Exhibit B attached hereto, except as otherwise amended or deleted
in this ordinance: Uniform Fire Code, 1994 Edition, sections 103.2,
103.3, 103.4, 104 and 105.7.
SECTION 5: Ordinances repealed.
Any ordinance, part of an ordinance, or code section in
conflict with this Ordinance is hereby repealed.
SECTION 6: violation.
A violation of this ordinance or any part hereof is
punishable by a fine of not more than Five Hundred Dollars ($500.00)
or by imprisonment in the County Jail for a period of not more than
six (6) months, or by both such fine and imprisonment. Each day or
any portion thereof during which any violation of any provision of
this ordinance is committed, continued or permitted, constitutes a
separate and individual offense.
SECTION 7: Severability.
If any section, subsection, sentence, clause, or phrase or
word of this ordinance is for any reason held to be void or
unconstitutional, such decision shall not affect the validity of the
remaining portions of this ordinance; it being the intention of the
City Council of the City of Vernon to adopt and pass this ordinance
and each section, subsection, sentence, clause or phrase thereof
irrespective of the fact that one or more of the sections,
subsections, clauses, sentences or phrases thereof may be declared
void or unconstitutional.

1 SECTION 8: Renumberinq Shall Not Chanqe Code Provisions.
2 The renumbering of any article or section of the Code of
3 the City of Vernon shall not constitute a change in its intent or
4 purpose, and it shall have the same effect and enforceability as if
5 it had never been renumbered. Any code section numbers not used
6 shall be reserved for future use.
7 SECTION 9: Copies on File with city Clerk.
8 Pursuant to Government Code section 50022.6, one certified
9 copy of the 1994 Edition of the Uniform Fire Code with the Uniform
10 Fire Code Standards shall be made available for public inspection in
11 the office of the City Clerk for at least fifteen (15) days prior to
12 the hearing.
13 SECTION 10: Postinq.
14 There being no newspaper printed, published or circulated
15 in the City of Vernon, the City Clerk is hereby directed to certify
16 to the passage of this ordinance and shall post the same, or cause
17 the same to be posted, within fifteen (15) days after its passage in
18 accordance with Section 36933 of the Government Code, in three (3)
19 of the most public places in the City of Vernon, to wit: the
20 northwest corner of 38th Street and Santa Fe Avenue, the northeast
21 corner of Leonis Boulevard and Pacific Boulevard, and on the
22 bulletin board in the lobby of the city Hall of said city, located
23 at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los
24 Angeles, State of California.

SECTION 11: Effective Date.
2 This ordinance shall be in full force and effect thirty
3 (30) days from and after its passage of the same.

PART I
GENERAL
ARTICLE 1 - ADMINISTRATION
SECTION 103 - INSPECTION AND ENFORCEMENT
103.2 Authority for Inspection and Enforcement.
103.2.1 Authority of the chief and the fire department.
103.2.1.1 General. The chief is authorized to administer and enforce [his code. Under the chief's
direction, the fire department is authorized to enforce all ordinances of the jurisdiction pertaining
to:
1. The prevention of fires,
2. The suppression or extinguishment of dangerous or hazardous fires,
3. The storage, use and handling of hazardous materials,
4. The installation and maintenance of automatic, manual and other private fire alarm systems
and fire-extinguishing equipment,
5. The maintenance and regulation of fire escapes,
6. The maintenance of fire protection and the elimination of fire hazards on land and in build-
ings, structures and other property, including those under construction.
7. The maintenance of exits, and
8. The investigation of the cause, origin and circumstances of fire and unauthorized releases of
hazardous materials.
For authority related to control and investigation of emergency scenes, see Section 104.
103.2.1.2 Fire prevention bureau personnel and police. The chief and members of the fire pre-
vention bureau shall have the powers of a police officer in performing their duties under this code.
When requested to do so by the chief, the chief of police is authorized to assign such available
police officers as necessary to assist the fire department in enforcing the provisions of this code.
103.2.2 Organization of the fire prevention bureau.
103.2.2.1 General. A fire prevention bureau established within the fire department under the di-
rection of the chief shall consist of fire department personnel assigned thereto by the chief. The
function of this bureau shall be to assist the chief in the administration and enforcement of the provi-
sions of this code.
103.2.2.2 Fire marshal. The chief is authorized to designate a member of the fire department to
exercise the powers and perform the duties of fire prevention engineer as set forth in this code. The
fire prevention engineer could also be known as fire marshal.

