Ordinance No. 10871 ORDINANCE NO. 1087 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 3 VERNON APPROVING AND AUTHORIZING AN AMENDMENT TO THE 4 CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY 5 COUNCIL OF THE CITY OF VERNON AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY 6 .7 WHEREAS, the Public Employees' Retirement Law permits the 8 participation of public agencies and their employees in the Public 9 Employees` Retirement System (PERS) by the execution of a contract, and 10 sets forth the procedure by which public agencies may elect to subject 11 themselves and their employees to amendments to said Law; and 12 WHEREAS, the PERS Board of Administration and the City of 13 Vernon entered into a contract dated October 23, 1948 (the "Contract"), 14 effective November 1, 1948, which provides for participation of the City 15 of Vernon and its employees in the PERS, and have made amendments to the 16 Contract effective April 1, 1956, October 1, 1960, July 1, 1966, October 17 1, 1972, May 1, 1974, November 1, 1975, December 1, 1976, March 1, 1979, 18 July 6, 1986, October 17, 1986, September 7, 1990, January 19, 1991, 19 September 21, 1991, December 24, 1993, October 30, 1994 and July 18, 20 1997; and 21 WHEREAS, on June 20, 2001, the City Council adopted 22 Resolution No. 7785 declaring its intention to approve an amendment to 23 the Contract to increase the retirement payout benefits to the entire 24 Safety Department, Police and Fire; and 25 WHEREAS, the City intended to adopt an ordinance amending 26 the Contract by June 30, 2002; and 27 WHEREAS, in accordance with Section 3A of the Fifth Side 28 Letter Agreement with the Vernon Police Officers' Benefit Association 1 ("VPOBA") effective September 1, 2001, the City agreed to take all 2 steps necessary to amend the retirement benefits of Group 2 employees 3 on or before July 1, 2002; and 4 WHEREAS, the City and the Vernon Fire Department have been 5 unable to reach an agreement about various benefit matters; and 6 WHEREAS, the City recently requested a new actuarial cost 7 report and contract amendment implementation schedule for police 8 members only to comply with the terms and conditions of the Fifth Side 9 Letter Agreement with the VPOBA; and 10 WHEREAS, the City Council of the City of Vernon adopte 11 Resolution No. 7978, on June 5, 2002, which declared its intention t 12 approve an amendment to the Contract; and 13 WHEREAS, Government Code Section 20471 provides that 14 approval of the Contract shall be by ordinance not less than 20 days 15 after adoption of the resolution of intention; and 16 WHEREAS, the City Council of the City of Vernon wishes to 17 amend the Contract to provide benefits under Government Code Section 18 21362.2, which provides 30 of pay at age 50 (3o at 50 Full formula) for 19 local police members only; and 20 WHEREAS, Chapters 4.3(e) and 4.4 of the Charter of the City 21 of Vernon provide that an ordinance declared by the City Council to be 22 necessary as an emergency measure for the immediate preservation of 23 the public peace, health, or safety, and containing a statement of the 24 reasons for its urgency, may be adopted in the manner provided in said 25 Charter, except that such emergency ordinance may be introduced and 26 adopted at one in the same regular or special meeting, and shall take 27 effect immediately; and 28 WHEREAS, there is an urgency in adopting this ordinance in 1 order to meet an accelerated time schedule to approve a contract 2 amendment by July 1, 2002, for the immediate preservation of the 3 public peace, health, safety, comfort, convenience and general welfare 4 of the City of Vernon and its inhabitants, employees and businesses. 5 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS: 6 SECTION 1: The "Amendment to Contract Between the Board of 7 Administration of the Public Employees' Retirement System and the City 8 Council of the City of Vernon" is hereby approved and authorized, a copy 9 of said amendment being attached hereto, marked "Exhibit," and made a 10 part hereof by reference. 11 SECTION 2: The Mayor and the City Clerk are hereby 12 authorized to execute said Amendment for, and on behalf of, the City 13 Council of the City of Vernon. 14 SECTION 3: This ordinance is declared to be urgently 15 required for the immediate preservation of the public peace, health, 16 safety, comfort, convenience and general welfare of the City of Vernon 17 and its inhabitants, and shall take effect immediately upon its 18 adoption. The following is a statement of the facts necessitating the 19 urgency: 20 a. There is a current and immediate threat to the public 21 health, safety and welfare arising from potential litigation and its 22 expense if the PERS contract amendment is not effective prior to 23 July 1, 2002. 24 b. Absent immediate correction, the City would be unable 25 to meet the accelerated time schedule to approve an amended.contract, 26 thereby detrimentally affecting the lives and quality of life of 27 residents, businesses and employees. 28 SECTION 4: There being no newspaper printed, published or 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 circulated in the City of Vernon, the City Clerk is hereby directed to certify to the passage of this ordinance and shall post the same, or cause the same to be posted, within fifteen (15) days after its passage in accordance with Section 36933 of the Government Code, in three (3) of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of said City, located at 4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles, State of California. Public Agency shall participate in the Public Employees' Retirement System from and after November 1, 1948 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except those, which by express provisions thereof, apply only on the election of a contracting agency. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class as are excluded by law or this agreement: a. Local Fire Fighters (herein referred to as local safety members); b. Local Police Officers (herein referred to as local safety members); C. Employees other than local safety members (herein referred to as local miscellaneous members). 4. In addition to the classes of employees excluded from membership by said Retirement Law, the following classes of employees shall not become members of said Retirement System: NO ADDITIONAL EXCLUSIONS 5. The percentage of final compensation to be provided for each year of credited prior and current service as a local miscellaneous member shall be determined in accordance with Section 21354 of said Retirement Law (2% at age 55 Full). 6. The percentage of final compensation to be provided for each year of credited prior and current service as a local fire member shall be determined in accordance with Section 21362 of said Retirement Law (2% at age 50 Full). 