AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 VERNON AMENDING SECTIONS 16.14, 16.15, 16.16, 16.17,
AND DELETING SECTION 16.18 OF THE CODE OF THE CITY
4 OF VERNON, CALIFORNIA, 1959, TO CHANGE SPEED LIMITS
ON CERTAIN STREETS AND TO REPEAL ALL ORDINANCES OR
5 PARTS OF ORDINANCES IN CONFLICT HEREWITH

7 WHEREAS, on November 2, 1999, the City Council of the City of
8 Vernon adopted Ordinance No. 1078 to establish speed limits on certain
9 streets in accordance with Speed Zone Survey dated October 1999; and
10 WHEREAS, the Community Services Department of the City of
11 Vernon has prepared a Speed Zone Survey: Engineering and Traffic Study
12 dated January, 2004 ("Engineering and Traffic Study") for the purpose
13 of evaluating existing speed limits on various streets within the City
14 of Vernon; and
15 WHEREAS, the Community Services Department has recommended
16 that the City Council accept and approve the recommendations contained
17 in the Engineering and Traffic Study and that, accordingly, the Code
18 of the City of Vernon, California, 1959, be amended by retaining
19 existing speed limits on some streets and changing speed limits on
20 other streets based on the Engineering and Traffic Study; and
21 WHEREAS, Vehicle Code Section 22357 authorizes cities to
22 determine and declare prima facie speed limits greater than 25 miles
23 per hour on the basis of an engineering and traffic survey; and
24 WHEREAS, according to the Engineering and Traffic Study, the
25 recommendations for prima facie speed limits of 30, 35, 40 and 45
26 miles per hour on certain streets will facilitate the orderly movement
27 of vehicular traffic and will be reasonable and safe on those streets;
28 and
1 WHEREAS, said Engineering and Traffic Study supports the
2 enforcement of the prima facie speed limit of 30, 35, 40 and 45 miles
3 per hour on certain streets; and
4 WHEREAS, the California legislature has established various
5 criteria for preparing an engineering and traffic survey and
6 determining speed limits therein, in order to promote uniformity
7 throughout the State; and
8 WHEREAS, Vehicle Code Section 40802 provides that radar may
9 not be used as an enforcement tool if the posted limits are set
10 without being justified in fact by an engineering and traffic survey;
11 and
12 WHEREAS, certain sections of the Vernon Code need to be
13 amended to establish the speed limits recommended in the Engineering
14 and Traffic Study.
15 THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
16 SECTION 1: The City Council of the City of Vernon hereby
17 finds and determines that the recitals contained hereinabove are true
18 and correct.
19 SECTION 2: Section 16.14 of the Code of the City of Vernon,
20 California, 1959, is hereby amended to read as follows:
21 Sec. 16.14. Speed limits on certain streets --Forty-five miles per
hour.

23 Pursuant to Vehicle Code Section 22357, the city council
24 hereby determines and declares that the prima facie speed limit on the
25 following streets shall be forty-five (45) miles per hour:

SECTION 3: Section 16.15 of the Code of the City of Vernon,
California, 1959, is hereby amended to read as follows:
Sec. 16.15. Speed limits on certain streets --Forty miles per hour.
Pursuant to Vehicle Code Section 22357, the city council
hereby determines and declares that the prima facie speed limit on the
following streets shall be forty (40) miles per hour:

SECTION 4: Section 16.16 of the Code of the City of Vernon,
California, 1959, is hereby amended to read as follows,:
Sec. 16.16. Speed limits on certain street --Thirty-five miles per
hour.
Pursuant to Vehicle Code Section 22357, the city council

23 SECTION 8: If any section, subsection, sentence, clause,
24 phrase or word of this Ordinance is for any reason held to be void or
25 unconstitutional, such decision shall not affect the validity of the
26 remaining portions of this Ordinance; it being the intention of the
27 City Council of the City of Vernon to pass and adopt this Ordinance
28 and each section, subsection, sentence, clause or phrase thereof

irrespective of the fact that one or more of the sections,
subsections, clauses, sentences or phrases thereof may be declared to
be invalid or unconstitutional.
SECTION 9: There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby directed to
certify to the passage of this Ordinance and shall post the same, or
cause the same to be posted, within fifteen (15) days after its
passage in accordance with Section 36933 of the Government Code, in
three (3) of the most public places in the City of Vernon, to wit: the
northwest corner of 38th Street and Santa Fe Avenue, the northeast
corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin
board in the lobby of the City Hall of said City, located at 4305
Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
State of California.
SECTION 10: This Ordinance shall be in full force and effect
thirty (30) days from and after its passage of the same.

SUBJECT: Speed Study — Citywide — Request for the Acting City Attorney to Prepare an
Ordinance to Adopt Speed Limits
The speed limits in the City of Vernon are established under the California Vehicle Code
Sections 627 (a), (b) which require an engineering, traffic analysis and report every five years to
validate the speeds as enforceable in a court of law. The last analysis was done in 1998 and the City
Council approved the limits in 1999. Community Services secured the services of a qualified traffic
engineering firm, Austin -Foust Associates, Inc. to do the investigation, analysis and report which is
now complete. The survey encompassed all the posted streets in the City of Vernon. The Police
Department and my staff reviewed the report with the consultant and have concluded there should be
four increased speed limits of five miles an hour to the existing speeds. The locations are as follows:
1.37t` Street from Santa Fe to Soto 35 mph to 40 mph
2. Vernon Avenue from Alameda to Santa Fe 35 mph to 40 mph
3. Pacific Blvd from Santa Fe to Fruitland 35 mph to 40 mph
4. Soto Street from Vernon to 57' 30 mph to 35 mph
I recommend we accept the recommendations of the report and, if you concur, I will request
the Acting City Attorney to prepare the ordinance for the adoption of the new speed limits.

In accordance with the California Vehicle Code Sections 627(a),(b),
the Community Services and Water Department retained the consulting
services of Austin -Foust Associates, Inc., to conduct a speed limit
study for the City of Vernon. Three locations were omitted from the
report and City staff completed the analysis and included the
locations as an addendum to the study. The Police Department in
conjunction with the consultant have reviewed the report and concluded
that the speed limits for the following locations should be increased:

Analysis
Three locations in the City of Vernon were not analyzed for speed limits by Austin -
Foust Associates, Inc. The City of Vernon Police gathered the speed data for an analysis and
the Engineering Division of Community Services inspected and evaluated the physical and
documentary information to derive the recommended the speeds in the attached Table 1-A.
This addendum shall be considered part of the Speed Zone Survey.
