ADOPTING BY REFERENCE (1) THE 1997 EDITION OF THE UNIFORM BUILDING CODE, VOLUMES 1, 2, AND 3, INCLUDING SELECTED APPENDICES; (2) THE 1996 EDITION OF THE NATIONAL ELECTRICAL CODE, AND THE 1996 EDITION OF THE UNIFORM ADMINISTRATIVE CODE PROVISIONS FOR THE NATIONAL ELECTRICAL CODE; (3) THE 1997 EDITION OF THE UNIFORM MECHANICAL CODE, INCLUDING SELECTED APPENDICES; (4) THE 1997 EDITION OF THE UNIFORM PLUMBING CODE, INCLUDING SELECTED APPENDICES; (5) THE 1997 EDITION OF THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS; (6) THE 1997 EDITION OF APPENDIX CHAPTERS 1 AND 5 OF THE UNIFORM CODE FOR BUILDING CONSERVATION; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH WHEREAS, the City of Vernon by Ordinance No. 1036 adopted the Uniform Building Code, 1994 Edition, including selected I Appendices, Chapters 1 (I & II), 11, 12 (I, II & III), 32, and 38, I and the Uniform Building Code Standards; the Uniform Plumbing I Code, 1994 Edition, including Appendices A, B, C, D, H, I, and L; and the Uniform Code for Abatement of Dangerous Buildings, 1994 Edition; and WHEREAS, the City of Vernon by Ordinance No. 1013 adopted I the National Electrical Code, 1993 Edition, including Appendices A and B; and WHEREAS, the City of Vernon by Ordinance No. 1037 adopted I the Uniform Mechanical Code, 1994 Edition, including Appendices A, B, and C; and WHEREAS, the City of Vernon by Ordinance No. 1059 adopted I Appendix Chapter 1 of the Uniform Code for Building Conservation, 1994 Edition; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, Health and Safety Code section 18938(b) provides that the most recent editions of the Uniform Building Code, the National Electrical Code, the Uniform Plumbing Code, the Uniform Mechanical Code and Appendix Chapter 1 of the Uniform Code for Building Conservation (hereinafter the "model codes"), as referenced in the California Building Standards Code, shall apply to all occupancies in the state and shall become effective 180 days after publication in the California Building Standards Code by the California Building Standards Commission or at a later date after publication established by said Commission; and WHEREAS, the 1997 Edition of the Uniform Building Code, Volumes 1, 2, and 3, including Appendix Chapters 3, 4, 9, 11, 12, 15, 16, 18, 30, 33, and 34, has been issued by the International Conference of Building Officials and has been published in the California Building Standards Code as the 1998 California Building Code; and WHEREAS, the 1996 Edition of the National Electrical Code, including Appendices A, B and C, has been issued by the National Fire Protection Association and has been published in the California Building Standards Code as the 1998 California Electrical Code; and WHEREAS, the 1996 Edition of the Uniform Administrative Code Provisions for the National Electrical Code has been issued by the International Conference of Building Officials; and WHEREAS, the 1997 Edition of the Uniform Plumbing Code, including Appendices A, B, C, D, H, I, and L, has been issued by the International Association of Plumbing and Mechanical Officials and has been published in the California Building Standards Code -2- 1 as the 1998 California Plumbing Code; and 2 WHEREAS, the 1997 Edition of the Uniform Mechanical Code, 3 including Appendices A, B, and C, has been issued by the 4 International Conference of Building Officials and has been 5 published in the California Building Standards Code as the 1998 6 California Electrical Code; and 7 WHEREAS, the 1997 Edition of the Uniform Code for the 8 Abatement of Dangerous Buildings has been issued by the 9 International Conference of Building Officials; and 10 WHEREAS, the 1997 Edition of the Uniform Code for 11 Building Conservation has been issued by the International 12 Conference of Building Officials, and Appendix Chapter 1 of said 13 Code has been published in the California Building Standards Code 14 as the 1998 California Code for Building Conservation; and 15 WHEREAS, the 1997 Editions of the Uniform Building Code, 16 the Uniform Plumbing Code and the Uniform Code for the Abatement 17 of Dangerous Buildings are substantially the same as the 1994 18 Editions of the said Codes as adopted by City -of Vernon Ordinance 19 No. 1036; and 20 WHEREAS, said 1997 Edition of the Uniform Mechanical 21 Code is substantially the same as the 1994 Edition of said Code as 22 adopted by City of Vernon Ordinance No. 1037; and 23 WHEREAS, the 1996 Editions of the National Electrical 24 Code and the Administrative Code Provisions for the National 25 Electrical Code are substantially the same as the 1993 Editions 26 the National Electrical Code and 1993 Edition of Administrative 27 Code Provisions for the National Electrical Code as adopted by 28 City .of Vernon Ordinance No. 1013; and -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the California Building Standards Commission has established that the aforesaid model codes as published in the California Building Standards Code shall become effective July 1, 1 1999; and WHEREAS, California Health and Safety Code Sections 17958, 17958.5, 17958.7 and 18941.5 provide for certain amendments to the model codes provided findings of necessity can be made; and WHEREAS, it is in the interest of the public health, safety and welfare to enact certain amendments to the aforesaid model codes because of climatic, geological and topographical conditions, based upon the following findings: 1. Adverse climatic conditions and strong winds such as those in existence in the City of Vernon increase the likelihood of fire spreading (conflagration) from one building to another; 2. General conditions in the City of Vernon are affected by the nearby location of earthquake faults that can create tremendous loss of life and structures in the city; 3. Topographical conditions of the City of Vernon coupled with the density of buildings, limited setbacks, narrow access to buildings and narrow streets potentially create a problem for governmental agencies to respond to emergency conditions; and WHEREAS, the amendments, deletions and additions to the model codes set forth in this ordinance are intended as amendments, deletions and additions to the corresponding requirements of the California Building Standards Code, based upon the findings set forth above; and WHEREAS, the City Council is authorized pursuant to Sections 38660 and 50022.2 of the California Government Code to -4- 1' 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 adopt by reference regulations for the abatement of unsafe structures; and WHEREAS, older buildings of tilt -up concrete wall construction are recognized to be a hazard due to the potential for collapse in an earthquake; and WHEREAS, several hundred buildings in the City of Vernon are made of tilt -up concrete wall construction; and WHEREAS, property owners have voluntarily retrofitted their tilt -up concrete wall buildings; and WHEREAS, the City of Vernon currently has no retrofiting