ORDINANCE NO. 1068
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE ZONING MAP OF THE CITY OF
VERNON TO PREZONE TERRITORY BEING ANNEXED
PURSUANT TO THE PROPOSAL DESIGNATED
"REORGANIZATION - CITY OF VERNON" INVOLVING THE
CITIES OF VERNON AND BELL
WHEREAS, by Resolution No. 7110 adopted on August 4,
1998, the City Council of the City of Vernon initiated proceedings
pursuant to the Cortese -Knox Local Government Reorganization Act
of 1985, commencing with Section 56000 of the California
Government Code, for the reorganization proposal identified as
"Reorganization - City of Vernon" in which territory will be
detached from the City of Bell and annexed to the City of Vernon;
and
WHEREAS, the Local Agency Formation Commission of the
County of Los Angeles requires that the territory proposed to be
annexed to the City of Vernon be prezoned; and
WHEREAS, descriptions and maps of the territory subject
to the reorganization are shown as Parcel 1 and Parcel 2 in
Exhibit "A" attached hereto and made a part hereof by reference;
and
WHEREAS, the City Council of the City of Vernon
heretofore approved and adopted a Negative Declaration for this
project and made appropriate findings in support thereof in
Resolution No. 7110, adopted August 4, 1998; and
WHEREAS, since adoption of the Negative Declaration,
there have been no changes in the project or its circumstances,
and no new information concerning it has become available, such

11 that no further documentation is necessary under the California
Environmental Quality Act ("CEQA"); and
WHEREAS, in accordance with Section 711.4(c) of the Fish
and Game Code, no evidence has been found that the proposed
project will have the potential for adverse effects on wildlife
resources, and the project is therefore exempt from the fees
otherwise payable under Section 711.4; and
WHEREAS, due and careful consideration has been given to
the suitability of the zoning of territory, and the General
Industrial (M) Zone regulations will best serve the use and
purpose of the parcel; and
WHEREAS, the property development standards which will be
made applicable to said parcel will preserve the community health,
safety, and general welfare and will encourage the development of
the property; and
WHEREAS, Section 26.5.3-2 of the Code of the City of
Vernon provides that the City Council may amend the zoning map by
introduction of an ordinance; and
WHEREAS, the change to the zoning map contemplated by
this ordinance is consistent with the goals and policies of the
General Plan; and
WHEREAS, the City Council held a duly noticed public
hearing in this matter at a regular meeting of the City Council on
November 3, 1998.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.

SECTION 2: Pursuant to Sections 15162 and 15164(e) of
the State CEQA Guidelines, the City Council hereby finds and
determines that no further documentation is necessary under CEQA
in addition to the Negative Declaration approved and adopted for
the project in Resolution No. 7110.
SECTION 3: Pursuant to Section 711.4(c) of the Fish and
Game Code, the City has found no evidence that the proposed
project will have the potential for adverse effects on wildlife
resources, and the project is therefore exempt from the fees
otherwise payable under Section 711.4.
SECTION 4: The City Council of the City of Vernon hereby
amends the zoning map of the Comprehensive Zoning Ordinance of the
City of Vernon and zones the territory described in Exhibit "A" by
adding said territory to the General Industry (M) Zone.
SECTION 5: This zoning of said parcel shall constitute a
prezoning which is contingent upon annexation of said territory to
the City, and shall require that the zoning map be amended upon
the effective date of the zoning designation provided for herein.
SECTION 6: Any ordinance, part of an ordinance, or code
section in conflict with this Ordinance is hereby repealed.
SECTION 7: If any section, subsection, sentence, clause,
or phrase or word of this ordinance is for any reason held to be
void or unconstitutional, such decision shall not affect the
validity of the remaining portions of this ordinance; it being the
intention of the City Council of the City of Vernon to adopt and
pass this ordinance and each section, subsection, sentence, clause
or phrase thereof irrespective of the fact that one or more of the
sections, subsections, clauses, sentences or phrases thereof may

be declared void or unconstitutional.
SECTION 8: There being no newspaper printed, published
or circulated in the City of Vernon, the City Clerk is hereby
directed to certify to the passage of this ordinance and shall
post the same, or cause the same to be posted, within fifteen (15)
days after its passage in accordance with Section 36933 of the
Government Code, in three (3) of the most public places in the
City of Vernon, to wit: the northwest corner of 38th Street and
Santa Fe Avenue, the northeast corner of Leonis Boulevard and
Pacific Boulevard, and on the bulletin board in the lobby of the
City Hall of said City, located at 4305 Santa Fe Avenue, all in
the City of Vernon, County of Los Angeles, State of California.
SECTION 9: This ordinance shall be in full force and
effect thirty (30) days from and after its passage of the same.

The City of Vernon is proposing to annex territory from the City
of Bell. As part of the Local Agency Formation Process, the City
of Vernon must pre -zone the area it is proposing to annex.

SUBJECT: ANNEXATION
The City of Vernon has commenced the process to annex two
large parcels within the City of Bell. The local Agency
Formation Commission requires that the City gaining the property
to pre -zone the territory. A public hearing must be conducted
prior to the City establishing the zoning for the area. The City
must mail a Notice to Affected Property Owners and those
properties within three hundred feet of the subject parcels.
The Community Services Department has reviewed the General
Plan and Comprehensive Zoning Ordinance and has determined that
the M-Zone is the most appropriate zoning designation.
The City Attorney's office has prepared an ordinance
establishing the zoning for the annexation area. It is
recommended that a Public Hearing be set for November 3, 1998 and
that the ordinance be approved.

