AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 VERNON AMENDING SECTIONS 16.14, 16.15 and 16.16 OF
THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, TO
4 CHANGE SPEED LIMITS ON CERTAIN STREETS AND TO REPEAL
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
5 HEREWITH

7 WHEREAS, on June 7, 1994, the City Council of the City of
8 Vernon adopted Ordinance No. 1021 to establish speed limits on certain
9 streets in accordance with Speed Zone Surveys dated June 1991 and
10 January 1994; and
11 WHEREAS, the Community Services Department of the City of
12 Vernon prepared a Speed Zone Survey dated October 1999 as part of the
13 Engineering and Traffic Survey for the City of Vernon for the purpose
14 of evaluating existing speed limits on streets within the City of
15 Vernon; and
16 WHEREAS, the Community Services Department has recommended
17 that the Code of the City of Vernon, California, 1959, be amended by
18 retaining existing speed limits on some streets and changing speed
19 limits on other streets based on the Speed Zone Survey dated October
20 1999; and
21 WHEREAS, Vehicle Code § 22357 authorizes cities to determine
22 and declare prima facie speed limits greater than 25 miles per hour on
23 the basis of such an Engineering and Traffic Survey; and
24 WHEREAS, according to the Engineering and Traffic Survey, the
25 recommendations for prima facie speed limits of 30, 35, 40 and 45
26 miles per hour on certain streets will facilitate the orderly movement
27 of vehicular traffic and will be reasonable and safe on those streets;
28 and
1 WHEREAS, said Speed Zone Survey supports the enforcement of
2 the prima facie speed limit of 25 miles per hour on certain streets;
3 and

WHEREAS, the California legislature has established rules for
5
6 determining speed limits in order to promote uniformity throughout the
7 State and § 40802 of the Vehicle Code provides that radar may not be
8 used as an enforcement tool if the posted limits are not set in
9 accordance with these rules; and
10 WHEREAS, certain sections of the Vernon Code need to be
11 amended to establish the speed limits recommended in the Speed Zone
12
Survey.

THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:

15 SECTION 1: The City Council of the City of Vernon hereby
16 finds and determines that the recitals contained hereinabove are true
17 and correct.
18 SECTION 2: Section 16.14 of the Code of the City of Vernon,
19 California, 1959, is hereby amended to read as follows:
20
Sec. 16.14. Speed limits on certain streets --Forty-five miles per
21 hour.
22 Pursuant to Vehicle Code Section 22357, the city council
23 hereby determines that the prima facie speed limit on the following
24 streets shall be forty-five (45) miles per hour:

BANDINI BOULEVARD From Soto Street to Atlantic
26 Boulevard
27 WASHINGTON BOULEVARD East/Downey Road to the east city
28 boundary

1 Every violation of this section by propelling a vehicle in
2 excess of the speed limit provided for herein is hereby declared to be
3 a public nuisance.

SECTION 3: Section 16.15 of the Code of the City of Vernon,
5
California, 1959, is hereby amended to read as follows:

7 Sec. 16.15. Speed limits on certain streets --Forty miles per hour.
8 Pursuant to Vehicle Code Section 22357, the city council
9 hereby determines and declares that the prima facie speed limit on the
10 following streets shall be forty (40) miles per hour:
11 ALAMEDA STREET -WEST The northbound lanes on the west
12 side of the railroad right-of-way
from the north city boundary to the
13 south city boundary.
14 DISTRICT BOULEVARD From Downey Road to Atlantic
Boulevard.

16 WASHINGTON BOULEVARD From the west city boundary to
Downey Road.

a public nuisance.

SECTION 4: Section 16.16 of the Code of the City of Vernon,

23 California, 1959, is hereby amended to read as follows:
24 Sec. 16.16. Speed limits on certain street --Thirty-five miles per
hour.

Pursuant to Vehicle Code Section 22357, the city council

27 hereby determines and declares that the prima facie speed limit on the
28 following streets shall be thirty-five (35) miles per hour:

Every violation of this section by propelling a vehicle in
excess of the speed limit provided for herein is hereby declared to be
a public nuisance.
SECTION 5: Any ordinance or parts of ordinances in conflict
with this Ordinance are hereby repealed.
SECTION 6: If any section, subsection, sentence, clause,
phrase or word of this Ordinance is for any reason held to be void or
unconstitutional, such decision shall not affect the validity of the
remaining portions of this Ordinance; it being the intention of the
City Council of the City of Vernon to pass and adopt this Ordinance
and each section, subsection, sentence, clause or phrase thereof
irrespective of the fact that one or more of the sections,
subsections, clauses, sentences or phrases thereof may be declared to
be invalid or unconstitutional.
SECTION 7: There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby directed to
certify to the passage of this Ordinance and shall post the same, or
cause the same to be posted, within fifteen (15) days after its
passage in accordance with Section 36933 of the Government Code, in
three (3) of the most public places in the City of Vernon, to wit: the
northwest corner of 38th Street and Santa Fe Avenue, the northeast
corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin
board in the lobby of the City Hall of said City, located at 4305

SECTION 8: This Ordinance shall be in full force and effect
thirty (30) days from and after its passage of the same.