standards for tilt -up concrete wall buildings, and the City Council believes that a minimum standard should be established; and WHEREAS, Appendix Chapter 5 of the 1997 Edition of the Uniform Code for Building Conservation, published by the International Conference of Building Officials, establishes standards for earthquake hazard regulation in existing tilt -up concrete wall buildings; and WHEREAS, the City Council of the City of Vernon is authorized, pursuant to Section 50022.2, et sea. of the California Government Code to adopt the above -mentioned model codes and other uniform codes by reference; and WHEREAS, pursuant to Government Code Section 50022.3, the City Council on May 4, 1999, gave a first reading to this Ordinance and the titles of said codes and standards, and a duly noticed public hearing was held on May 18, 1999, for the purpose of considering the adoption of the 1997 Edition of the Uniform Building Code Volumes 1, 2, and 3, including Appendix Chapters 3, -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4, 91 11, 12,, 15, 16, 18, 30, 33, and 34; the 1996 Edition of the National Electrical Code, including Appendices A, B and C; the Uniform Administrative Code Provisions for the National Electrical Code, 1996 Edition; the 1997-Edition of the Uniform Mechanical Code, including Appendices A, B and C; the 1997 Edition of the Uniform Plumbing Code, including Appendices A, B, C, D, H, I, and L; Appendix Chapters 1 and 5 of the 1997 Edition of the Uniform Code for Building Conservation;, and the 1997 Edition of the Uniform Code for the Abatement of Dangerous Buildings. THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein above are true and correct. SECTION 2: Article II of Chapter 24, Building and Construction, of the Code of the City of Vernon is hereby amended as follows: A. Section 24.10 and is amended to read as follows: Sec. 24.10. Uniform Building Code, 1997 Edition, adopted. The Uniform Building Code, 1997 Edition, Volume 1, 2, and 3, including Appendices, Chapters 3, 4, 9, 11, 12, 15, 16, 18, 30, 33 and 34, copyrighted by the International Conference of Building Officials, subject, however, to the amendments, additions and deletions set forth in this article and by the State of California Building Standards Commission in the California Building Code, are hereby adopted by reference -as the Building Code of the City of Vernon. In the event of any conflict between provisions of the Uniform Building Code and a provision applicable to cities of CM. 1 the California Building Code as contained in Title 24 of the 2 California Code of Regulations, the provisions of the 3 California Building Code shall prevail. 4 B. Section 24.11 of said Article II, Building 5 Code, of Chapter 24 is hereby amended to read as follows: 6 Sec. 24.11. Building Code amendments, additions, and deletions. 7 The Uniform Building Code, 1997 Edition, is amended as 8 follows: 9 (a) Uniform Building Code Section 104.2.6 is amended to 10 delete the clause at the end of the first paragraph 11 which reads: "and any judgment resulting therefrom 12 shall be assumed by this jurisdiction." 13 (b) Uniform Building Code Section 105 is hereby deleted. 14 (c) Uniform Building Code Section 109.1 is hereby 15 amended to read as follows: 16 Sec. 109.1. Use or occupancy. No building or structure 17 shall be used or occupied and -no change in the existing use 18 or occupancy of said building or structure or portion thereof 19 shall be made until the building official has issued a 20 certificate of occupancy therefor as provided herein. 21 "Use" shall have the same meaning as defined in Vernon City 22 Code Section 26.2.17 and any other applicable provision of 23 the Comprehensive Zoning Ordinance of the City of Vernon. 24 "Change in Use" shall include, but not be limited to, any 25 change in tenancy of a'building for which a new business 26 license is required under the Code of the City of Vernon. 27 EXCEPTION: Group U and Division 3 of Group R Occupancies. 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 When determined by the building official that a special inspection is required to determine compliance with the Code of the City of Vernon or with this code for a certificate of occupancy, an inspection fee shall be paid as set forth by resolution of the City Council. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of the Code of the City of Vernon, of this code, or of any other ordinance. A certificate of occupancy which presumes to give authority to violate or cancel the provisions of the Code of the City of Vernon, of this code, or of any other ordinance shall not be valid. (d) Uniform Building Code Table 1-A is hereby amended to read as follows: TABLE NO. 1-A. BUILDING PERMIT FEES. Building permit fees shall be as set forth in a fee schedule adopted by resolution of the City Council. (e) Uniform Building Code Section 503.1 is hereby amended to read as follows: Sec. 503.1. General. Buildings shall adjoin or have access to a public right-of-way on not less than one side. Required yards shall be permanently maintained. (f) Uniform Building Code Section 505 is hereby amended to add Section 505.1.4 as follows: Sec. 505.1.4. Yards. For the purpose of this Section a public right-of-way, and a railroad right-of-way containing railroad tracks owned and operated by a railroad, may be considered as required yard space. -8- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (g) Uniform Building Code Section 1503 is hereby amended to read as follows: Sec. 1503. Roof covering requirements. The roof covering on any structure regulated by this code shall be as specified in Table No. 15-A and as classified in Section,1504, except that only fire retardant roof coverings meeting class A or B roofing assemblies are permitted in the City of Vernon. The roofing assembly includes the roofdeck, underlayment, interlayment, insulation and covering which is assigned a roof classification. (h) Uniform Building Code Section 2603.6 is hereby deleted. (i) Uniform Building Code Section 2603.7 is hereby amended to add Section 2603.7.3 as follows: Sec. 2603.7.3. Approved materials. Regardless of the provisions in Chapter 2.6, no skylight shall be installed unless the materials, the construction standards, and the location have been approved by the building official, all in accordance with the provisions of this code. 1. Skylights which are flat or corrugated at the roof level shall be provided with an approved supporting barrier immediately above or below the skylight. 2. Each skylight shall not exceed a maximum area of 32 square feet. 3. The aggregate area of all skylights shall not exceed 25 percent of the floor area of the room or space sheltered by the roof in which they are installed. