ORDINANCE NO. 1066
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING SECTION 16.32 OF THE CODE OF THE
CITY OF VERNON, CALIFORNIA, 1959, TO REQUIRE
PRISONERS CONFINED IN THE CITY JAIL TO PERFORM
LABOR ON THE PUBLIC WORKS AND WAYS AS DIRECTED BY
THE CHIEF OF POLICE AND REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the City of Vernon maintains a facility in the
Police Department which, pursuant to Section 16.31 of the Vernon
City Code, has been designated as the City jail; and
WHEREAS, from time to time persons may be sentenced to
serve a period of confinement in the City jail in lieu of serving
time in the County jail, or may be ordered to serve a period of
confinement in the City jail as a condition of probation; and
WHEREAS, Section 4017 of the California Penal Code provides
in relevant part that all persons confined in a city jail under a
final judgment of imprisonment rendered in a criminal action or
proceeding and all persons confined in a city jail as a condition of
probation may be required by an order of the city council to perform
labor on the public works or ways in the city; and
WHEREAS, Section 4017 defines the term "labor on public
works" as including clerical and menial labor in a city jail; and
WHEREAS, the City Council of the City of Vernon by adoption
of Resolution No. 7211, has approved a Trusty Program developed by
the Chief of Police which establishes rules and regulations for
persons confined in the City jail who are designated as trusties,
including the obligation to work during the time of their
confinement; and
WHEREAS, it is in the interest of the public health, safety
and welfare that the City Council of the City of Vernon by this
I Ordinance, make it mandatory that persons confined in the City jail
2 who are designated as trusties perform work during the period of
3 their confinement as directed by the Chief of Police under the
4 guidelines established in the Trusty Program.
5 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
6 SECTION 1: The City Council of the City of Vernon hereby
7 finds and determines that the recitals contained hereinabove are
8 true and correct.
9 SECTION 2: Section 16.32 of the Vernon City Code is hereby
10 amended to read as follows:
11 Sec. 16.32. Feeding persons in care of Police Department;
labor upon public works and ways.

(a) Persons in the care of the police department, as
13
prisoners or otherwise, shall be provided with sufficient
14
plain and wholesome food of such variety as may be most
15
conducive to good health, in such amount and at such times
16
as the general welfare of such persons will be best served.

(b) Persons confined in the City jail under a final
18
judgment of imprisonment rendered in a criminal action or
19
proceeding and persons confined in the City jail as a
20
condition of probation after a suspension of imposition of
21
a sentence or suspension of execution of sentence shall
22
perform labor on the public works or ways in the City, as
23
directed by the Chief of Police. The term "labor on the
24
public works" includes, without limitation, clerical and
25
menial labor in and about the City jail.

SECTION 3: Any ordinance, part of an ordinance, or code
27
section in conflict with this Ordinance is hereby repealed.

SECTION 4: If any section, subsection, sentence, clause,
or phrase or word of this ordinance is for any reason held to be
void or unconstitutional, such decision shall not affect the
validity of the remaining portions of this ordinance; it being the
intention of the City Council of the City of Vernon to adopt and
pass this ordinance and each section, subsection, sentence, clause
or phrase thereof irrespective of the fact that one or more of the
sections, subsections, clauses, sentences or phrases thereof may be
declared void or unconstitutional.
SECTION 5: There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby directed
to certify to the passage of this ordinance and shall post the same,
or cause the same to be posted, within fifteen (15) days after its
passage in accordance with Section 36933 of the Government Code, in
three (3) of the most public places in the City of Vernon, to wit:
the northwest corner of 38th Street and Santa Fe Avenue, the
northeast corner of Leonis Boulevard and Pacific Boulevard, and on
the bulletin board in the lobby of the City Hall of said City,
located at 4305 Santa Fe Avenue, all in the City of Vernon, County
of Los Angeles, State of California.
SECTION 6: This ordinance shall be in full force and
effect thirty (30) days from and after its passage of the same.

RESOLUTION NO. 7211
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
IMPLEMENTATION OF A TRUSTY PROGRAM AT THE
VERNON CITY JAIL
WHEREAS, persons sentenced to a period of confinement in
the County jail may, in the discretion of the Court, serve their
sentences in a city jail; and
WHEREAS, the Vernon City jail has facilities to hold a
limited number of prisoners sentenced to serve a period of
confinement there; and
WHEREAS, the Chief of Police has proposed a Trusty
Program which establishes rules and regulations for prisoners
confined in the City jail; and
WHEREAS, it is the desire and intent of the City Council
to approve the Trusty Program as proposed by the Chief of Police,
and to authorize the Chief of Police to implement said Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF

SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The City Council of the City of Vernon
hereby approves the document entitled "Vernon Police Department
Trusty Program," a copy of which has been presented to the City
Council concurrently with this resolution, and the City Council
hereby orders the City Clerk to receive and file said document.
SECTION 3: The Chief of Police is hereby authorized to
implement the Trusty Program.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