PRE -ZONING OF AREAS TO BE ANNEXED FROM BELL
(October 27, 1998)
The City of Vernon is proposing to annex, certain areas from
the City of Bell. The City will be gaining two parcels.
The vast majority of Parcel 1 lies within the Los Angeles
River and cannot be developed. The parcel also includes the
Atlantic Boulevard Bridge over the Los Angeles River. See
attached Exhibit "i". The annexation will allow the City to
square off its boundaries. Parcel 1 is approximately 23 acres in
size.
Parcel 2 is generally located in the vicinity of the
intersection of Atlantic and Bandini Boulevards. The area is
shown in the attached Exhibit "2" and contains approximately 27
acres. For the most part the land is currently unimproved with
the exception of an Edison Substation. The land also includes
portions of Atlantic Boulevard and Bandini Boulevard. It is the
City of Vernon's intention to reconfigure the interchange of the
Atlantic/Bandini I-710 and extend 26th Street over Atlantic
Boulevard and connect it to Bandini Boulevard via a new local
street. A considerable amount of the construction required for
these projects will be completed on the Parcel 2 property.
The City of Vernon has three established zoning districts
with two overlay zones. The three zones are nearly identical.
The M Zone allows the following uses:
a. Industry
b. Residential dwelling, single family or independent
living facility in accordance with Sec. 26.4.5.
C. Residential unit - temporary in accordance with Sec.
26.4.5-3.
d. Public facilities.
e. Retail and commercial uses with a floor area of 10,000
square feet or less and which generate less than 20
vehicle trips per day per 1,000 square feet of floor
area.
f. Warehouses and wholesale uses including accessory
warehouses with a floor area of 50,000 square feet or
less per lot or parcel.
g. Refrigerated warehouse.
h. Vehicle sales, fabrication or repair facility.
i. General offices with a floor area of 10,000 square feet
or less.
The following uses are allowed in the M Zone with a
conditional use permit:
a. Retail and commercial uses with a floor area of more
than 10,000 square feet or which generate more than 20
vehicle trips per day per 1,000 gross square feet of
floor area.
b. Hazardous waste treatment facilities, so long as they
comply with all the requirements of state and federal
law and subject to the standards specified in Section
26.5.2-9.
C. Trash -to -energy facilities subject to the standards
specified in Section 26.5.2-9.
d. Petroleum related uses and/or uses primarily engaged in
the storage of petroleum products.
e. Public storage facilities with a floor area no greater
than 50,000 square feet per lot or parcel subject to
the standards specified in Section 26.5.2-9.
f. Cogeneration facilities, subject to the standards
specified in Section 26.5.2-9.

g. Trade schools.
h. General offices with a floor area of 10,000 square feet
or more.
i. Residential dwelling unit, multiple.
j. Accessory warehouses with a floor area of 50,000 square
feet or more per lot or parcel being operated as an
integral part of a manufacturing operation located in
the City of Vernon and storing goods produced in that
operation.
k. Recycled materials processing facility.
The M-2 Zone is nearly identical with the exception that
warehouse and wholesale uses are not limited in size and that a
residential dwelling unit, single family or independent living
facility and freight or truck terminals and other related uses
are allowed with a conditional use permit. The M-2 Zone also has
less restrictive requirements on vibrations emanating from the
site.
The C-M Zone is the same as the M Zone except that only the
following uses are permitted with a conditional use permit,
general offices in excess of 10,000 square feet, retail and
commercial uses with a floor area of more than 10,000 square feet
or which generate more than 20 vehicle trips per 1,000 gross
square feet of floor area per day, trade schools and residential
dwelling units, multiple. Additionally the building intensity is
allowed to be up to 4.0 times the buildable area of a lot instead
of the 2.0 allowed in the M Zone.
The Slaughtering Overlay Zone allows slaughtering with a
conditional use permit, the Rendering Overlay Zone allows for a

rendering plant, fertilizer plant and a junk and salvage yard
with a conditional use permit.
The Community Services Department has reviewed the sites and
has made a determination that the two parcels should be
designated M Zone. It is staff opinion that the properties
should not have any overlay districts since they border
neighboring cities and these districts would allow the siting of
uses which may have obnoxious odors, noise, vibration and
traffic. The M-2 Zone allows freight and truck terminals. The
streets in the area to be annexed are very congested. It is
staff opinion that truck terminals in this area would only
adversely impact the operation of the traffic circulation system
in this area and therefore this zoning should not be considered.
The existing development in the area are more consistent with the
M Zone than the C-M Zone and therefore the M Zone was chosen as
the most favorable designation of the areas to be annexed.

As part of the Local Agency Formation Process the City of
Vernon must pre -zone the area that it is proposing to annex from
the City of Bell.
The City Council will be conducting a Public Hearing on
Tuesday, November 3rd, regarding the pre -zoning. City staff has
prepared the attached report.
It is my recommendation that the areas be designated M-Zone.
The City Attorney has prepared the necessary ordinance to adopt
the pre -zoning designation.

ORDINANCE PREZONING TERRITORY TO BE ANNEXED
FROM THE CITY OF BELL TO THE CITY OF VERNON
NOTICE IS HEREBY GIVEN that the City Council of the City of
Vernon will hold a public hearing in accordance with Government
Code Sections 65804 and 65854 to consider adoption of an ordinance
amending the zoning map of the City of Vernon to prezone territory
being annexed to the City of Vernon pursuant to the proposal
designated "Reorganization --City of Vernon" involving the cities of
Vernon and Bell. The area subject to prezoning in this proceeding
is depicted on the map appearing before (or attached hereto marked
"Exhibit A.") If adopted, the ordinance would apply to regulations
of the General Industry (M) Zone to the subject territory effective
upon completion of the annexation proceedings.
Said hearing is scheduled for November 3, 1998, at 5:00 p.m.,
or as soon thereafter as the matter may be heard, in the City
Council Chambers located at 4305 Santa Fe Avenue, Vernon,
California 90058.