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4. All existing skylights which are not in conformance with this code are deemed to be hazardous and shall be removed or protected in accordance with this section. (j) Uniform Building Code Chapter 32 is hereby deleted. (k) Uniform Building Code, Appendix Chapter 34, Section 3406.2, is hereby amended to read as follows: Sec. 3406.2. Enforcement. With a change in occupancy or otherwise upon order of the building official, the work shall be completed or the building shall be vacated until.made to conform. (1) Uniform Building Code, Appendices, Chapters 10, 13, 21, 23, 29, and 31 are hereby deleted. SECTION 3: Article III of Chapter 24, Building and Construction, of the Code of the City of Vernon, is hereby amended to read as follows: A. Section 24.15 is hereby amended to read as follow: Sec. 24.1"5 National Electrical Code, 1996 Edition, adopted. The National Electrical Code, 1996 Edition, including Appendices A, B and C, copyrighted by the National Fire Protection Association, and the Uniform Administrative Code Provisions for the National Electrical Code, 1996 Edition, promulgated by the International Conference of Building Officials, subject, however, to the amendments, additions, and deletions set forth in this article and by the State of California Building Standards Commission in the California -10- 1 Electrical Code are hereby adopted by reference as the 2 Electrical Code of the City of Vernon. 3 In the event of any conflict between the provisions of 4 the National Electrical Code or the Uniform Administrative 5 Code Provisions for the National Electrical Code and a 6 provision applicable to cities of the California Electrical 7 Code as contained in Title 24 of the California Code of 8 Regulations, the provisions of the California Electrical Code 9 shall prevail. 10 B. Section 24.16 is hereby amended to read as 11 follow: 12 Sec. 24.16. Amendments, additions and deletions. 13 (a) The Uniform Administrative Code Provisions for the 14 National Electrical Code, 1996 Edition, is hereby 15 amended as follows: 16 (1) Section 203 is hereby deleted. 17 (2) Subsections 9,11,12 and 13 of Section 301.2 are 18 hereby deleted. 19 (3) Table 3-A is hereby amended to read as follows: 20 TABLE NO. 3-A - ELECTRICAL PERMIT FEES. 21 Electrical permit fees shall be as set forth in a fee 22 schedule adopted by resolution of the City Council. 23 (b) The National Electrical Code, 1996 Edition, is 24 hereby amended as follows: 25 (1) Exceptions No. 1 and 2 to National Electrical 26 Code Section 250-91(b) are hereby deleted. 27 (2) Subsections (d) through (h) are hereby added to 28 National Electrical Code Section 250-91 as -11- 1 follows: 2 Sec. 250-91. Material. 3 (d) Conduit. All wiring installed in or on buildings 4 or other structures shall be in a metal protected 5 wiring system of either flexible, nonmetallic 6 conduit, thin wall tubing or rigid conduit 7 (e) Entrance Conductors. Service entrance conductors 8 from overhead service drops shall be installed in 9 rigid metal raceways. 10 (f) Color Coding. Grounded conductors of different 11 voltage shall be identified by white and natural 12 grey; grounded conductors of the 277/480 volt system 13 shall be grey; grounded conductors of the lower 14 voltage systems shall be white. 15 (g) Aluminum Conductor Terminations. All stranded 16 aluminum conductors must be terminated with an 17 approved by -press termination. 18 (h) Ceiling Receptacles. Upon change of occupancy, use 19 or tenancy all 120 volt ceiling mounted receptacles 20 shall be removed. 21 SECTION 4: Article IV of Chapter 24, Building and 22 Construction, of the Code of the City of Vernon is hereby 23 amended as follows: 24 A. Section 24.20 is amended to read as follows: 25 Sec. 24.20. Uniform Mechanical Code, 1997 Edition, adopted. 26 The Uniform Mechanical Code, 1997 Edition, including 27 Appendices A, B, and C, published by the International 28 -12- 1 Conference of Building Officials, Subject, however, to the 2 amendments, additions and deletions set forth in this article 3 and by the State of California Building Standards 4 Commission, is hereby adopted by reference as the Mechanical 5 Code of the City of Vernon. 6 In the event of any conflict between the provisions of 7 the Uniform Mechanical Code and a provision applicable to 8 cities of the California Mechanical Code as contained in 9 Title 24 of the California Code of Regulations, the 10 provisions of the California Mechanical Code shall prevail. 11 B. Section 24.21 is amended to read as follows: 12 Sec. 24.21. Mechanical Code amendments, additions, and deletions. 13 The Uniform Mechanical Code, 1997 Edition, is amended as 14 follows: 15 (a) Uniform Mechanical Code Section 108.8 is amended to 16 delete the clause at the end of the first paragraph 17 which reads: "and any judgment resulting therefrom 18 shall be assumed by this jurisdiction." 19 (b) Uniform Mechanical Code Section 110 is hereby 20 deleted. 21 (c) Uniform Mechanical Code Table No. 1-A is amended to 22 read as follows: 23 TABLE 1-A. MECHANICAL PERMIT FEES. 24 Mechanical permit fees shall be as set forth in a 25 fee schedule adopted by the City Council. 26 (d) Uniform Mechanical Code Section 1118 is amended by 27 adding the following: 28 -13- 1 2 3 4 5 6 7 8 9 10' 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1118.4 Manual Emergency Discharge. 1118.4.1 When required. Systems containing a Group Al refrigerant having a charge weight exceeding 440 pounds and carbon dioxide or refrigerants in other groups having a charge weight exceeding 220 pounds shall be provided with a manual system for discharge of the refrigerant at an approved location. 1118.4.2 Emergency Discharge Lines. Separate emergency discharge pipe lines, independent of other piping, shall be connected above the liquid refrigerant level on the high-pressure side and on the low-pressure side of the system. The lines shall be pitched so as to drain to the control box. The emergency refrigerant control box shall be locked and identified with a permanent label reading "Emergency Refrigerant Control Box" with the name and number designation of the refrigerant in the system. 1118.4.3 Stop Valves. Readily accessible stop valves and suitable pressure gauges shall be installed on each discharge pipe within the emergency refrigerant control box. The gauge shall be located ahead of the stop valve, and the valve shall have the same discharge capacity as the discharge pipe it serves. A permanent label shall be attached to each valve indicating "High-pressure Refrigerant Discharge Valve" or "Low-pressure -14- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Refrigerant Discharge Valve" as appropriate. A permanent label indicating "Pressure Relief Valve Setting" and the appropriate pressure shall be located adjacent to each gauge. 1118.4.4 Sizing Valves and Lines. The size of the stop valve and the size and length of the discharge line shall be determined in accordance with Section 1117. 1118.4.5 High- to Low-pressure Valve. A stop valve from the high side to the low side on the system side of the emergency discharge stop valves shall be provided in the emergency refrigerant control box. The stop valve and line shall be the same size as the higher pressure line. The valve shall be marked "High to Low Pressure Control Valve". 