ORDINANCE NO. 1097
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING THE CODE OF THE CITY OF VERNON,
CALIFORNIA, 1959, BY ADDING SECTION 2.3 TO CHAPTER
2, ARTICLE I CREATING A PUBLIC BENEFITS RESOURCE
COMMITTEE
WHEREAS, in 1996, the California State Legislature enacted
Assembly Bill No. 1890 which in part required local publicly owned
electric utilities to fund certain investments; and
WHEREAS, pursuant to Assembly Bill No. 1890, such investments
were to include new investment in renewable energy resources and
technologies consistent with existing statutes and regulations which
promote those resources and technologies; and
WHEREAS, the City of Vernon provides electrical utility
service and qualifies as a publicly owned electric utility under
Assembly Bill No. 1890; and
WHEREAS, it is the desire of the City Council to formally
establish a committee known as the Public Benefits Resource Committee
of the City of Vernon to investigate and recommend investments in
renewable energy resources and technologies consistent with Assembly
Bill No. 1890; and
WHEREAS, it is the desire of the City Council to define the
duties of said Committee and to appoint a secretary therefore.
THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct
SECTION 2: The City Council of the City of Vernon hereby

amends Chapter 2, Article 1 of the Vernon City Code by adding Section
2.3 to read as follows:
Sec. 2.3. Public Benefits Resource Committee.
(a) The City Council hereby establishes a committee known as
the Public Benefits Resource Committee and said Committee shall
(henceforth be referred to as the Public Benefits Resource Committee of
the City of Vernon.
(b) The duties of said Committee shall be to research,
investigate and recommend to the City Council investments in renewable
energy resources and technologies consistent with the provisions of
Assembly Bill No. 1890.
(c) The City Administrator for the City of Vernon shall be
the secretary for said Committee and shall perform all secretarial
duties relating thereto.
(d) The regular meeting of the Public Benefits Resource
Committee shall be held at the time and place designated by; an
appropriate resolution adopted by the City Council.
(e) The members to serve on the Public Benefits Resource
Committee shall be designated by an appropriate resolution adopted by
the City Council. Said members shall serve on the Committee until
their successors are appointed during the normal reorganization of the
Council which is provided for in Government Code Section 36801.
SECTION 3: Any ordinance, part of an ordinance, or code
section in conflict with this Ordinance is hereby repealed.
SECTION 4: If any section, subsection, sentence, clause,
phrase or word -of this Ordinance is for any reason held to be void or
unconstitutional, such decision shall not affect the validity of the
remaining portions of this Ordinance; it being the intention of the

(City Council of the City of Vernon to pass and adopt this Ordinance and
each section, subsection, sentence, clause or phrase thereof
irrespective of the fact that one or more of the sections, subsections,
clauses, sentences or phrases thereof may be declared to be invalid or
unconstitutional.
SECTION 5: There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby directed to
certify to the passage of this Ordinance and shall post the same, or
cause the same to be posted, within fifteen (15) days after its passage
in accordance with Section 36933 of the Government Code, in three (3)
of the most public places in the City of Vernon, to wit: the northwest
corner of 38th Street and Santa Fe Avenue, the northeast corner of
Leonis Boulevard and Pacific Boulevard, and on the bulletin board in
the lobby of the City Hall of said City, located at 4305
Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
State of California.
SECTION 6: This Ordinance shall be in full force and effect
thirty (30) days from and after its passage of the same.

The City Attorney is requesting that City Council establish a
committee to meet regularly in conjunction with all City Council
meetings to discuss and determine appropriate policy and action for
the development of Public Benefit Resources as mandated by State
Assembly Bill 1890 and to articulate a policy to create projects
within the City to utilize the renewal resources and support the
business community.