7. The percentage of final compensation to be provided for each year of credited prior and current service as a local police member shall be determined in accordance with Section 21362.2 of said Retirement Law (3% at age 50 Full). 8. Public Agency elected and elects to be subject to the following optional provisions: a. Section 21571 (Basic Level of 1959 Survivor Benefits) for local police members only. b. Sections 21624, 21626 and 21628 (Post -Retirement Survivor Allowance). C. Section 21024 (Military Service Credit as Public Service), Statutes of 1974. d. Section 20042 (One -Year Final Compensation). Public Agency, in accordance with Government Code Section 20790, ceased to be an "employer" for purposes of Section 20834 effective on November 1, 1975. Accumulated contributions of Public Agency shall be fixed and determined as provided in Government Code Section 20834, and accumulated contributions thereafter shall be held by the Board as provided in Government Code Section 20834. 10. Public Agency shall contribute to said Retirement System the contributions determined by actuarial valuations of prior and future service liability with respect to local miscellaneous members and local safety members of said Retirement System. 11. Public Agency shall also contribute to said Retirement System as follows: a. Contributions required per covered member on account of the 1959 Survivor Benefits provided under Section 21573 of said Retirement Law. (Subject to annual change.) In addition, all assets and liabilities of Public Agency and its employees shall be pooled in a single account, based on term insurance rates, for survivors of all local miscellaneous members and local fire members. b. A reasonable amount, as fixed by the Board, payable in one installment within 60 days of date of contract to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. C. A reasonable amount, as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special 'valuations on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law. 12. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Law. 13. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within fifteen days after the end of the period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may be made by direct payments between the employee and the Board. B. Paragraphs 1 through 12 are hereby stricken from said contract as executed effective July 18, 1997, and hereby replacedby the following paragraphs numbered 1 through 13 inclusive: 1. All words and terms used herein which are defined in the Public Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall mean age- 55 for local miscellaneous members and age 50 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after November 1, 1948 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except those,` which by express provisions thereof, apply only on the election of a contracting agency. I ,s 3. Emyies of Public Agency in the following classes shall becomes members of - said Retirement -System except such in each such class as are exuded by law or this agreement: a. Local Fire Fighters. (herein referred`to as local safety members); b. Local Polite Officers (herein referred to as local safety members); C. Employees other than local safety members. (herein referred to as looal ., miscellaneous members). 4. In addition to the classes of employees excluded from membership by said Retirement Law, the following classes of employees shall not become members of said Retirement System: NO ADDITIONAL EXCLUSIONS 5. The percentage of final compensation to be provided. for each year of 4redited 'a prior and current service aslocal miscellaneous member shall be determined in accordance withiSection 21354 of said Retirement Law (2% at age 55 Full). 6. The percentage of final compensation to be provided for each year of credited prior and current serviceas a local fire member shall be determined in accordance with Section 21362 of said Retirement Law 2% at age 50 Full). T: The percentage of final compensation to be provided for each year of credited prior and current service as a local police member shall ' be determined in accordance with Section 21362.2 of said Retirement Law (3% at 50 Fu '' 8. Public Agency elected and elects to be subject to the following optional provisions: a. Section 21571 (Basic Level of 1959 Survivor Benefits) for local police members only. b. Sections 21624, 21626 and 21628 (Post -Retirement Survivor Allowance). C. Section 21024 (Military Service Credit as Public Service), Statutes of 1974. d. Section 20042 (One -Year Final Compensation). F' s _ e. Section 21573 (Third Level * of 1959 Survivor Benefits) for local miscellaneous members and local fire members only. f. Section 21548 (Pre -Retirement Optional Settlement 2 Death Benefit) for local miscellaneous members and local fire members only. 9. Public Agency, in accordance with Government Code Section 20790, ceased to be an "employer" for purposes of Section 20834 effective on November 1, 1975. Accumulated contributions of Public Agency shall be fixed and determined as provided in AGovernment Code Section 20834, and accumulated Contributions thereafter, shall be held by the Board as provided in Government Code Section 20834. 10. Public Agency shall contribute to said Retirement System the contributions determined by actuarial valuations of prior and future service liability with respect to local miscellaneous members and local safety members of said Retirement System. 11. Public Agency shall also contribute to said Retirement System as follows: a. Contributions required per covered member on account of the 1959 Survivor Benefits provided under Section 21573 of said Retirement taw. (Subject to annual change.) In addition, all assets and Iiabdities of Public Agency and its employees shall be pooled in a single account, based on term insirirance rates, for survivors of all local miscellaneous members and local fire members. b. A reasonable amount, as fixed by the Board, payable in one installment within 60 days of date of contract to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. C. A reasonable amount, as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special° valuations on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law. 12. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodicinvestigation and valuation required by said Retirement Law. 13. Contributions required of Public Agency and Its employees shall.: be paid by Public Agenc-y-,to the Retirement System within fifteen days after the end of the _ period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall -be made in connection with subsequent remittances.