1118.4.6 Sizing Headers and Diffusers. When more than one relief valve or emergency discharge line is connected to a common header or riser, the area of the header or riser and the diffuser inlet shall be equal to the sum of the areas of all of the relief - valve vent lines and emergency discharge lines feeding it. 1118.4.7 Discharge Location. The discharge shall be located in accordance with Section 1116 or 1118.1 as appropriate for the refrigerant involved. 1118.4.8 Provide Drip Legs. Drip pockets or drains for collecting moisture shall be installed on emergency discharge lines beyond the emergency -15 1 2 3 4 �L' 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 valve. (e) Uniform Mechanical Code, Section 1406.1 is hereby amended to read as follows: Sec. 1406.1. General. Process piping and tubing shall comply with this section and shall be installed in accordance with nationally recognized standards. Piping and tubing systems shall be compatible with the material being transported. (f) Uniform Mechanical Code Appendix D is hereby deleted. SECTION 5: Article V of Chapter 24, Building and Construction, of the Code of the City of Vernon is hereby amended as follows: A. Section 24.25 is amended to read as follows: Sec. 24.25. Uniform Plumbing Code, 1997 Edition, adopted. The Uniform Plumbing Code, 1997 Edition, its Appendices A, B, C, D, H, I, and L with the IAPMO Installation Standards, prepared and published by the International Association of Plumbing and Mechanical Officials, subject, however, to the amendments, additions and deletions set forth in this article and by the State of California Building Standards Commission in the California Plumbing Code, is hereby adopted by reference as the Plumbing Code of the City of Vernon. In the event of any conflict between the provisions of the Uniform Plumbing code and a provision applicable to cities of the California Plumbing Code as contained in part of Title 24 of the California Code of Regulations, the -16- 1 provisions of the California Plumbing Code shall prevail. 2 B. Section 24.26 of said Article V, Plumbing Code, 3 and is amended to read as follows: 4 Sec. 24.26. Amendments, additions, and deletions. 5 The Uniform Plumbing Code, 1997 Edition, is amended 6 as follows: 7 (a) Uniform Plumbing Code Table No. 1-1 is amended to 8 read as follows: 9 TABLE NO. 1-1 - PLUMBING PERMIT FEES 10 Plumbing permit fees shall be as set forth in a fee 11 schedule adopted by resolution of the City Council. 12 (b) Uniform Plumbing Code, 1997 Edition, Table 4-1 13 amended by adding the following to Table 4-1. 14 Minimum plumbing facilities. 15 (1) Add the following after the opening paragraph: 16 The number of plumbing facilities shall be 17 determined based on the maximum number of 18 occupants that can be expected at the facility. 19 (2) Insert the following in "Industrial Warehouses, 20 Workshops, Foundries, and similar 21 establishments (for employee use)": 22 A floor drain or drains shall be installed in all 23 shop toilet areas. 24 (c) Uniform Plumbing Code, 1997 Edition, Chapter II, 25 Section 1101.1 is hereby amended as follows: 26 1101.1 Yard drainage piping and onsite storm drain 27 systems that connect to public storm drainage 28 systems shall be installed in accordance with -17- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 this chapter and approved public works standards. Prior to construction of any storm drain system, complete plans and hydraulic calculations shall be approved by the agency whose storm drainage system is to be impacted by the proposed system. A City of Vernon standard storm drain inspection manhole or equivalent shall be installed on private property at an approved location. (d) Uniform Plumbing Code Appendices E, F, G, J and K are hereby deleted. SECTION 6: Article VI of Chapter 24, Building and Construction, of the Code of the City of Vernon, is hereby amended as follows: A. Section 24.30 is amended to read as follows: Sec. 24.30. Uniform Code for Abatement of Dangerous Buildings, 1997 Edition, adopted. The Uniform Code for Abatement of Dangerous Buildings, 1997 Edition, published by the International Conference of Building Officials, except as provided herein, is adopted as the Dangerous Buildings Code of the City of Vernon. B. Section 24.31 is amended to read as follows: Sec. 24.31. Exceptions. The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is amended as follows: (a) Section 203 is hereby amended to read as follows: Sec. 203. Violations and Penalties. Any person violating the provisions of this section shall be guilty of a misdemeanor for each day such violation continues. (b) Section 205 is hereby deleted. (c) Sections 401.6 and 401.7 are added to read as follows: Sec. 401.6. Imminent Threat. When a dangerous building poses an imminent threat to life, limb, health, or property, the building official shall have authority to do any or all of the following: 1. Immediately restrict or prohibit the occupancy of, and/or vacate, any dangerous building or any adjacent structure or area which is threatened thereby. 2. Order the closure and barricading of all or a part of any street, alley, sidewalk, or other public area which is threatened thereby. 3. Post notices to enforce the above. No such notice shall be removed without official authorization. 4. The property owner shall be responsible and liable for all costs incurred by the City for all enforcement. Notwithstanding any other provision of this Code, if the building official determines that a dangerous building poses an imminent threat to life, limb, or property, the time for giving notice to repair or demolish a dangerous building pursuant to Section 401.2-may be reduced to seven (7) days and the time to appeal the building official's determination may be shortened to 48 hours as set forth in the notice. SECTION 7: Article IX of Chapter 24, Building and Construction, of the Code of the City of Vernon, is hereby amended I as follows: A. Section 24.60 is hereby amended to read as follows: Sec. 24.60. Appendix chapter 1 of the Uniform Code for Building Conservation, 1997 Edition, adopted. Appendix Chapter 1 of the Uniform Code for building Conservation, 1997 Edition, published by the International Conference of Building Officials, except as provided herein, is hereby adopted as the seismic strengthening provisions for unreinforced masonry bearing wall buildings for the City of Vernon. B. Section 24.64 is hereby added to read as follows: Sec. 24.64. Appendix Chapter 5 of the Uniform Code for Building Conservation, 1997 Edition, adopted. Appendix Chapter 5 of the Uniform Code for Building Conservation, 1997 Edition, published by the International Conference of Building Officials, is hereby adopted as the minimum standard for seismic strengthening of tilt -up -20- 1 concrete wall buildings. These Standards are established as a 2 minimum guideline for those property owners voluntarily 3 selecting to retrofit their structures and shall not be 4 construed as a City of Vernon mandated program. 