ORDINANCE NO. 1069
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON, REPEALING ORDINANCE NO. 80, WHICH GRANTED
TO F. E. FITZPATRICK A FRANCHISE TO MAINTAIN AND
OPERATE A PIPELINE SYSTEM IN THE CITY OF VERNON
WHEREAS, on May 25, 1912, the City Council of the City of
Vernon adopted Ordinance No. 80, granting to F. E. Fitzpatrick a
franchise to maintain and operate a pipeline system in the City of
Vernon for the purpose of carrying oil along the following described
route:
Beginning at the intersection of the northerly boundary of
the corporate limits of the City of Vernon and Redondo
Branch of the Atchison, Topeka and Santa Fe R. R.; thence
in a southerly direction along private property and
adjacent to the said Atchison, Topeka and Santa Fe R. R.,
to the intersection of Pacific Boulevard and the said
Redondo Branch of the Atchison, Topeka and Santa Fe R. R.;
thence along Pacific Boulevard in a southerly direction to
the intersection of the southerly boundary of the corporate
limits of the City of Vernon, at Fruitland Road, all in
Township two (2) South, Range thirteen (13) West, S. B. B.
& M; and
WHEREAS, Mobil Oil Corporation ("Mobil") is the current
holder of the franchise rights granted by Ordinance No. 80, and
Mobil has requested that its operation of said pipeline be made
subject to Encroachment License Agreement No. 387, which the City
Council of the City of Vernon has granted or intends to grant by
adoption of Resolution No. 7237; and
1 WHEREAS, in light of the incorporation of the right to
2 operate the aforesaid pipeline in Encroachment License Agreement
3 No. 387, it is necessary and appropriate that the franchise rights
4 granted by Ordinance No. 80 be terminated.
5 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
6 SECTION 1: The City Council of the City of Vernon hereby
7 finds and determines that the recitals contained hereinabove are
8 true and correct.
9 SECTION 2: Ordinance No. 80, entitled "An Ordinance
10 granting to F. E. Fitzpatrick a franchise to maintain and operate a
11 pipe line system in the City of Vernon," dated May 25, 1912, is
12 hereby repealed.
13 SECTION 3: Any ordinance, part of an ordinance, or code
14 section in conflict with this Ordinance is hereby repealed.
15 SECTION 4: If any section, subsection, sentence, clause,
16 or phrase or word of this ordinance is for any reason held to be
17 void or unconstitutional, such decision shall not affect the
18 validity of the remaining portions of this ordinance; it being the
19 intention of the City Council of the City of Vernon to adopt and
20 pass this ordinance and each section, subsection, sentence, clause
21 or phrase thereof irrespective of the fact that one or more of the
22 sections, subsections, clauses, sentences or phrases thereof may be
23 declared void or unconstitutional.
24 SECTION 5: There being no newspaper printed, published or
25 circulated in the City of Vernon, the City Clerk is hereby directed
26 to certify to the passage of this ordinance and shall post the same,
27 or cause the same to be posted, within fifteen (15) days after its
28 passage in accordance with Section 36933 of the Government Code, in

1 three (3) of the most public places in the City of Vernon, to wit:
2 the northwest corner of 38th Street and Santa Fe Avenue, the
3 northeast corner of Leonis Boulevard and Pacific Boulevard, and on
4 the bulletin board in the lobby of the City Hall of said City,
5 located at 4305 Santa Fe Avenue, all in the City of Vernon, County
6 of Los Angeles, State of California.
7 SECTION 6: This ordinance shall be in full force and
8 effect thirty (30) days from and after passage of the same.

On December 10, 2015, ExxonMobN Oil Corporation (ExxonMobil) mailed a letter to Maria Ayala
notifying her that ExxonMobil recently entered into a Sale and Purchase Agreement with PBF
Holding Company LLC (PBF) to purchase the assets covered by License Numbers 387, 400, 405,
1714 and 1715 and Licenses Dated September 24, 1965, January 19, 1965 and March 16, 1965.
The pipeline asset will be transferred Into the name of Torrance Pipeline Company LLC (Torrance
Pipeline).This letter also stated that Torrance Pipeline would request that the franchise be
transferred to them once the sale Is finalized.
While the sale is tentatively scheduled to dose on June 1, 2016, Torrance Pipeline respectfully
requests that the City of Vemon approve the transfer from ExxonMobil to Torrance Pipeline once the
sale has been finalized.
P8F Currently operates four oil refineries in Ohio, Delaware, New Jersey and Louisiana, and has
entered into an agreement to acquire the ExxonMobil Torrance refinery. Some investrnent
