ORDINANCE NO. 1107
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING SECTION 1.10 OF CHAPTER 1, SECTIONS
2.7-2, 2.24, 2.27, 2.29, AND 2.49 to 2.66 OF
CHAPTER 2, REPEALING SECTION 2.28 OF CHAPTER 2 AND
ADDING SECTIONS 2.29-4, 2.67 AND 2.68 TO CHAPTER 2
OF THE CODE OF THE CITY OF VERNON, CALIFORNIA,
1959, AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT THEREWITH
WHEREAS, the City of Vernon (the "City") is a municipal
corporation and a chartered city of the State of California organized
and existing under its Charter and the Constitution of the State of
California; and
WHEREAS, certain corrections, additions and amendments are
needed to clarify inconsistencies, improve the application of the
Vernon City Code provisions and clarify the intent of the City Council
in implementing said provisions; and
WHEREAS, Chapter 8.10 of the Charter of•the City of Vernon
provides that there are no bidding requirements for any contract unless
the City Council adopts an ordinance providing therefore; and
WHEREAS, on April 2, 1985, the City Council of the City of
Vernon adopted Ordinance No. 950, as amended by Ordinance No. 1095 on
June 4, 2003, establishing Separate Funds; and '
WHEREAS, the City Council of the City of Vernon intends to
modify, establish and create additional Separate Funds in accordance
with state statutes and sound public accounting requirements; and
WHEREAS, Chapter 4.1(f) and (h) of the Charter of the City of
Vernon provides that an ordinance shall amend a code or repeal any
ordinance or code previously adopted.

THE CITY COUNCIL OF THE CITY OF VERNON HEREBY ORDAINS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
land correct.
SECTION 2: The City Council of the City of Vernon hereby
amends Chapter I, General Provisions, of the Vernon City Code by
amending Section 1.10 to read as follows:
sec. 1.10. Three posting places for ordinances designated.
The three most public places in the city for the posting of
notices and other documents required to be posted by city officials
under the laws of the state, or the ordinances adopted by the city, are,
hereby fixed and designated as the northwest corner of 38th Street and
Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific
Boulevard, and on the bulletin board located outside on the wall near
the second floor entrance to the City Hall of said City, located at
4305 Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
State of California.
SECTION 3: The City Council of the City of Vernon hereby
amends Chapter 2, Article II, City Administrator, of the Vernon City
Code by amending Section 2.7-2 to read as follows:
Sec. 2.7-2. Compensation and expenses.
The city administrator shall receive compensation competitive
to private industry and commensurate to the tasks to be undertaken at
an exclusively industrial city, managing various enterprises and
developing and supporting businesses. The city council may, at the
beginning of each fiscal year, specify the total executive income
package to be paid to the city administrator, for that particular
fiscal year, which shall include total base salary, expense allowance

1 compensation, executive leave compensation, vacation pay income,
2 medical expenses reimbursement income, retirement plan compensation and
3 other benefits and perquisites which accrue to the office of the city
4 administrator.
5 The total income amount for compensation and expense
6 allowances shall be in addition to the sums which may be reimbursed to
7 the city administrator from time to time throughout the fiscalyearfor
8 expenses incurred or paid by him for conducting the business of the
9 city.
10 The city administrator shall receive such compensation and
11 expense allowances as the council shall, from time to time, determine,
12 and such compensation and expenses shall be a proper charge against
13 such funds of the city as the council shall designate.
14 The city administrator shall be reimbursed for all sums
15 necessarily incurred or paid by him in the performance of his duties,
16 or incurred when traveling on business pertaining to the city under the
17 direction of, or with the express consent of, the council.
18 Reimbursement shall be made only in accordance with an itemized claim
19 setting forth the sums expended or obligations incurred in the manner
20 provided by the council for the presentation of claims for
21 reimbursement of expenses of other city officers and employees,.
22 SECTION 4: The City Council of the City of Vernon hereby
23 amends Chapter 2, Article IV, Purchasing System, of the Vernon City
24 Code by amending Sections 2.24, 2.27 and 2.29, adding Section 2.29-4
25 and repealing Section 2.28 as set forth in Exhibit A which is attached
26 hereto and incorporated by reference. Those sections or subparagraphs
27 not expressly identified in Exhibit A shall remain unchanged.

SECTION 5: The City Council of the City of Vernon hereby
amends Chapter 2, Article VIII, Separate Funds, of the Vernon City Code
by amending Sections 2.49 through 2.66 and adding Sections 2.67 and
2.68 as set forth in Exhibit B which is attached hereto and
incorporated by reference.
SECTION 6: Any ordinance, part of an ordinance, or code
section in conflict with this Ordinance is hereby repealed.
SECTION 7: If any section, subsection, sentence, clause,
phrase or word of this Ordinance is for any reason held to be void or
unconstitutional, such decision shall not affect the validity of the
remaining portions of this Ordinance; it being the intention of the
City Council of the City of Vernon to pass and adopt this Ordinance and
each section, subsection, sentence, clause or phrase thereof
irrespective of the fact that one or more of the sections, subsections,'
clauses, sentences or phrases thereof may be declared to be invalid or
unconstitutional.
SECTION 8: There being no newspaper printed, published or
circulated in the City of Vernon, the City Clerk is hereby directed to
certify to the passage of this Ordinance and shall post the same, or
cause the same to be posted, within fifteen (15) days after its passage
in accordance with Section 36933 of the Government Code, in three (3)
of the most public places in the City of Vernon, to wit: the northwest
corner of 38th Street and Santa Fe Avenue, the northeast corner of
Leonis Boulevard and Pacific Boulevard, and on the bulletin board in
the lobby of the City Hall of said City, located at 4305
Santa Fe Avenue, all in the City of Vernon, County of Los Angeles,
State of California.