5 SECTION 8: Enactment of Penalty Sections. 6 Pursuant to Government Code Section 50022.4 the following 7 penalty sections are specifically enacted and published as set 8 forth in Exhibits A, B, C, D, and E attached hereto and made a 9 part hereof by reference, except as otherwise amended or deleted 10 in this ordinance: 11 A. Uniform Building Code, 1997 Edition, Sections 12 102, 103, 104, 106.4.5 and 109.6 (Exhibit A). 13 B. Uniform Administrative Code Provisions for the 14 National Electrical Code, 1996 Edition, Sections 201, 202, 204 and 15 303.5 (Exhibit B). 16 C. Uniform Mechanical Code, 1997 Edition, Sections 17 108, 109, 111 and 114.5 (Exhibit C). 18 D. Uniform Plumbing Code, 1997 Edition, Sections 19 102.1 through 102.3.2 and 103.3.5 (Exhibit D). 20 E. Uniform Code for the Abatement of Dangerous 21 Buildings, 1997 Edition, Sections 202, 203, 701.1 and 701.2 22 (Exhibit E). 23 SECTION 9: Ordinances repealed. 24 Any ordinance, part of an ordinance, or code section in 25 conflict with this Ordinance is hereby repealed. 26 SECTION 10: Violation. 27 A violation of this ordinance or any part thereof is 28 punishable by a fine of not more than One Thousand Dollars -21- 11 FA 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ($1,000.00) or by imprisonment in the County Jail for a period of not more than six (6) months, or by both such fine and imprisonment. Each day or any portion thereof during which any violation of any provision or any section of this chapter or of any uniform code or part thereof is committed, continued or permitted, constitutes a separate and individual offense. SECTION 11: Severability. If any section, subsection, sentence, clause, or phrase or word of this ordinance is for any reason held to be void or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance; it being the intention of the City Council of the City of Vernon to adopt and pass this ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that one or more of the sections, subsections, clauses, sentences or phrases thereof may be declared void or unconstitutional. SECTION 12: Copies on File with City Clerk. Any use of buildings or structures constituting a hazard to safety, health or public welfare by reason et inadequate maintenance, dilapidation, obsolescence, fire haz- ard, disaster, damage or abandonment is, for the purpose of this section, an unsafe use. Parapet walls, cornices, spires, towers, tanks, statuary and other appendages or structural members that are supported by, attached to, or a part of a building and that are in deteriorated condition or otherwise unable to sustain the design toads that are specified in this code are hereby designated as un- safe building appendages. All such unsafe buildings, structures or appendages are hereby declared to be public nuisances and shall be abated by repair, reha- bilitation, demolition or removal in accordance with the proce- dures set forth in the Dangerous Buildings Mode or such alternate procedures as may have been or as may be adopted by this jurisdio- tion. As an alternative, the building official, or other employee or official of this jurisdiction as designated by the governing body, may institute any other appropriate action to prevent, restrain, cor- rect or abate the violation. SECTION 103 —VIOLATIONS It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter,.repair; move, improve, remove, convert Of demolish, equip, use, occupy or maintain any building or struc- ture or cause or permit the same to be done in violation of this code. SECTION 104 — ORGANIZATION AND ENFORCEMENT 104.1 Ciliation of Enforcement Agency. There is hereby estab- lished in this jurisdiction a code enforcement agency which shall be under the administrative and operational control of the building official. 104.2 Powers and Duties of Building Otficiat. 104.2.1 GenmL The building official is hereby authorized and directed to enforce all the provisions of this code. For such pur- poses, the building official shall have the powers of a law enforce- ment officer. The building official shall have the power to render interpreta- tions of this code and to adopt and enforce rules and supplemental regulations to clarify the application of its provisions. Such inter- pretations, rules and regulations shall be in conformance with the intent and purpose of this code. 104.2.2 Deputies. In accordance with prescribed procedures and with the approval of the appointing authority, the building of- ficial may appoint such number of technical officers and inspec- tors and other employees as shall be authorized from time to time. The building official may deputize such inspectors or employees as may be necessary to carry out the functions of the Code enforce- ment agency. - 1041.3 Right of entry. When it is necessary to make an inspec tion to enform the provisions of this code, or when the building official has reasonable cause to believe that there exists in a build- ing or upon a premises a condition that is contrary to or in violation of this code that makes the building or premises unsafe, dangerous or hazardous, the building official may enter the building or prem- ises at reasonable times to inspect or to perform the duties imposed by this code, provided that if such building or premises be oocu- pied that credentials be presented to the occupant and entry re- quested. If such building or premises be unoccupied, the building official shall fast make a reasonable effort to locate the owner or. other person having charge or control of the building or premises and request entry. If entry is refused, the building official shall have recourse to the remedies provided by law to secure entry. 104.2A Stop orders. Whenever any work is being done con- trary to the provisions of this code, or other pertinent laws or ordi- nances implemented through the enforoment of this axle, the building official may order the work stopped by notice in writing served on any persons engaged in the doing or causing such work to be dome, and any such persons shall forthwith stop such work until authorized by the building official to proceed with the work. 1041.5 Occupancy violations. Whenever any building or structure or equipment therein regulated by this code is being used Contrary to the provisions of this code, the building official may order such use discontinued and the structure, or portion thereof•; vacated by notice served on any person causing such use to be con- tinued Such person shall discontinue the use within the time pre- scribed by the building official after receipt of such notice to make the structure, or portion thereof, comply with the requirements of this code. 104.2.6 Liability. The building official charged with the en- forcement of this code, acting in good faith and without malice in the discharge of the duties