Ordinance No. 1041 1 ORDINANCE NO. 1041 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZING AN APPLICATION FOR FUNDING AND APPROVING ADHERENCE TO THE BOARD OF CORRECTIONS STANDARDS FOR CORRECTIONS OFFICERS 4 5 6 WHEREAS, California Penal Code Section 6041 requires that 7 each city in the State of California which applies for funding with regard to costs of correction officer training adopt an ordinance 8 which provides that the city will adhere to the standards adopted by 9 the Board of Corrections of the State of california; and 10 WHEREAS, the Policies for and Procedures Manual 11 Participating Departments was adopted by the Board of Corrections on 12 January 1, 1987; and 13 WHEREAS, said manual contains standards for the selection 14 and training of corrections personnel, as well as forms for the 15 application, for quarterly reports, and for an annual report; and 16 WHEREAS, the Board of Corrections provides subventions for 17 the cost of correction officer training, which funds are derived 18 from penalty assessments paid by persons convicted of crimes; and 19 WHEREAS, Penal Code Section 6042 provides that such 20 subventions can be allocated only to agencies which adhere to the 21 Board of Corrections standards; and 22 WHEREAS, the Board of Corrections standards provide that a 23 city may withdraw from the program upon forty-five (45) days notice 24 in writing; and 25 WHEREAS, it will benefit the jail administration and 26 correction officer training of the City of Vernon Police Department 27 to participate in such program. 28 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: 1 SECTION 1: The city Council of the City of Vernon hereby 2 finds and determines that the recitals contained hereinabove are 3 true and correct. 4 SECTION 2: The Chief of Police is authorized to file an 5 application for funding from the California Board of Corrections for 6 corrections officer selection and training. with the consent of the 7 City Council, the Chief of Police may file notice of withdrawal from 8 such program. 9 SECTION 3: While receiving state aid pursuant to Article 10 3, "Corrections Training Fund," of Chapter 5 of Title 7 of Part 3 of 11 the Penal Code of the State of California (commencing with section 12 6040), the City of Vernon will adhere to the standards for selection 13 and training of corrections officers established by the California 14 Board of Corrections. 15 SECTION 4: Any ordinance, part of an ordinance, or code 16 section in conflict with this Ordinance is hereby repealed. 17 SECTION 5: If any section, subsection, sentence, clause, 18 or phrase or word of this ordinance is for any reason held to be 19 void or unconstitutional, such decision shall not affect the 20 validity of the remaining portions of this ordinance; it being the 21 intention of the City Council of the City of Vernon to adopt and 22 pass this ordinance and each section, subsection, sentence, clause 23 or phrase thereof irrespective of the fact that one or more of the 24 sections, subsections, clauses, sentences or phrases thereof may be 25 declared void or unconstitutional. 26 SECTION 6: There being no newspaper printed, published or 27 circulated in the City of Vernon, the City Clerk is hereby directed 28 to certify to the passage of this ordinance and shall post the same, -2- 1 or cause the same to be posted, within fifteen (15) days after its 2 passage in accordance with Section 36933 of the Government Code, in 3 three (3) of the most public places in the City of Vernon, to wit: 4 the northwest corner of 38th Street and Santa Fe Avenue, the 5 northeast corner of Leonis Boulevard and Pacific Boulevard, and on 6 the bulletin board in the lobby of the City Hall of said City, 7 located at 4305 Santa Fe Avenue, all in the City of Vernon, County 8 of Los Angeles, State of California. 9 SECTION 7: This ordinance shall be in full force and 10 effect thirty (30) days from and after its passage of the same. 11 APPROVED AND ADOPTED this 16 day of , 1996.