SECTION 9: This Ordinance shall be in full force and effect
thirty (30) days from and after its passage of the same
APPROVED AND ADOPTED this 27th day of April, 2005.

CHAPTER 2. ADMINISTRATION
ARTICLE IV. Purchasing System.,
Sec. 2.24. Bidding generally.
The purchases and contracts for supplies, services, equipment,
public works, and the sale of personal property shall be in accordance
with the procedures set forth in sections 2.29, 2.29-1, 2.29-2, 2.29-3
and 2.29-4.
Sec. 2.27. Alternative procedures.
(a) In the event that the purchasing agent finds that it is in the
public interest and necessity, the purchasing agent may make a purchase
or enter into a contract without compliance with the procedures set fort
in this article.
Sec. 2.28. Repealed.
Sec. 2.29. Open market procedure.
Purchases and contracts for supplies, services, equipment, and the
sale of personal property may be made by the purchasing agent in the open
market.
(a) Minimum number of bids. Open market purchases and contracts
shall, whenever possible, be based on at least three written bids.
(b) Lowest responsible bidder. To the extent practicable such
purchases and contracts shall be awarded to the lowest responsible
bidder.
(c) Notice inviting bids. Bids may be solicited by written or
telephone request from prospective vendors or contractors.
(d) Negotiation. The purchasing agent in consultation with the

originating department may negotiate any such purchase or contract, or
may call for sealed written bids to be submitted by a date and time
specified.
(e) Sealed written bids. When sealed written bids are required,
they shall be submitted to the purchasing agent prior to the date and
time specified, but shall not be opened prior thereto.
(f) Record. The purchasing agent shall keep a record of all open
market bids and orders for a period of one year after the submission of
bids or the placing of orders. This record, while so kept, shall be open
to public inspection.
(g) Rejection. The purchasing agent may reject all written bids
and may subsequently negotiate any such purchase or contract, or call for
rebids.
Sec. 2.29-4. Formal contract procedure.
The city council may by resolution direct purchases and contracts
for supplies, services, equipment, public works, and the sale of personal
property of an estimated value greater than twenty-five thousand dollars
($25,000.00) and the purchase of all vehicles shall be by written
contract awarded to the lowest responsible bidder in the case of a
purchase or contract, on to the highest responsible bidder in the case of
a sale, pursuant to the procedures prescribed herein. No notice inviting
bids shall be issued except as authorized by resolution of the city
council.
(a) Notice inviting bids. Notices inviting bids shall distinctly
state the project to be done, the articles to be purchased or sold,
shall state where bid blanks and specifications may be secured and the
time and place for opening bids:

1 1. Published notice. Notice inviting bids shall be
2 published at least ten days before the date of opening of the bids.
3 Notice shall be published at least once in a newspaper of general
4 circulation, printed and published in the city, or if there is none, it
5 shall be posted in at least three public places in the city that have
6 been designated by ordinance as the places for posting public notices.
7 2. Bidders' list. The purchasing agent shall also solicit
8 sealed bids from prospective suppliers whose names are on the bidders'
9 list or who have requested their names to be added thereto.
10 Unintentional or inadvertent failure to notify any one or more
11 prospective suppliers shall not affect the validity of any purchase or
12 award of any contract.
13 (b) Bidder's security. Bidder's security shall be prescribed in
14 the public notices inviting bids. Bidders shall be entitled to return
15 of bid security; provided, that a successful bidder shall forfeit his
16 bid security upon refusal or failure to execute the contract within ten
17 days after the notice of award of contract has been mailed, unless the
18 city is responsible for the delay. The city council may, on refusal or
19 failure of the successful bidder to execute the contract, award it to
20 the next lowest responsible bidder. If the city council awards the
21 contract to the next lowest bidder, the amount of the lowest bidder's
22 security shall be applied by the city to the difference between the low
23 bid and the second lowest bid, and the surplus, if any, shall be
24 returned to the lowest bidder.
25 (c) Bid opening procedure. Sealed bids shall be submitted to the
26 city clerk and shall be identified as bids on the envelope. Bids shall
27 be opened in public at the time and place stated in the public notices.
28 All bids received shall be open for public inspection during regular

business hours for a period of not less than thirty calendar days after
the bid opening.
(d) Rejection of bids. In its discretion, the city council may
reject any and all bids presented and readvertise forbids.
(e) Award of Contracts. Contracts shall be awarded by the city
council to the lowest responsible bidder except as otherwise provided
herein.
(f) Tie bids. If two or more bids received are for the same
total amount or unit price, quality and service being equal, and if the
public interest will not permit the delay of readvertising for bids,
the city council may accept the one it chooses or accept the lowest bid
made by negotiation with the tie bidders.
(g) Performance bonds. The city council shall have authority to
require a performance bond before entering a contract in such amount as
it shall find reasonably necessary to protect the best interests of the
city. If the city council requires a performance bond, the form and
amount of the bond shall be described in the notice inviting bids.