required by this code or other pertinent law or ordinance shall not thereby be rendered personally liable for damages that may accrue to persons or property as a result of an act or by reason of an act or omission in the discharge of such du- ties. A suit brought against the building official or employee be- cause of such act or omission performed by the building official or employee in the enforcement of any provision of such codes or other pertinent laws or ordinances implemented through the en- forcement of this code or enforced by the code enforcement agency shall be defended by this jurisdiction until final termina- tion of such proceedings, and any judgment resplting therefrom shall be assumed by this jurisdiction. This code shall not be construed to relieve from or lessen the re- sponsibility of any person owning, operating or controlling any building or structure for any damages to persons or property caused by defects, nor shall the code enforcement agency or its parent jurisdiction be held as assuming any such liability by rea- son of the inspections authorized by this code or any permits or certificates issued under this code. EXHIBIT "A" Page 1 of -2 1997 UNIFORM GUILDINd COOL: 104.7-7 Modifications. When there are practical difficulties in- volved in carrying out the provisions of this code, the building of- ficial may grant modifications for individual cases. The building official shall first find. that a special individual reason makes the strict letter of this code impractical and that the modification is in conformance with the intent and purpose of this code and that such modification does not lessen any fire -protection requirements or any degree of structural integrity. The details of any action grant- ing modifications shall be recorded and entered in the files of the code enforcement agency. 1042.8 Alternate materials, alternate design and methods of construction. The provisions of this code are not intended to pre- vent the use of any material, alternate* design or method of construction not specifically prescribed by this code, provided any alternate has been approved and its use authorized by the building official. The building official may approve any such alternate, provided the building official finds that the proposed design is satisfactory and complies with the provisions of this code and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in this code in suitability, strength, effectiveness, fire resistance, durability, safety and sanitation. The building official shall require that sufficient evidence or proof be submitted to substantiate any claims that may be made regarding its use. The details of any action granting approval of an alternate shall be recorded and entered in the files of the code en- forcement agency. 104M Tests. Whenever there is insufficient evidence of com- pliance with any of the provisions of this code or evidence that any material or construction does not conform to the requirements of this code, the building official may require tests as proof of com- pliance to be made at no expense to this jurisdiction. Tea methods shall be as specified by this code or by other rec, ogniaed test standards. If there are no recognized and accepted test methods for the proposed alternate, the building official shall de- termine test procedures. All tests shall be made by an approved agency. Reports of such tests shall be retained by the building official for the period re- quired for the retention of public records. 1042-10 Cooperation . of other officials and officers. The building official may request, and shall receive, the assistance and cooperation of other officials of this jurisdiction so far as is re- quired in the discharge of the duties required by this code or other pertinent law or ordinance. SECTION 106 — PERMITS 106.4.5 Suspension or revocation. The building official may, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of, incorrect information supplied, or in violation of any ordinance or regulation or any of the provisions of this code. SECTION 109 — CERTIFICATE OF OCCUPANCY 109.6 Revocation. The building official may, in writing, sus- pend or revoke a certificate of occupancy issued under the provi- sions of this code whenever the certificate is issued in error, or on the basis of incorrect information supplied, or when it is deter- mined that the building or structure or portion thereof is in.viola- tion of any ordinance or regulation or any of the provisions of this code. In accordance with prescribed procedures and with the approval of the appointing authority, the building official may appoint a chief electrical inspector and other related technical officers and inspectors and other employees as shall be authorized from time to time. 2013 Right of Entry. When necessary to make an inspection to enforce any of the provisions of this code, or when the building official has reasonable cause to believe that there exists in any building or upon a premises a condi- tion which is contrary to or in violation of this code which makes the building or premises unsafe, dangerous or hazardous, the building official may enter the building or premises at all reasonable times to inspect or to perform the duties imposed by this code, provided that if such building or premises be oc- cupied, that credentials be presented to the occupant and entry requested. If such building or premises be unoccupied, the building official shall first make a reasonable effort to locate the owner or other persons having charge or con- trol of the building or premises and request entry. Should entry be refused, the building official shall have recourse to the remedies provided by law to secure entry. EXHIBIT "B" Page 1 of 3 201A Stop Orders. When work is being done contrary to the provisions of this code, the building official may order the work stopped by notice in writing served on persons engaged in the doing or causing such work to be done, and such persons shall forthwith stop such work until authorized by the building official to proceed with the work. 201.5 Authority to Disconnect Utilities. The building official or the build- ing official's authorized representative shall have the authority to disconnect a utility service or energy supplied to the building, structure or building service equipment therein regulated by this code or the technical codes in case of emergency where necessary to eliminate an immediate hazard to life or prop- erty. The building official shall whenever possible notify the serving utility, the owner and occupant of the building, structure or building service equip- ment of the decision to disconnect prior to taking such action, and shall notify such serving utility, owner and occupant of the building, structure or building service equipment, in writing, of such disconnection immediately thereafter. 