103.3 Inspection.
103.3.1 General.
103.3.1.1 Authority to inspect. The fire prevention bureau shall inspect, as often as necessary,
buildings and premises, including such other hazards or appliances designated by the chief for the
purpose of ascertaining and causing to be corrected any conditions which would reasonably tend to
cause fire or contribute to its spread, or any violation of the purpose or provisions of this code and of
any other law or standard affecting firesafety.
103.3.1.2 Right of entry. Whenever necessary to make an inspection to enforce any of the
provisions of this code, or whenever the chief has reasonable cause to believe that there exists in any
building or upon any premises any condition which makes such building or premises unsafe, the
chief is authorized to enter such building or premises at all reasonable times to inspect the same or to
perform any duty authorized by this code, provided that if such building or premises is occupied, the
chief shall first present proper credentials and demand entry; and if such building or premises IS
unoccupied. the chief shall first make a reasonable effort to locate the owner or other persons having
charge or control of the building or premises and demand entry. If such entry is refused, the chief
shall have recourse to every remedy provided by law to secure entry.
If the owner or occupant denies entry, the chief is authorized to obtain a proper inspection warrant
or other remedy provided by law to secure entry. Owners, occupants or any other persons having
charge. care or control of any building or premises shall, after proper request is made as herein pro-
vided, promptly permit entry therein by the chief for the purpose of inspection and examination
pursuant to this code.
For the purpose of Section 103.3.1.2, the term "chief' shall include the chief officer of the fire
department serving the jurisdiction and the officers named in Sections 103.2.1.2 and 103.2.2.2.
103.3.2 New construction and alterations.
103.3.2.1 General. Construction or work for which fire department approval is required shall be
subject to inspection by the chief and such construction or work shall remain accessible and
exposed for inspection purposes until approved by the chief.
Approval as a result of an inspection shall not be construed to be an approval of a violation of the
provisions of this code or of other ordinances of the jurisdiction. Inspections presuming to give
authority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction
shall not be valid.
It shall be the duty of the permit applicant or contractor or both to cause the work to remain
accessible and exposed for inspection purposes. Neither the chief nor the jurisdiction shall be liable
for expense entailed in the removal or replacement of any material required to allow inspection.
103.3.2.2 Inspection requests. It shall be the duty of the person doing the work authorized by a
permit to notify the chief that such work is ready for inspection. The chief is authorized to require
that every request for inspection be filed not less than one working day before such inspection is
desired. Such requests may be in writing or by telephone at the option of the chief.
It shall be the duty of the person requesting any required inspections to provide access to and
means for proper inspection of such work.
103.3.3 Firesafety during construction and alterations. Firesafety during construction, alter-
ation or demolition of a building shall be in accordance with Article 87.
103.3.4 Records. The fire prevention bureau shall retain for not less than three years a record of
each inspection made showing the findings and disposition of each inspection made.

103.4 Enforcement.
103.4.1 Authorization to issue corrective orders and notices.
103.4.1.1 General. When the chief finds in any building or on any premises combustible, hazard-
ous or explosive materials or dangerous accumulations of rubbish; or finds unnecessary accumula-
tions of wastepaper, boxes, shavings or any highly flammable materials which are so situated as to
endanger life or property; or finds obstructions to or on fire escapes, stairs, passageways, doors or
windows that reasonably tend to interfere with the operations of the fire department or the egress of
the occupants of such building or premises; or finds that the effectiveness of any exit door, attic
separation or any fire separation wall is reduced; or finds that this code is being violated, the chief is
authorized to issue orders as necessary for the enforcement of the fire prevention laws and ordi-
nances governing the same and for the safeguarding of life and property from fire.

103.4.1.2 Unsafe heating or electrical equipment and structural hazards. When the chief
deems any chimney, smokestack, stove, oven, incinerator, furnace or other heating device, electric
fixture or any appurtenance thereto, or anything regulated under a nationally recognized standard in
or upon any building, structure or premises not specifically mentioned in this code, to be defective
or unsafe so as to create a hazard, the chief is authorized to serve upon the owner or the person hav-
ing control of the property a written notice to repair or alter as necessary and shall notify any other
authority enforcing codes regulating such equipment. The chief is authorized to affix a condemna-
tion tag prohibiting the use thereof until such repairs or alterations are made. When affixed, such tag
shall only be removed by the order of the chief when the hazard to which the order pertains has been
eliminated in an approved manner. Until removed, that item or device which has caused the hazard
shall not be used or be permitted to be used.
When an apparent structural hazard is caused by the faulty installation, operation or malfunction
of any of the items or devices listed in this subsection, the chief shall immediately notify the build-
ing official to investigate such hazard and cause such hazard to be abated as required by the Build-
ing Code.
103.4.1.3 Stopping uses, evacuation. The chief is authorized to order an operation or use stopped
or the evacuation of any premises, building or vehicle or portion thereof which has or is a fire haz-
ard.
103.4.1.4 Time limit for corrective orders. Orders or notices shall set forth a time limit for com-
pliance dependent upon the hazard and danger created by the violation.
103.4.2 Service of orders and notices. Orders and notices authorized or required by this code
shall be given or served upon the owner, operator, occupant or other person responsible for the con-
dition or violation either by verbal notification, personal service, or delivering the same to and leav-
ing it with a person of suitable age and discretion upon the premises; or, if no such person is found on
the premises, by affixing a copy thereof in a conspicuous place on the door to the entrance of said
premises and by mailing a copy thereof to such person by registered or certified mail to the person's
last known address.
Orders or notices which are given verbally shall be confinned by service in writing as herein pro-
vided.

