Ordinance No. 10581 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 1058 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING A DATE FOR CERTIFICATION OF THE RESULTS OF THE CANVASS OF THE APRIL 14, 1998 GENERAL MUNICIPAL ELECTION; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY WHEREAS, a general municipal election will be held in the City of Vernon on April 14, 1998; and WHEREAS, Chapter 5.3 of the Charter of the City of Vernon provides (1) that the City Council is authorized to adopt by ordinance procedures governing municipal elections, (2) that until the City Council adopts by ordinance provisions governing municipal elections, all elections shall be held in accordance with the general laws of the State of California, and (3) that if an ordinance respecting municipal elections is adopted by the City Council thereby superseding certain provisions of the general laws governing municipal elections, the general laws so superseded as they may exist from time to time shall be applicable unless and until the City Council shall take action otherwise; and WHEREAS, Elections Code § 10262 provides that the governing body of a city conducting an election shall meet at their usual place of meeting on the first Tuesday after the election to canvass returns and to install newly elected officers; and WHEREAS, Elections Code § 10263 provides that the governing body of a city conducting an election may, in the alternative, by resolution adopted prior to the election, order the canvass to be made by the elections official prior to the first Tuesday after the election, and that, upon completion of the canvass, the elections official shall certify the results to the governing body who shall 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15' 161I' 17 18 19 20 21 22 23 24 25 26 27 28 11on the first Tuesday after the election comply with the other 11provisions of Elections Code § 10262; and WHEREAS, Chapter 3.4 of the Charter of the City of Vernon provides, as to the election of Councilmembers, (1) that the City Council shall canvass the returns of an election on the first Tuesday following a City Council election or such other date within fifteen days of the election as may be provided by ordinance, ( 2 ) that the term of each elected Councilmember shall begin at the hour of the completion of the canvass of the election returns, and (3) that each incumbent Councilmember shall serve until expiration of his or her term and until a successor qualifies; and WHEREAS, by adoption of Resolution No. 7083 on February 3, 1998, the City Council of the City of Vernon ordered the canvass of the general municipal election to be made by the City Clerk as the City's elections official and directed the City Clerk to finish the canvass of the election prior to the Tuesday following the election and certify the results to the City Council on April 21, 1998; and WHEREAS, it is the desire and the intent of the City Council that it meet on the second Tuesday following the April 14, 1998 general municipal election instead of the first Tuesday following said election for the purpose of canvassing returns, installing newly elected officers and performing the other functions and duties specified in Elections Code §§ 10262 and 10263 and Chapter 3.4 of the City Charter; and WHEREAS, Chapter 4.3 of the Charter of the City of Vernon allows an ordinance to be introduced and adopted at one meeting if it relates to an election. THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18'' 191 20 21 22 23 24 25 26 27 28 SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are �Itrue and correct. SECTION 2: With respect to the municipal election to be held on April 14, 1998, the City Council of the City of Vernon shall meet at their usual place of meeting on the second Tuesday after the election instead of the first Tuesday after the election for the purpose of canvassing returns, installing newly elected officers and performing the other functions and duties specified in Sections 10262 and 10263 of the California Elections Code and Chapter 3.4 of the City Charter. The City Council may, by resolution adopted prior to the date of said election, order the canvass to be made by the City Clerk as the elections official prior to the second Tuesday after the election and to certify the results of the canvass to the City Council upon completion thereof. SECTION 3: There being no newspaper printed, published or circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this ordinance and shall post the same, or cause the same to be posted, within fifteen (15) days after its passage in accordance with Section 36933 of the Government Code, in three (3) of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California. -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: Pursuant to Chapter 4.3(a) of the Charter of the City of Vernon, this Ordinance shall be introduced and adopted at one regular or special meeting of the City Council and shall be in full force and effect immediately upon adoption.