201.6 Authority to Condemn Building Service Equipment. When the building official ascertains that building service equipment regulated in the technical codes has become hazardous to life, health or property, or has be- come insanitary, the building official shall order in writing that such equip- ment either be removed or restored to a safe or sanitary condition, as appropriate. The written notice itself shall fix a time limit for compliance with such order. Defective building service equipment shall not be maintained af- ter receiving such notice. When such equipment or installation is to be disconnected, a written notice of such disconnection and causes therefor shall be given within 24 hours to the serving utility, the owner and occupant of such building, structure or prem- ises. When any building service equipment is maintained in violation of the technical codes and in violation of a notice issued pursuant to the provisions of this section, the building official shall institute appropriate action to prevent, restrain, correct or abate the violation. 201.7 Connection after Order to Disconnect. Persons shall not make con- nections from an energy, fuel or power supply nor supply energy or fuel to building service equipment which has been disconnected or ordered to be dis- connected by the building official or the use of which has been ordered to be discontinued by the building official until the building official authorizes the reconnection and use of such equipment. 201.8 Liability. The building official charged with the enforcement of this code and the technical codes, acting in good faith and without malice in the discharge of his duties, shall not thereby be rendered personally liable for damage that may accrue to persons or property as a result of an act or omission in the discharge of the assigned duties. A suit brought against the building offi- cial or employee because of such act or omission performed by the building official or employee in the enforcement of the provisions of such codes oroth- er pertinent laws or ordinances implemented through the enforcement of this code or enforced by the code enforcement agency shall be defended by this jurisdiction until final termination of such proceedings, and any judgment re- sulting therefrom shall be assumed by this jurisdiction. The building official may request, and shall receive, the assistance and cooperation of other offi- cials of this jurisdiction so far as is required in the discharge of the duties re- quired by this code or other pertinent laws or ordinances. SECTION 202 — UNSAFE ELECTRICAL SYSTEMS OR EQUIPMENT Electrical systems or equipment regulated by this code which are unsafe, or which constitute a fire hazard, or are otherwise dangerous to human life are, for the purpose of this section, unsafe. Use of electrical systems or equipment regulated by this code constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster damage or abandonment is, for the purpose of this section, an unsafe use. Unsafe electrical systems or equipment are hereby declared to be.public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the procedures set forth in the Uniform Code for the Abatement of Dangerous Buildings or such alternate procedure as may be adopted by this jurisdiction. As an alternative, the building official or other employee or official of this jurisdiction as designated by the governing body may institute other appropriate action to prevent, restrain, correct or abate the violation. SECTION 204 — VIOLATIONS It shall be unlawful for a person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any electrical system or equipment or cause or permit the same to be done in violation of this code. Chapter 3 PERMITS AND INSPECTIONS SECTION 303 — PERMITS ISSUANCE 303.5 Suspension or Revocation. The building official or the building official's authorized representa- tive shall have the authority to disconnect fuel -gas utility, service, or energy supplies to a building, structure, premises or equipment regulated by this code in case of emergency when necessary to eliminate an immediate hazard to life or property. The building of- ficial shall, whenever possible, notify the serving utility, the own- er and occupant of the building, structure or premises of the decision to disconnect prior to taking such action, and shall notify such serving utility, owner and occupant of the building, structure or premises in writing of such disconnection immediately thereaf- ter. 108.6 Authority to Condemn Equipment. When the building official ascertains that equipment, or a portion thereof, regulated by this code has become hazardous to life, health or property, the building official shall order in writing that the equipment either be removed or restored to a safe or sanitary condition, as appropriate. The written notice shall contain a fixed time limit for compliance with such order. Persons shall not use or maintain defective equip- ment after receiving a notice. When equipment or an installation is to be disconnected, writ- ten notice of the disconnection and causes therefor shall be given within 24 hours to the serving utility, the owner and occupant of the building, structure or premises. When equipment is main- tained in violation of this code, and in violation of a notice issued pursuant to the provisions of this section, the building official shall institute an appropriate action to prevent, restrain, correct or abate the violation. 108.7 Connection after Order to Disconnect. Persons shall not make connections from an energy, fuel or power supply nor supply energy or fuel to any equipment regulated by this code which has been disconnected or ordered to be disconnected by the building official, or the use of which has been ordered to be dis- continued by the building official, until the building official authorizes the reconnection and use of such equipment. 108.8 Liability. The build- ing official may request, and shall receive, the assistance and cooperation of other officials of this jurisdiction so far as is re- quired in the discharge of the duties required by this code or other pertinent law or ordinance. SECTION 109 — UNSAFE EQUIPMENT 1091 Hazardous Conditions. Equipment . regulated by this code, which is unsafe or which constitutes a fire or health hazard or is otherwise dangerous to human life is, for the purpose of this section, unsafe. Use of equipment regulated by this code constitut- ing a hazard to safety, health or public welfare by reason of inade- quate maintenance, dilapidation, obsolescence, fire hazard, disaster, damage or abandonment is, for the purpose of this sec- tion, an unsafe use. Unsafe equipment is hereby declared to be a public nuisance and shall be abated by repair, rehabilitation, de- molition or removal in accordance with the procedures set forth in the Uniform Code for the Abatement of Dangerous Buildings or such alternate procedure as may be adopted by this jurisdiction. As an alternative, the building official or other employee or offi- cial of this jurisdiction as designated by the governing body may institute other