103.4.3 Compliance with orders, notices and tags.
103.4.3.1 Compliance with orders and notices. Orders and notices issued or served as provided
by this code shall be complied with by the owner, operator, occupant or other person responsible for
the condition or violation to which the order or notice pertains. In cases of extreme danger to per-
sons or property, immediate compliance is required.
If the building or other premises is not owner occupied, under lease or otherwise, and the order or
notice requires additions or changes in the building or premises which would immediately become
real estate and be the property of the owner of the building or premises, such orders or notices shall
be complied with by the owner.
EXCEPTION: When the owner and the occupant have agreed otherwise between themselves, in which
event the occupant shall comply.
103.4.3.2 Compliance with tags. A building, premises or thing shall not be used when in viola-
tion of this code as noted on a tag affixed in accordance with Section 103.4.1.
103.4.3.3 Removal and destruction of signs and tags. A sign or tag posted or affixed by the chief
shall not be mutilated, destroyed or removed without authorization by the chief.
103.4.4 Citations. Persons operating or maintaining an occupancy, premises or vehicle subject to
this code who allow a hazard to exist or fail to take immediate action to abate a hazard on such occu-
pancy, premises or vehicle when ordered or notified to do so by the chief shall be guilty of a
misdemeanor.
103.4.5 Unsafe buildings. Buildings or structures which are structurally unsafe or not provided
with adequate egress, or which constitute a fire hazard or are otherwise dangerous to human life, or
which in relation to existing use constitute a hazard to safety or health or public welfare, by reason
of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster damage or
abandonment as specified in this code or any other ordinance, are. for the purpose of Section
103.4.5. unsafe buildings. Such unsafe buildings are hereby declared to be public nuisances and
shall be abated by repair, rehabilitation. demolition or removal. See the procedure speci fied in
Chapters 4 through 9 of the Uniform Code for the Abatement of Dangerous Buildings.
103.4.6 Appeals. For appeals, see Section 103.1.4.
SECTION 104 - CONTROL AND INVESTIGATION OF EMERGENCY SCENES
104.1 Authority at Fires and Other Emergencies.
104.1.1 General. The chief or officer of the fire department in charge at the scene of a fire or other
emergency involving the protection of life or property or any part thereof, shall have the authority to
direct such operation as necessary to extinguish or control any fire. perfonn any rescue operation,
investigate the existence of suspected or reported fires, gas leaks or other hazardous conditions or
situations or of taking any other action necessary in the reasonable performance of duty. In the exer-
cise of such power, the chief is authorized to prohibit any person, vehicle, vessel or thing from ap-
proaching the scene and is authorized to remove orcause to be removed or kept away from the scene
any vehicle, vessel or thing which could impede or interfere with the operations of the fire depart-
ment and, in the judgment of the chief, any person not actually and usefully employed in the extin-
guishing of such fire or in the preservation of property in the vicinity thereof.

104.1.2 Interference. The operations of the fire department in connection with extinguishing any
fire or other emergency shall not be obstructed. Lawful commands of the chief or officer of the fire
department in charge at such a scene. or any part thereof, or any police officer assisting the fire de-
partment, shall not be disobeyed.
104.1.3 Barricades. The chief or officer of the fire department in charge at the scene of an emer-
gency is authorized to place ropes, guards, ban"icades or other obstructions across any street, alley,
place or private property in the vicinity of such operation so as to prevent accidents or interference
with the lawful efforts of the fire department to manage and control the situation and to handle fire
apparatus.
104.2 Investigations. The fire department is authorized to investigate promptly the cause, origin
and circumstances of each and every fire occurring in the jurisdiction involving loss of life or injury
to person or destruction or damage to property and, if it appears to the bureau of investigation that
such fire is of suspicious origin, they are authorized to take immediate charge of all physical
evidence relating to the cause of the fire and are authorized to pursue the investigation to its
conclusion.
The chief is authorized to investigate the cause, origin and circumstances of unauthorized
releases of hazardous materials.
The police department is authorized to assist the fire department in its investigations when
requested to do so.
104.3 Records and Reports.
104.3.1 Fire occurrences. The fire department shall keep a record of fires occurring within its
jurisdiction and of facts concerning the same, including statistics as to the extent of such fires and
the damage caused thereby, together with other information as required by the chief.
104.3.2 Record retention. The fire department shall retain for not less than three years a record of
each investigation made showing the cause, the findings and disposition of each investigation.
105.7 ~evocation of Permits. The chief is authorized to suspend or revoke a permit when it is
determmed after a hearing by the chief that:
1. The permit has been used by a person other than the person to whom the permit was issued,
2. The permit has been used for a location other than that for which it was issued,
3. Any of the conditions or limitations set forth in the permit have been violated,
4. The p~rmittee fail~~, refused or neglected to comply with orders or notices duly served in ac-
cordance WIth the proVISIOns of this code within the time provided therein, or
5. There ~as been a false statement or misrepresentation as to a material fact in the application or
plans on whIch the permit or application was based.