appropriate action to prevent, restrain, correct or abate the violation. SECTION 111 — VIOLATIONS 11L1 General. It shall be unlawful for a person, firm or corpora- tion to erect, construct, enlarge, alter, repair, move, improve, re- move, convert or demolish, equip, use or maintain mechanical systems or equipment or cause or permit the same to be done in violation of this code. SECTION 114 — PERMIT ISSUANCE 1145 Suspension or Revocation. The building official may, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of ineomect information supplied or in violation of other ordinances or regulations of the jurisdiction. Malke orst City Clerk STAFF REPORT Building Codes (May 13, 1999) The State of California recently adopted the Uniform Building Code, the National Electrical Code, Uniform Mechanical Code, Uniform Plumbing Code and Appendix 1 of the Uniform Code for Building Conservation. These codes will become effective on July 1, 1999. California Health and Safety Code Sections 17958, 17958.5, 17958.7 and 18941.5 allow the local agency to amend the Model Codes provided a finding of necessity can be made. City staff believes it is in the interest of Public Health, Safety and Welfare to enact certain amendments to the model codes because of climatic, geological and topographical conditions and based upon the following findings: 1. Adverse climatic conditions and strong winds such as those in existence in the City of Vernon increase the likelihood of fire spreading from one building to another; 2. General conditions in the City of Vernon are affected by the location of earthquake faults that can create tremendous loss of life and structures in the City; and 3. Topographical conditions of the City of Vernon coupled with the density of buildings, limited setbacks, narrow access to buildings, narrow streets potentially create a problem for Governmental agencies to respond to emergency conditions. The Uniform Codes published by the ICBO, IAPMO, and NFPA are amended by the State and their various agencies and are approved 1 by the California Building Standards Commission. The Codes adopted by the City of Vernon are subject to the amendments, additions and deletions set forth in the California Building Codes as contained in Title 24 of the California Code of Regulations. When a conflict between the provisions of the Uniform Code and a provision applicable to Cities of the California Building Code, the provisions of the California Building Code shall prevail. It is recommended that Uniform Building Code, 1997 Edition, Volume 1, 2 and 3 including appendices, Chapters 3, 4, 9, 11, 12, 15, 16, 18, 30, 33 and 34 be adopted with various amendments. The amendments are briefly summarized as follows: 1. The City requires a Certificate of Occupancy to be issued for each change in use or tenancy for which a business license is required. 2. The City establishes its own building permit fees. 3. Buildings shall have access to a public way on not less than one side of a building. 4. Allows public right-of-ways and railroad right-of-ways to be used as a yard. 5. Requires roof coverings to be Class A or B. 6. Requires skylights to meet certain minimum requirements. It is recommended that the National Electrical Code, 1996 Edition, including appendices A, B and C copyrighted by the National Fire Protection Association and the Uniform Administrative Code Provisions for the National Electrical Code, 1996 Edition, promulgated by the International Conference of OA Building Officials be adopted with various amendments. The amendments include: 1. Establishment of Permit Fees. 2. Specific City requirements for conduit, conductors, color coding and receptacles. It is recommended that the Uniform Mechanical Code, 1997 Edition, including Appendices A, B, and C, published by the International Conference of Building Officials be adopted with various amendments. The Amendments include: 1. Establishment of City Permit Fees. 2. The installation of a manual discharge on systems containing a Group Al Refrigerant. It is recommended that the Uniform Plumbing Code, 1997 Edition, including appendices A, B, C, D, H, I and L with the IAPMO Installation Standards, published by the International Association of Plumbing and Mechanical Officials be adopted with various amendments. The amendments include: 1. Establishment of City Permit Fees. 2. Establishes minimum number of plumbing fixtures. 3. Requirements for yard drainage. It is recommended that the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, published by the International Conference of Building Officials be adopted with various amendments. This code allows the Building Official to restrict or prohibit the occupancy of a dangerous building, order the closure and barricading of a street, sidewalk or other public area, post notice of enforcement and establish procedures to 3 eliminate dangerous conditions. It is recommended that Appendix Chapter 1 of the Uniform Code for Building Conservation, 1997 Edition, published by the International Conference of Building Officials be adopted. Appendix Chapter 1 establishes standards for the seismic strengthening for unreinforced masonry bearing wall buildings. Sections 38660 and 50022.2 of the California Government Code authorizes the City Council the to adopt by reference regulations for the abatement of unsafe structures. Older buildings of tilt up concrete wall construction are recognized to be a hazard due to the potential for collapse in an earthquake, especially those constructed prior to the adoption of the 1976 Uniform Building Code. These types of structures often do not have proper ties between the wall and roofing systems. During an earthquake the wall and roof connection have been known to fail causing the roof to collapse endangering persons and property below. The City of Vernon currently has no retrofitting standards for tilt -up constructed buildings and City staff believes that a minimum standard should be established. Property owners have in the past voluntarily retrofitted their tilt -up buildings and have either used other City's standards or used no standards at all. Often lenders or insurance companies require these types of buildings to be retrofitted. City staff believes that a minimum recognized standard should be established for the retrofit of these structures. Appendix Chapter 5 of the 1997 edition of the Uniform Code of Building Conservation published by the International Conference of Building Officials establishes 4 minimum standards for tilt -up concrete walled buildings to provide structural seismic resistance in order to reduce the risk of life loss or injury on both the subject and adjacent properties. It is recommended that Appendix Chapter 5 of the Uniform Code of Building Conservation be adopted as the retrofit standard for tilt -up concrete walled buildings. It should be noted that this standard will not necessarily prevent loss of life or injury or prevent earthquake damage to an existing building.
